HomeMy WebLinkAboutCouncil Resolution 535RESOLUTION N0. 535 A RESOLUTION GRANTING TENTATIVE APPROVAL OF PRELIMINARY PLAT FOR JACKSON CREEK ESTATES UNIT NO. 2 WHEREAS, subdivider Tom Malot has submitted a preliminary plat for Jackson Creek Estates Unit No. 2, a subdivision located at the easterly extensions of Brandon and Vincent Streets within the City, and WHEREAS, the Planning Commission of the City on January 2, 1990, by Planning Commission Resolution No. 179 has reviewed said application for approval of preliminary plat and has recommended approval subject to the conditions set forth in the staff report of the Public Works Department, and WHEREAS, the City Council of the City of Central Point held a public hearing upon said application for approval of the preliminary plat on January 18, 1990, pursuant to Central Point Municipal Code Section 1.24.020D, and having at said public hearing received and reviewed the City staff report and testimony, and being fully advised, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Based upon the staff report, evidence, and record relating to said application, the City Council hereby finds that said application meets the requirements for preliminary plat applications, that said preliminary plat as proposed is in compliance with the City's comprehensive plan and zoning code, and if the conditions set forth hereinafter are met, said application meets the City's requirements. for subdivision layout, park dedication, street standards, water system standards, sanitary sewer standards, and storm drainage standards. Section 2. The City Council hereby grants tentative approval of the preliminary plat submitted by subdivider Tom Malot for Jackson Creek Estates Unit No. 2, subject to the. conditions set Forth in Exhibit A, attached hereto, and by this reference expressly made a part of the within resolution. Section 3. This action of the Council shall be noted on two copies of the preliminary plat, including reference to the conditions set forth. in Exhibit A, with one copy to be returned to the subdivider and one copy to be retained in the City planning files with a memorandum setting forth the action of the RESOLUTION NO. 535 - 1 (JACKSONC.RES - 010890] Council, as required by Central Point Municipal Code Section 16.24.080. The City's engineer shall be used, and the develoeer shall pay for the cost of these services. A street lighting plan shall be included in the construction documents according to the requirements of PP&L. All intersections shall be illuminated. Developer to install all pads and conduits for street lights as a part of the construction of the subdivision. The developer shall also pay for street lights and for the installation of all street lights in this subdivision. 5. The developer shall construct a valve at the end of the strut in this phase for the future. connection of the next phase of this development. 6. Ladder rungs shall be installed in each sanitary sewer manhole of a depth greater than 3.0 feet to the flow line of the manhole. Developer shall use ladder rungs approved by the Central Point Public Works Department. i. There is a small seasonal stream which r"lows through this property. Developer shall construct a storm drainage system which collects the flow from this subdivision and carries. through this subdivision in such a manner as tc not cause flooding of any lot in or drainage area of this 5 seasonal stream. 8. Developer's engineer shall evaluate the do4mstream structures of the drainage system which provides discharge for this. subdivision. If it is determined that any structure(s) Can not meet the flaw reoulrement not to exceed a 100 year flood the developer shall improve said structurefs) to meet this requirement. Said. imcrovement shall be done according to the plans completed by Developer's engineer and approved by the Central Point Public Work's Department. 9. Catchbasins must be located no greater than 350 feet for any section of curb and gutter. 10. Developer shall design the storm drainage system to prcvide for discharge of ereperties in future phases or within the drainaae service area of this subdivision's storm drainage system. 11. As originally approved in Jackson Creek Estates Unit #1 the developer shall provide ozrk land in lieu of paying a 3200.C0 per let development fee fOr prop^crLY lOCated along Griffin Creek Park Maser Plan. Property to be dedicated shall be done according to the requirements set forth in Title 16.20. Basee en Title 16.20, 700 square feet per lot or a total of 18,900 square feet (27x700 = 18,900 square feet) shall be dedicated. 12. The developer shall install or cause to install conduits for utilities at intersections. or locations determined by utility companies and utility companies who will not install their servic=_s until after the subdivision is constructed. The developer shall be responsible for all costs associated with the installation of these conduit crossings. 13. ,4 subdivision Agreement shall be approved by the City Council prior to issuing a permit for construction of this subdivision. _14. All construction for utilities, streets and other structures discussed herein :vithin rights of ways owned or to be owned by the City of Central Point, shall be done so according to all rules, regulations, ordinances, resolutions, and other applicable requirements of the Cit;r of Central Point for construction of this subdivision. 15. The final plat r"or this subdivision shall not be approved by the City Council until all conditions as herein stipulated and as approved for this subdivision have been met. 16. The preliminary plat review for the preliminary plat submitted herein by Tom Malot Construction was done in accordance with the rules, regulations and ordinances in effect as of the date of this review. Any modifications by the developer which would allow this subdivision not to meet standards set forth in the Central Point Municipal Code or would require staff to complete a new preliminary plat review shall require a new submittal of preliminary plat for City approval. If it is determined that insufficient -flow less than 1000 gpm is unattainable for fire flow in this subdivision, the developer shall make the necessary corrections to the existing water system within this subdivision to obtain the required fire flow. The correction(s) shall be completed as a part c-" the construction of this subdivision. 18. Developer shall construct the storm drainage system tcc meet the requirements set forth by the Department of Environmental Quality for biochemical oy,ygen demand,. suspended solids, ammonia, and phosphorus... Any correction to the storm drainage system shall be completed during the construction of this subdivision. 19. Brandon Street from Jackson Creek Drive to the last lot 49 & 50 is greater than 400' in length and serves more than 12 lets. Since 3randon Street will eventually expend past this point in future phases of this subdivision; a temporary turn around shall be installed. The timing for this requirement shall be completed on or before September 1, 1990, or prior to issuing a building permit r'or lets 49 and/or 50. The temporary turn around shall be approved by the Central Point sire Department, and Public Works Department. 7
