PLANNING COMMISSION 8:00 P.M.
REGULAR MEETING
October 28, 1969
Present: Jantzer, Langston, Novosad, Bruce, and Backes.
Meeting was called to order by the Chairman, Bill Langston.
Minutes of the previous meeting were read and approved.
Mr. Gene E. Skelton, 459 Grand Ave. , Central Point, presented a request
for a conditional use permit, to allow a home Occupation at 780 Ash St.,
as he is having a new residence built there. The business will be known as
"Eb-Tide Aquariums", and will consist of the sale of Tropical Fish and
Equipment.
A motion was made by Jantzer to call for a Public Hearing, for this
request. The time set.would be at the next regular meeting of the
Planning Commission, November 25, 1969, at 8:00 P.M. The motion was
seconded by Novosad. Motion Carried.
Further study of the Ordinance on Conditional Use showed this type of
business would not be allowed as a Home Occupation, at the sales were
the primary business listed.
Mr. Skelton stated that he would amend his application to show that his
primary business would be "Fish Tank Repair and Allied Services", with
the repair service being the primary business, with only a small quantity
of fish to be maintained for sale.
Since Mr. Skelton stated. he would amend his application, the Planning
Commission decided to let the motion calling for a Public Hearing stand
as passed.
A discussion of Article VII, Section 7.010. Variances, which reads as
follows:
Where practical difficulties, unnecessary hardships, and results incon-
sistent with the general purposes of this ordinance may result from
the strict application of certain provisions thereof, variance may be
granted as provided in this article. This article may not be used to
allow a use that is not in conformity with the uses specified by this
Ordinance for the District in which the land is located. In granting
a variance, the City may impose conditions similar to those provided for
conditional uses to protect the best interests of the surrounding pro-
perty, the neighborhood or the City as a whole.
Novosad made a motion to recommend to the City Council, that the words,
"Uses specified by", be changed to the words, "Intention of", in this
Ordinance, to make it easier in understanding and application of this
Ordinance. Mr. Jantzer stated, "We feel we need a little latitude to help
in these situations". Motion seconded by Backes. Motion Carried.
A motion was made by Jantzer to adjourn. 2nd by Novosad. Motion Carried.
