Krupp _ absent L. L. Dysinger - present Wm Askwith absent his meeting was called by president Bigham, for the express purpose of considering a tentative plat of sub-division proposed by one Bud M. Smith .of his property described DR 2$$-204, March, 1950, in which he proposed to give 25 feet rightFof way adjoining on the south side and paralleling an existing right of way between said Bud M. Smith and Bert Peck properties; and a 50 foot right -of way north and south, more or less exactly so, the middle of which would be approximately 130 feet east of the west line. of D, L. C. No. 55 DR 2$$-204. In coming to conclusion in this matter and considering lot sizes and property values resulting from this sub-division, it is well under- stood and recognized that Bud M. Smith will deed these rights of way to the City of Central Point, withholding in such an instrument full right to use of a certain well now exixting on that property, which will be situated within the area granted for sidewalk. Motion was made by Commissioner Kincaid that Mr. Smith19 proposal be accepted by the Commission. Second to the motion was made by Comm- issioner Maier, and the motion was carried by unanimous vote. Where- upon motion was made by Commissioner Dysinger that the Commission recommend to the Common Council, acceptance of the plat. Seconded by Commissioner Maier and carried, again by unanimous vote. of It shall bellrecordj� that the said Bud M. Smith is at this meeting presenting a preliminary plat only; it is accepted as such, and in n0 way shall be honored except as a declaration of intent. Said Bud M. Smith having stated that he will submit a legal plat for redord, embodying the provisions as concluded in this meeting. The business of the meeting having been consumated, motion to ad- journ was made by dommissioner Kincaid and the motion seconded by Commissioner. Dysinger. Motion carried. $:33 PM Lyland L.
