Citizen's Advisory Committee
Minutes
October 11, 2005

Meeting Caged to Order
II. Roll Call: Walter Moczygemba, Chairman; Herb Fazber; David Painter; Peg
Wiedman, and Joe Thomas were present. Sam Inkley Sr was absent; Sam Inkley,
Jr. arrived after roll call.
Also in attendance was Tom Humphrey, Community Development Director;
Don Burt, Interim Planning Manager and Lisa Morgan, Planning
Technician.
III. Minutes
The minutes from August 16, 2005, were unanimously approved.

V. Business
A. Proposed Code Cbaages
Tom Humphrey, Community Development Director wen[ over the hand out regarding
status on the code amendments that were brought to the Citizens Advisory Committee in
July, 2005.
There were discussions regarding flag lots and that easements to access [he lots should
not be included in determining lot sizes. Mr. Humphrey illustrated the different flag lot
configurations on the board.
Mr. Humphrey summarized projects that the City has before them in the neaz future. He
explained that the City is approaching the end of the 20 year Comprehensive Plan, we are
looking at a full periodic review of the TSP, combining Chapters 16 (Subdivisions) and
17 (Zoning) which would be similar to a LUDA that other cities use.
Don Burt, Interim Planning Manager presented [he proposed code changes. Mr. Burt
began with the definition section. He explained the purpose is to streamline [he
definition portion of the code, eliminating the numerical code numbers and to include
them all under one number.
Mr. Bur[ went over the proposed building height, and how the new proposal would
determine setbacks by height /building mass rather than trying to determine [he number
of stories. There were discussions how this calculation was arrived at, and if it would
actually make the setback requirement less. Mr. Burt went through a couple of examples
on how the setbacks would be determined.
Mr. Burt explained that it should work out to be about the same, and [his is just a starting
point and staff could bring something back [o the CAC on the formula for determining
setbacks based on height, if necessary.
He continued with the proposed amendments regarding [he modifications made to
17:20.050 to add a minimum and maximum density, as well as minimum and maximum
lot areas, lot widths and lo[ coverage allowances.
Mr. Burt proposed to eliminate the section regarding distances between principal and
accessory structures since the Building code can regulate this.
The rest of the proposed changes involved creating tables for single family, two-family
and multiple family districts and incorporating the lot coverage section into the tables.
There aze proposed changes in establishing minimum and maximum densities; ranges
established for minimum and maximum lot sizes within each zoning district; and
increasing [he maximum lot coverage.
In the TOD District, the code currently does not allow residential uses in the GC, General
Commercial zoning district. Since activities in this district are oriented to encourage
pedestrian travel, residential uses above ground floor commercial activities would be
consistent with the purpose of the zone. The proposed amendment is to allow residential
uses above ground floor commercial uses if the residential use is compatible with the
commercial use. There was a recommendation [o make this a conditional use to ensure
that the residential use would be compatible with the commercial use below.
Mr. Burt continued to the next proposed amendment to reduce the minimum lots from 16
to 14 in the TOD-MMR, Medium Mix Residential zoning district to be more consistent
with lot area requirements.
The last proposed code amendment is to eliminate Planned Unit Developments (PUD's)
on sites less than 5 acres. By amending the other areas mentioned before enables greater
flexibility in the R-1, Single Family districts.
The Citizens Advisory Committee recommended approval of the proposed code
amendments with adding the Conditional Use requirement for residential uses in
the TOD-GC, General Commercial zone.
VI. Miacellaneooa
Mr. Humphrey informed the Citizen Advisory Committee that the City will be
purchasing a portion of property from the Burton Family [o develop another parking lot
adjacent to the Library and City Hall.
