HomeMy WebLinkAboutMarch 7, 1978 Planning Commission Meeting March 7 , 1978 7 : 30 P . I . Meeting called to order by Chairman Don Banks . Roll call found the following Commissioners present : Emery, Halley, Hillyer , Mann , McManama, Loveland and Banks . Absent being Commissioner Messmer. Others present were City Administrator Kucera, City Attorney Carter; Bldg . Inspector Ritchey, Secretary Stamper and several interested citizens . Minutes for February 21st meeting were submitted for approval ; under Old Business Snow Annexation , page 1 fifth line down — Commissioner Mann questioned the figure of 4, 723 people and U. S .D . A , soil report. Short discussion and motion to approve with corrections to "people figure" if needed , made by Member Hally, seconded by Member Mann . Motion carried . Correspondence received and read into record a letter from Southern Pacific answering City ' s query about cost of construction on main line track. The letter gave a figure of $300 , 000 . per mile excluding any crossing , signalling, or gate equipment. Old Business Robert Blanton, engineer for Alleman & Christianson for Suburban Subdivision of 43 lots residential and 3 lots multi—family for con- struction at 882 Hopkins Road for Preliminary Plat Review was present . Staff report presented by City Admin. Kucera with City ' s recommendations. Blanton questioned elimination of Lot 12 , stated Subdivider of land was part of Prelim. Plan proposed and not the bldgs , construction as recommended in the Staff Report . Stated Subdivider followed the Subdivision Ord. for R-3 Zones with adequate sq. feet for all lot sizes, and that Interceptor and drainage plans are already prepared. (See report) City Admin . Kucera reported on Public Works Committee Meeting of Feb . 23rd; school impact , recommended all streets, intersections , curbs and gutters CDnst , to City specs . & flood plain picture. , Water- lines and hydrants were approved by the City Fire Department said Kucera . Engineer Blanton read Mr. Alleman ' s letter of 2/21/78 into record; 13. 55 acres with 490 living units allowed. 230 units were planned or 47% of land used. HUD or Farmer' s Loan Bank financing would allow 440 units. Presented 3 diagrams showing bldgs . and parking arrange- ments to the Commission . City Admin . Kucera then presented a Staff Report dated 3/02/78 recommending 1 . elimination of Lot 12 from Prelim. or rearrangement , 2 . Construct townhouse type buildings . .Mare favorable for asthetic reasons and acceptable to area, 3. Suburban Drive; catch basin at angle for proper street drainage, 4. Make recommended changes to Plat as shown with 16" Medford Water line; Developer to pay all casts and B . C . U .S , A . assessments by withdrawal and perhaps a joint—use agreement. ' March 7 , 1978 Blanton responded saying Lot 12 , because of shape would be unfeasible A to re—arrange ; cost of construction , another street and value of land . The R-3 zone does allow for higher density living ; same for utilities . Architectural motif requirement is uncalled for as this is not an architectural review board, and item #4. Subdivider has followed all ordinance requirements — to change Lot 12 for a "re—arrangement" to satisfy the Staff report would possibly leave unusable strip of land or not meet the lot depth requirements . He then submitted revised plans and posted on wall . Storm sewer, water and sewer requirements were shown on revised plat had already been considered by Developer. Flood plain map for drainage showing 4 tributaries and their flow . Developer would consider const . of culvert to east (after permission of propertyowner) and proposal to connect to 30" pipe owned by Tom Malot to divert in a westerly direction . Blanton continued, stating Developer would pay assessments to B .C . U . S . A . and that monies have already been set aside for a large collectable drainage system for storm drains and he would work this out with Jackson County Public Works Supt. Bill Gaddis . Discussion of size for 60 ' right of way with 100 ' radius curve at north end of Lot 12 going easterly ; width of private driveway off Hopkins and curb construction and if unused lots would be sold off . Chairman Banks inquired of City Attorney Carter if the City could require Developer to include the long flag lot on westerly portion as part of development . Carter replied that this Commission could or could not make such requirement. Commissioner Mann questioned ingress & egress of Fire Dept . equipment on portion where townhouses are to be constructed; 2-12 ' lanes and the radius required on north end. Blanton stated Developer would comply . Commissioner Halley questioned lack of 3 frontages on Exhibit at back curve of n .w. portion . Blanton explained a "draftsman" error . Commissionmember Emery stated he would rather see Lot 12 as part of Subdivision than as a separate flag lot . Halley said Lot 12 would not have room for 12 ' street lanes plus curbs and sidewalks and gutters (the private driveway) . Chairman Banks answered the Commission could not require these if it was a private driveway on private property . Engineer Blanton explained that Flag Lot 12 was planned for elderly living and the traffic would be less than average ; the street could be planned for 24 ' traffic flow. Motion made by Mann to not approve the Preliminary Plat on basis of Flat Lot 12 and when recommended changes are incorporated , the Developer to re—submit . Motion seconded by Halley . Roll call vote ; all "Ayes" with exception of Commissioner Emery who abstained . Snow Annexation Opening remarks by City Attorney Carter quoting Land Use decision and use of Fasano—type zone change procedure guidelines ; and the responsi- bility for the burden of proof provided by those applicants and Findings of Fact would be determined by this Commission ; 1 . this land is outside of City Limits , 2 . City does not have approved Urban Growth Boundary , 3. Procedure by L .C .D . C . must be followed . . . this Commission to follow the Comprehensive Plan Planning Goals (LCDC) copies passed to each member . Goal 3 — Agricultural Lands was item of Exception . Commission to deter- mine if all areas are met ; compatibility for future use, long term use be applicable for locale, use other than provided for ; and the Commission Barth 7, 1978 will satisfy this portion of the Planning Goals. Question from Dann to Atty. Heisel (Opponent Atty. ) of what properties would be served by B .C .V . S . A . proposed trunk line . Atty. Heisel did not know. City Admin . Kucera said line would run along Jackson Creek, crossing Taylor and westerly to Grant Road to Westside School area. Another question of how many to be served , answer 19 , 000 was quoted ! Atty . Heisel did not know. Question of water availability to be answered later in proceedings by Admin . Kucera. Findings as submitted offered by City Admin. Kucera; 1 . copy of item 2 (in red) Land Use Planning , 2 . Comments by Atty . Heisel passed to each and read aloud for the record . (See letter) . City is obligated to provide — in answer to Item 2 of letter , and #5 , we will have to go to an Exceptions form of answer. No questions from Commissioners on the Heisel document. Next document presented by Admin. Kucera was Proponent Atty. R . Stark ' s findings and read aloud (see attached) . The Staff finds no basic ob- jection to the document said Mr. Kucera. Next was handed out a City building permit summary and Soil ' s conservation map prepared by the Jackson County Planning Staff . In answer to earlier query, Item 7 of report — water facilities ; water facilities will be available through 'City water facilities . Item B — Water supply adequate through Lost Creek Dam , #9 — 6" water main with 8" through City . Item 10 — Fire hydrant capacity from adjacent subdivi- sion 'the water capacity is inadequate at present . 10° water line , if constructed, still will not provide an adequate supply. Item 11 — Agricultural lands already discussed. Item 12 Sewer Interceptor ; 2 year plan by B . C . V . S . A . for potential buildout capacity as the density criteria ; the parcels involved are about 1 acre per parcel on map . Item 13 — Police personnel Present 10 officers and L .E .A .A . assess their own needs for what is required — but felt that present coverage inadequate said fir. Kucera. Item M of Proponent ' s document — School District 6 reports of need of new Westside School at present population figures and Board projected in 3-5 years . District feels that in a lifetime the need for construc- tion of schools can catch up as school figure of 1. 5 students per household. Subdivision development would have to be a school bond issue and City unable to determine if this would be accomplished. Item N — Report by City staff by fir. Kucera states Snow property is included in Urban Growth Boundary and Administrative Rules were read again on Commission discussion of L .C . D . C . rules, Exception route and our Land Use Plan as adopted by Council . Question of tediousness of going over each item . . . item by item as necessary. City Atty . Carter said it was the only way to handle each area in order to arrive at Findings . 1 March 7 , 1978 aCommissioner Waldron stated he did not feel that at this time the City needs this property and will make hardships on some of the small property owners and does not like to see islands created . Commissionmember Mann stated that water is not available at present. Member Emery stated that citizen involvement to him means anyone 300 feet from the proposed annexa- tion - after Mann inquired of citizen involvement in that area; Emery feels the Commission has the responsibility to the other citizens and not just the propertyowners involved in the Snow Annexation , other citizens in Jackson County . Commissionmember Emery feels we should limit our concerns at the present time to just our people per our ordinances , City Atty . Carter said that the City ' s obligation on annexations was to notify propertyowners in an annexation matter of those concerned by written notice. Member Hillyer felt we need a positive response by citizens from outside our immediate vicinity. Exceptions to Goal A - Item 3 - was taken after lengthy discussion of Findings were : Economical standards , locked into boundary .available land should be ready for City expansion , up to propertyowners to use land as they determined. More discussion, motion made and seconded to allow Exception to Goal 3 of Item A...vote that Proponent did show burden of rp oof - 7; Did not show burden of proof - 1. Item B...vote by show of hands - Proponent did comply - Unanimous. Item C...by show of hands vote - Proponent has not rp oved point - 7; and did comply - 1. Item D...show of hands vote - Proponent,has not rp oved - 5; did prove - 1. Because of lenthiness of Findings yet to be reconciled, motion made by Halley to adjourn A to a special meeting for March 14, 1978 at 7:30 P.M. and Snow Annexation to be only order of business. Motion seoonded by Member Emery and carried. After short recess the meeting reconvened. Old Business (continued) Request for Conditional Use at 990 So. Front Street and request of legal opinion by City Atty. Carter was next order of business, and explained to all attending. A non- conforming use from former professional use to real estate building. Reading Item D of Ordinance 17.56.010; deals with 2 uses where it was only allowed a singular use before. Applicant James Freeman explained request for Mrs. Freeman occupying desk and phone - very little personal contact and much less than a real estate salesman in the extra office. Mr. Freeman stated it would be wutilization of something already there, i.e., office space. Motion made by Waldron to allow the use of office space for the requested use, second by Member Loveland. Roll call vote all in favor with exception of Member Emery who had left the room and not present during voting. Requestion of petitioners Ernest & Pat Himmelman for 1068 Review of construction of a tri-plex at 123 North Second Street, J.C. Map 37 2W 3DD, Tax Lot 7200, Block 12 of Original Town. Because of lateness of hour, Petitioner had left meeting and was not present. Tabled to the March 21, 1979 regular meeting of the Planning Commission. Petitioner will be contacted of the re-schedule. New Business Dalton Ellis petit oa for preliminary plat approval and a 1068 Review of 7 unit apart- ment constructed at 162 Glenn Way, J.C. map 37 2W IOAC - Block 1 of Yocum Addition; Lots 8 and 9. Applicant was represented by Wayne Crompton. Staff report presented by Bldg. Inspector Ritchey for permitted use in the R-3 zones. A new fire hydrant to be I constructed adjacent to this property; curbs, gutters and sidewalks will be re- 1 quired as well as driveway aprons. Discussion. Recommendations of 2' overhang; "eyebrow" added to buildings on sides where no balconies are planned; elevation of front unit must be done for compensation of flood plain in that area; landscaping as drawn; if existing house on property will be used as part of complex then it must be brought up-to U.B.C. standards. More discussion. Motion by Emery for off- site street improvement along'Gl ,nn Way length' of property be done by Developer of property and to reimburse Stonecreek Developere'if required, second by Mann. Roll call vote, carried unanimously. Commissioner Halley made motion to accept the Staff report with their' recommenda tions, seconded by Andy, Loveland. By roll call vote, all in favor, motion carried unanimously. Next item of New Business was request of Gary Yost and John Blair as applicants for subdivision'construction at area near 10th"and Laurel Streets in the `Patterson Sub- division; J.C. 'map 37"2W 2CB Tax Lot 7301 for Preliminary plat'review. 'Because of lateness of hour the Applicants requested to be reset to March 21, 1978- regular business meeting. Motion to reset this matter was made by Commissioner Emery, s seconded by Mann. All in favor, the motion carried. Request for Minor Petition by Wayne Van Wey for property located at 260 No. Fifth, J.C. map 37 2W 3DA Lots 3 and 4 of Tax Lot 11900>in Block 56 of Original Town. Staff report made by Inspector Ritchey and diagram?tpassed to each member of the Commission meets all codes required for Minor Petition. Discussion. Motion made by Emery, second by Halley to allow Minor'Petition of this property. Roll call vote, all in favor, the motion carried. Suburban Subdivision - 43 lots residential & 3 multi-family for construction at 882 Hopkins Road, Tax Lot 1600 of J.C. map 37 2W 11A - Robert Blanton representing applicant. Preliminary plat review denied because of Flag Lot #12 irregularities. Changes were suggested to representative on staff report and City requirements. 2. Snow Annexation - Findings of Fact Reports were presented by City Admin. Dave Kucera to Commissioners using Procedures as outlined by L.C.D.C. and City Atty. Carter. Went into detail item-by-item. The matter was not resolved because of length of Reports. Has been rescheduled to a Special Meeting to be held on March 14th at 7:30 P.M. 3. Second use with a Non-Conforming use (Conditional Use granted 2/07/78) of professional bldg. at 990 So. Front Street by applicant James Freeman who has established a real estate office there, to allow Mrs. Esther Freeman (wife) to conduct a business operation at same locale using office desk and phone as a supplier for printing & copying supplies; will not conflict with present use of bldg. nor traffic pattern already existing. 4. E & Patricia Himmelman for 1068 Review for 123 No. 2nd Street for triplex construction on TL 7200 Blk 12 of Original Town. Tabled as applicant left meeting before request was an item of business. New Business 1. D4 Ellis for preliminary plat of 7 unit apartments and 1068 Review approved subject to staff recommendations including construction of curbs, gutters and sidewalks; to be located at 162 Glenn Way, Lot 8 & 9 of Yokum Addition, J.C. map 37 2W 10AC 2.
