March 21, 1978
0 Meeting was called to order at 7:35 P.M. by Vice-Chairman Richard Halley. Roll call
found the following Commissioners present: Halley, Hiilyer, Emery4, Loveland and
Waldron. Absent members were Messmer, Mann and McManama as well as Chairman Don
Banks. Others present were City Admin. Kucera, Bldg. Insp. R.J. Ritchey and Secre-
tary Stamper.
Minutes of March 7, 1979 meeting were approved without discussion, in a motion made by
Paul Emery, seconded by Andy Loveland. Roll call vote was unanimous and motion carried.
Correspondence
Letter received from Joan A. Kilby requesting extension of their Conditional Use Permit
for Old Oak Tree Mobile Rome Park which was due to expire on April 13, 1978; citing
weather and drainage problems had prevented any start-up of construction. Discussion
held. Extension to be given for 1 year from date the Conditional Use is set to expire
in motion by Emery, seconded by Waldron. Roll call vote the motion carried unanimous-
ly. The extended date is April 13, 1979.
Letter received from Robert S. Smith requesting extension of time to start a low-cost
housing project as government red-tape and much paperwork has held up the site plans
for HUD financing, from their date of 6/21/78. Mr. Smith anticipates 3-5 months before
he receives their approval. Discussion held. Motion by Emery seconded by Loveland to
extend Mr. Smith's start-up construction time to 6/21/79. Roll call held. Motion
carried unanimously.
0 Old Business
1068 Review for Ernest & Patricia Himmelman for triplex construction at 123 No. Second
Street, T.L. 7200, Block 12 of Original Town. Bldg. Insp. Ritchey questioned lands-
caping plans and suggested "eyebrow" around building. Mrs. Himmelman stated existing
lawn will remain, low shrubs and ground cover to be south and rear with asphalt at
other bare areas. Will add brick planters at entry ways and whatever the City- recom-
mends. Motion by Loveland to accept the landscaping plans as explained. All other
plans have been approved in prior Planning Commission meetings with Cityi•recommenda=
tions. Motion to accept landscaping plans was by show of hands and was unanimous.
Next order of business was Preliminary Plat Review for John Blair and Gary-Yost,
applicants, for property near North 10th- and Laurel Streets, J.C. map page 37 2W 2CB
Tax Lot 7301, for construction of 5 - 4-plexes. Discussion on sewer and waterline
requirements and hookups for sewer and size of line. Applicants want to connect to
already private 8" sewer line on Laurel Street they had already installed to serve 2
buildings to reduce costs to developers. Discussion of possible future sewer problems
if they wereto sell off buildings, and whose responsibility would it be. The City
could be held responsible in future years if theis were allowed. The Council's Public
Works Committee and the Public Works Supt. of the City do not want multiple use from
single connections per City Admin. Kucera and recommended this matter be referred back
to Public Works Committee for further study. Also discussed was establishing a local
improvement district for 10th Street. 8" line construction for water was given to be
$10415 per foot. Kucera said developers would bear cost of waterline construction.
Discussion by Commissionmembers to put this matter to a study session to see if costs
0 could be shared by developers and City for future City development to No. 9th Street:
Items to consider - 1. Public Works Committee to recommend to the Planning Commission
on the sewer line to service the one lot. 2. Burden- of costs between Developer and
City for 8" water line for loop development on 10th Street for future City use; as

water system in area is poor. Council's intentions is to subsidize the water line
on No. 10th Street stated City Admin. Kucera; approx. 704 of cost will be absorbed
by City.
Mr. Yost requested to develop the lots on Maple Street as the last portion of the
subdivision. City Admin. Kucera said bonding. procedures are available to insure
completion of a subdivision and the City cannot allow conditions within - the sub-
division before "finals" are granted; as preaent ordinances must be met. c,which
dictate all improvements must be in before the City can sign-off to accept a sub-
division. City Admin. Kucera suggested talking to City-Atty. to work out question-
able items to allow developer to get sgarted and building permits issued. Discus-
sion on Council's intent to change ordinance to allow developers to start construc-
tion before all City-required improvements are finalized. Suggested solution to
the Laurel Street problem is to make 3 northern lots in l phase of the development
and the remaining southerly lots as a second phase; or the last 2 lots in a minor
partition process.
Park land requirement was also discussed per Ord. 16.20.060 and money in lieu of
land per Ord. 16.20.040 (164th-acre for each dwelling unit is required). Ordinance
read aloud by R.J. Ritchey. Mr. Blair questioned City Admin. if developer can re-
quest a local improvement district for themselves to the City Council and if the
developers are to put in 2 streets? Kucera answered yes, they can apply for Ban-
crofting for a L.I.D. for Laurel. and 9th Streets. Finery made motion to continue for
a Preliminary Plat Review on April 4th. to discuss sewer hookup for 'the south 2 lots;
2. 8" waterline and costs borne by Developer; 3. Developer and City,to share costs.
Commissioner Waldron seconded motion. Motion carried unanimously. i
New Business
Everett Evenson & Don McBride as applicants for Preliminary Plat Review for multi-
family apartment complex. to be. constructed at 715 Hopkins Road, J.C. map 37 2W
11A, Tax Lot 12009 were not present and the matter was tabled to an unknown future
date.
Next order of business was a 1068 Review for triplex construction on parts of Lots
6. and 7 of Block 23 of Original Town, J.C. map page 37 2N 11BB (next to 360 South
Second ), and Patrick Henderson of Design Trends representing the applicant Terry
McCardle. Staff report prepared by R.J. Ritchey read into record. Parking require-
ment per Ord. 17.64.070. "D" were discussed. Interpretation is that this.will be
4-separate driveways with medians in-between. Commissioner Emery made motion to
allow parking plans as acceptable as if it were applicable to single family habit-
ation, seconded by Member Waldron. Roll call vote, all in favor with exception
of Member Hillyer who voted "NO". Reference was then called to Ritchey Staff
Report item- 6 - Domestic well. Henderson stated it would only be used for irri-
gation purposes and- to connect to an underground sprinkling system installed for
landscaping maintenance. Discussion that, the manhole cover be "standard" and have
a safety-locking device affixed as part of City requirements. Motion made and
seconded to add this as a City requirement to the Bldg. Dept. report and accept
the 1068 Review with recommendations.
Wayne Van Wey, applicant for 1068 Review for construction of apartment at 260 No.
Fifth Street, J.C. map page 37 2W 3DA, the south one-half of Tax Lot 11900 in
Block 56 of Original Town, was present in the audience. Staff Report prepared
and read into the record by R.J. Ritchey. .Commissioner Waldron made motion to
accept the staff report with provision that applicant must supply a copy of the
recorded survey at the City Hall prior to construction. Motion was seconded by
Loveland. Roll call vote, motion carried by unanimous vote.

New Business (continued)
The order of business next was Don Boyd as applicant for 1068 Review for construction
of a 1-unit (to add to an already built 2-units on property located at 637-639 Maple
Street; J. C. map page 37 2W 3DA,' Lot 7 of Block 67 Original Town. Staff report
read by R.J. Ritchey. Discussion of paving the alley to get to the off-street park-
ing as provisioned under Ord. 17.64.070 was determined to not be a requirement for
the applicant to pave any portion of the alley. All hands were raised in vote and
showed paving of alley as a non-requirement. Motion was made by Member Loveland to
approve the 1068 Review as presented, seconded by Member Emery. All in favor by roll
call vote. Motion carried.
No further business to come before the Commission, motion by Waldron and seconded by
Loveland to adjourn. All in favor motion carried. Meeting adjourned at 9:55 P.M.

for the development of the Park based on inclement weather conditions and
correcting of drainage problems in the area. Extension granted for 1. year

review near North 10th and Laurel Streets, J.C. map page 37 2W 2CB Tax Lot 7301.
for construction of 5 - 4-plexes. Discussion on sewer and water line requirements
and hookups and sewer line size and question of starting Local Improvement District.
Staff Report recommended improvements to conform to City Ords. for streets, curbs,
etc., and who bears costs. Also discussed was money in lieu of park land dedication.
Builders indicated they would prefer to build in "phases". Referred to Council
Public Works Committee for study session. Preliminary Plat review set for
April 4th meeting if problem areas can be resolved.
5. 1068 Review for Triplex construction at 360 So. Second Street, Patrick Henderson
representing applicant Terry McCardle. Lots 6 & 7 of Block 23 of Original Town
A roved with City recommendations of curbs, gutters and sidewalks (part of Staff-
Report and added requirement of locking safety device on manhole cover over well
to be used for irrigation purposes for underground sprinkling system.
6. 1068 Review for construction of apartment at 260 North Fifth Street, Wayne
Van Wey applicant. Recommendation of staff report accepted and additional require-
ment of Planning Commission for copy of legal survey to be on file at City Hall
prior to start of construction.
7. 1068 Review for construction of a 1 bedroom apartment unit (add to an already
2 units on lot) at 637-639 Maple Street, J.C. map page 37 2W 3DA, Lot 7 of Block
67 Original Town. Recommended to approve based on City staff report.
