HomeMy WebLinkAboutFebruary 7, 1978 Planning Commission Minutes February 7 , 1978 7 : 30 P.M. The Planning Commission meeting was called to order by Chairman Don Banks . Roll call found the following Commissioners present : Emery , Halley, Hillyer, Loveland, Mann , McManama, Messmer and Banks . Absent being Commissioner Waldron . Also present were City Adm. Dave Kucera, Building Inspector R . J . Ritchey, Secretary Janice Corbett and several interested citizens . The minutes of January 17 , 1978 were presented for approval . Commissioner Halley said he would like to make a correction to the minutes . Under Miscellaneous Matters and Public Appearances, "B" , the motion made to move #7 on the agenda outline under #4 should read as follows : "Move only the public appearance portion of #7 on the agenda outline under #4. " Motion was made by McManama, seconded by Mann to approve the minutes as corrected. All in favor, motion carried. Public Appearances A . Proposed laundromat located at let and Manzanita - Applicant , Dale Van Way Mr. Dale Van Wey was recognized and came forth. He stated the proposed laundromat is located next to the Blue Bell building and the parking will utilize the balance of the Blue Bell building . Concrete sidewalks will be installed on lst and Manzanita. Sewer and water is available. Building Inspector Ritchey said 18 parking spaces are required and 5 extra spaces have been provided. The building is located in Fire Zone I and will be a block building . Motion was made by Emery, seconded by Loveland to approve the concept of the plans . Roll call vote : Emery, yes ; Halley, yes; Hillyer, yes ; Loveland, yes; Mann, yes ; McManama, yes ; 'Messmer, yes ; Banks , yes . All in favor, motion carried. Unfinished Business A . Discussion on zoning to allow tattoo parlors Motion was made by Emery , seconded by Halley to table this matter until the applicants are present. All in favor, motion carried. New 'lBusiness A. Conditional use public hearing for real estate office located at 990 S . Front Street - 37-2W-11C , Tax Lot 4400 - Applicant James Freeman , Century 21 Bob Bauman Realty Chairman -Banks opened the public hearing and asked if any proponents were present. Mr. James Freeman was recognized and came forth. He stated the building is located in a LC-LI district and the intended use of the building will not contain any flammable or combustible materials which were being used in the existing February 7, 1978 New Business (cont' d) ' medical building. The building has 12 , 600 square feet with 10 , 000 square -feet -of parking area:, Mr. Freeman stated there would be,'less traffia coming and going from a real estate office than from the .existing medical office. . No changes would be made in the existing layout of .the building. Chairman Banks asked if there were any opponents present: No one came forth. Chairman Banks closed the public portion of the hearing. The Fasano Findings ,for• conditional use permits were read and answered (Refer to attached report) . ' Motion 'was made 'by Messmer, seconded by Loveland to accept the -proponent ' s findings for Item #1 under Section -:17.56.010 . rslating ;.to non-conforming uses. All in favor , , motion carried. M,otion . was -made by • Mann, seconded by Hillyer to accept . the . proponent ' s findings for Item #2 under non-conforming uses . All in favor, .motion carried. . Motion 'was .made by Mann , seconded by McManama to accept the proponent' s findings for Item #3 under non-conforming uses. All in favor, motion carried. Motion was made by Mann , seconded by Halley to allow the conditional use in the LC-LI zone. Roll call vote: Emery, abstained ; 'Halley, yes; 'Hillyer, yes; Loveland; yes; Mann , yes; 'McManama, yes; Messmer, yes; Bank6; 'yes. Majority in favor, motion carried. B . Preliminary Plat Review for Suburban 'Subdivision located at 882 Hopkins Road = - 37-2W-11A , Tax -Lot 1600 Applicants , O .W. Alleman , and M.S . -and Grace -Christianson - Mr. - Alleman was recognized and came forth. He stated that the staff report says -there will be 43 single family lcts. i This is incorrect as he has planned - that .area to be built primarily for 4-plex units . Building Inspector Ritchey read the staff report. Discussion was held: - Adm. Kucera stated the park fee will have to bey recalculated since the fee was calculated on the basis of 43 single family lots and 58 apartment units . Building Inspector Ritche read the County ' s recommendations. (Refer to attached letter . ' The Planning Commission asked Mr. Alleman to present to them a traffic flow and school impact report and to provide a solution to : the - drainage problem. The Planning Commission asked Mr. Alleman to present the revised plans to the Fire Chief for his report before the March 7th meeting : Motion was made by , Halley , seconded by Messmer to table this matter to the March 7th meeting . Review for extension of Burton ' s Pharmacy located at 236 E. Pine Street - Applicant,, Newt Mead Building Inspector , Ritchey read the staff report. , Ritchey stated the power pole is located ; on the property line and asked the ' Commission who should be responsible for removing the pole. February 7 , 1978 a New Business (cont ' d) Chairman Banks said he thought the city should be responsible For removing the power pole . Discussion was held . Motion was made by Emery , seconded by McManama to approve the plans as presented subject to an agreement between the applicant and City Council as to who is going to bear the cost involved for removing the power pole which holds the sirens for the Fire Department and include the staff report requirements . Roll call vote : Emery, yes ; Halley , yes ; Hillyer, yes ; Loveland , yes ; Mann, yes ; McManama , yes ; Messmer, yes ; Banks , yes . All in favor, motion carried . D. #1068 Plan Review for proposed lumber storage located at 594 S . Front St. - 37-2W-10AA, Tax Lot 5000 - Applicant, Louisiana Pacific Corporation Mr. Graydon Hallock was recognized and came forth . Mr. Hallock stated the building will be a Butler building (40 X 200) and the construction will be done by Medford Construction Co . Motion was made by McManama , seconded by Messmer to approve the plans subject to the staff report and approval of the Fire Marshall ' s report . Roll call vote : Emery , yes ; Halley, yes ; Hillyer, yes ; Loveland, yes ; Mann , yes ; McManama, yes ; Messmer , yes ; Banks , yes . All in favor, motion carried. E. #1068 Plan Review , for alterations to the Center Cafe located at 223 E . Pine Street - 37-2W-30D, Tax Lot 10600 - Applicant, Al Towner Building Inspector Ritchey said the applicant is proposing to add a second floor to the existing building for lving. quarters . This is not "permitted under Section 17 . 56.010 relating to non-conforming uses . Ritchey stated that letter D of Section 17 . 56 .010 prohibits enlargement of the space occupied by a non-conforming use. Discussion was held . Motion was made by Mann , seconded by Emery to recommend to the City Council changing Section 17 . 56.010 to allow conditional use permits for non-conforming uses in C-1 , C-2 and C-3 zones . Roll call vote : Emery , yes; Halley, yes ; Hillyer, yes ; Loveland, yes ; Mann , yes ; McManama, yes ; Messmer , no; Banks , yes . Majority in favor, motion carried. Motion was made by McManama , seconded by Mann to table the plans until findings are presented on the zone change. All in favor, motion carried. F. #1068 Plan Review for remodeling of Arco Service Station and aiplication for change in occupancy from a service station to an ice cream parlor located at 414 E. Pine Street - 37-2W-2CC , Tax Lot 6300 - Applicant , Norman Kellough Mr . Joe LaValle with Sunshine Valley Construction , Phoenix, OR, was recognized and came forth . He stated the applicant wishes to leave the gas pumps in for one year. The pumps will be approx- imately 20-30 feet from the building . Discussion was held February 7 , 1978 New Business (cont ' d) ' regarding the safety and fire hazard resulting from a service station being' so close to an eating establishment. The Commis- sion requested .that the Fire Department present a feasibility study'. showing the reasons why the gas pumps should be removed. Building Inspector Ritchey read.- the staff _ report . Motion was made by Mann , seconded by McManama to approve the 1068 plan review. for. an ' ice. cream parlor leaving the gas 'pumps in subject to approval :by, the City Fire Chief .and'. Health' Department and including the staff report. , Roll call vote : Emery, yes ; Halley, yes ,, Hillyer„ yes; ' Lovelan.d, yes ; Mann , yes; McManama, yes ; Messmer, yes ; Banks , yes. County:: F:ederal Savings ant Loan..Association The proposed plam.is basically similar. to the Central, Point State. Bank ., Discussion was' held. . Motion was made by_ MQManama, seconded by Loveland .that . the .traffic -flow in and out of Pine Street be - a right turn: only and suggested using the n,ew - state approved no left turn sign:_ All � in favor , motion carried. Planning Commission term expiration dates Adm .' Kucera .stated ' each Commissioner has been given a copy of the Commission term expiration dates and this is to- be entered into the minutes. Good access in and out of building . b . Plenty of parking area. 2 . Traffic : Traffic flow would be less for a real estate office than for a medical office . 3. No adverse effect : No . Less restrictive use proposed. Vandalism and crime would be less with proposed use . 4 . Additional conditions imposed by Planning Commission .
