August 15, 1978 - Council Chambers ,
Meeting called to order by Vice-Chairman Richard Halley at 7:30 P.M. Roll call
found Members Emery, Loveland, Mann, McManama, Nordby and Halley present. Ab-
sent were Messmer and Waldron and Chairman Don Banks away on vacation. Others
present were City Engr. Hendershot, Bldg. Insp. Ritchey and Secretary Stamper.
Approval of Minutes of Meetings held June 20, 1978, July 5, 1978 and August 1,
1978 were made in motion by Loveland, seconded by Mann and carried with all in
favor.
No correspondence to come before the Commission.
Public Appearance was made by James T. White of 118 North Fifth Street at the
request- of the Commission. Mr. White had appeared at the Meeting of Au st 19
1978 with a request for a 10' setback in Lot 5 of Block 51 (Tax Lot 900rfor
parking requirements per ordinance. At that meeting the variance was granted
to accommodate 6 parking spaces; however, it was determined that only 5 spaces
were required and therefore,- no need for the variance. Planning Commissioners
recommended return of fees paid to the Applicant, but in discussion, fees will
be applied toward his building permit to be issued at a later date. Motion

lot is created. Discussion. Member Halley stated some lots in the City are in
the category that if utilization of the land is accomplished to their fullest,
the non-acceptable or below standard lots can be the only resultant; according
to our ordinances at the present time. Bldg. Inspector answered questions df
width of private driveway can be from 12 to 20 feet wide! More discussion;
if private driveway was allowed, the City could not maintain the roadway as a
City road. Recommendation of turn-around space at the most northerly portion
of the driveway to prevent backing out onto Scenic Avenue. Discussion and
reading of Ordinance 16.36 for "Variances". Motion by McManama seconded by
Nordby to set a public hearing for September 5, 1978 for "the Variance creation
of a flag lot on the basis of economic hardship and removal of a fire hazard".
Ordinance 16.44.050 was read. By roll call vote, motion carried unanimously
to set a public hearing for September 5, 1978 to resolve this matter.
Miscellaneous Matters
Prolem of street trees overhand into the street's right of way and hazards that
may be created by not trimming trees to drivers using the curbside of the right-
of-way. Discussion. One such area in the City is at the southwest corner of
Maple and North Sixth. Problem to be referred to the Street Tree Committee of
Council.

hurry up and use it?' Mr. Thelen spoke again and stated as his property is
directly behind the Applicant' s he would object to mis-use of the property
and the splitting it for another tax lot and dwelling doesn't appear to be a
good answer. No further questions for or against the request, the public
portion of the hearing was closed. Discussion by Councilmembers; Eliminate
a potential fire hazard, the responsibility of the Planning Commission to
see that land is developed to its best potential, Existing ordinance pro-
hibits creating a flag lot. Member Halley asked Mr. Wells if he had investi-
gated all avenues to use his property. Mr. Wells responded "Yes". Member
Emery stated it was a case "of value versus value and therefore pros and cons
to both sides". Member Waldron comments that the way the ordinances are
presently written that the Planning Commission must go along with them and
recommended it go to the City Council for them to create a flag lot in
instances where merited and not change the existing ordinance! More discus-
sion. McManama made a motion to deny the request for creation of a flag lot
at 1954 Scenic Avenue. Member Nordby seconded. Roll call vote found all
members in favor to deny the request for variance to create a flag lot based
on the City Attorney's opinion. Motion carried to Deny the request.

Department as they would determine if traffic could cross the double-yellow
traffic lane or a lane made for such a usage. Bldg. Dept. Official was asked
to insure that parking spaces be 9 feet wide(as a new restaurant in town does
not! ) (Building Dept. will check up on this complaint.) Motion to approve
the Preliminary Plat Review which changes of Drive-Up Station placement and
slanted parking on east side of ingress way off of Pine Street parking lot
with Revised plans be brought to the next Planning Commission meeting
scheduled for 9/19/78 incorporating changes; made by Waldron, seconded by
McManama and by roll call vote, passed with all in favor. Matter reset to
meeting of 9/19/78.
Miscellaneous Matters
1. Member Waldron inquired about parking lot paving for Gary Yost's apart-
ments on North Tenth Street built last year and requirement that the lot be
paved. Secretary to research this matter.
2. City Administrator Kucera brought into discussion "Zero Lot Line" concept
by Developer Bud Adler (Mr. Adler had appeared before the Planning Commission
on their meeting of May 16, 1978) for possible construction of a Planned Unit
Development at the Hopkins-Burseld Road area. Applications will have to be
made and process through the system according to ordinances with considerations
given in the areas of zoning, variances, P.U.D. , and possible annexation pro-
ceedings later. The first public hearing is set for October 3, 1978 meeting
of the Planning Commission tot-receive input on this new concept.
3. Commissioner Halley inquired about what happened to his request for trim-
ming of trees on North Sixth Street and Maple, southwest corner. Answer not
available.
4. Poppy's Pizza has painted parking lot strip spacing with less than 9'
between strips. Bldg. Dept. Official Ritchey will measure and report back if
corrections are needed. - .
5. Member Mann asked if the Planning Commission can require an applicant
such as Big Al's Restaurant to pave an alley from street to street (Item F
above). Discussion. Answer was that the Planning Commission can require any
regulation they determine as necessary as part of the conditions.
No further business to come before this Body, motion made by Member Waldron
to adjourn, seconded by Loveland and approved by all.
