January 3, 1978
7 : 30 P.M.
0 The Planning Commission .meeting was called to order by Chairman
Don Banks. Roll call found the following Commissioners present :
Emery, Halley, Hillyer, Mann, McManama, Messmer, Waldron and Banks.
Absent being .Commissioner Loveland. Also present were Councilmen
Rayburn, Corliss and Hamer, City Adm. Dave Kucera, Secretary Janice
Corbett and several interested citizens .
The minutes of December 20, 1977 were not ready to be .presented
for approval.
Election of Officers
CHAIRMAN — Emery nominated Don Banks, seconded by Mann.
Messmer nominated Dick Halley, seconded by Waldron.
Motion was made by Emery, seconded by Mann to close the
nominations . All in favor, motion carried.
Voting results — Don Banks , 5 votes ; Dick Halley, 3 votes.
VICE—CHAIRMAN — McManama nominated Dick Halley, seconded by Waldron.
Emery nominated Ben McManama, seconded by Halley.
Motion was made by Waldron, seconded by Mann to
close the nominations . All in favor, motion carried.
Voting results — Dick Halley, 5 votes ; Ben McManama,
3 votes .
SECRETARY — Emery nominated Jean Hillyer, seconded by Halley.
Motion was made by Emery, seconded by Messmer to close
the nominations . All in favor, motion carried.
Voting results — Unanimous vote for Hillyer.
New Business
A . Variance public hearing to allow a 10 foot front yard setback
for vehicle parking located at 825 E . Pine Street 37-2W CC,
Tax Lots 4200 & 4300, Lots 5, 6 and the westerly half o -2
f Lo 7 ,
Block 2 — Applicants Mike and Dennis Sullivan, agents for Clyde
A. Severson and D.L. Gressett , owners
Chairman Banks opened the public hearing. Mr. Bruce Abelo,
Architect and representing the Sullivans was recognized and came
forth. He stated the variance is in relation to the parking only
and does not include the structure. Mr. Abelo stated that
' Pine Street is changing from quasi—residential to primarily
commercial due to recent commercial growth and the addition of
the Expo to Central Point. The setbacks need to be changed

in order to handle the influx of automobiles on primarily
residential lots . Chairman Banks . asked if there were any
opponents present. No .one -was recognized. Chairman ,Banks closed
the public ' portion_of ' the 'hearing. , City Adm. Kucera `reviewed
the application and public hearing procedure for variances and
stated..that the`applicants 'have " fully complied with the
requirements . The Fasano Findings _were read .and _answered.
(Refer to attached findings ) . Motion Was made by Emery,
seconded by Messmer. to approve the 101

for vehicle parking on 8th and Pine Streets '. Roll call vote :
Emery, yes; Halley, yes ; Hillyer, yes; Dann, yes . McManama, yes ;
Messmer, yes ; Waldron , yes ; Banks, yes . All in favor, motion
carried.
B. Request for a. tattoo ' parlor ' located at 335 E. Pine Street,
'31 3D2 Tax Lot 11300- Lot 13 — A licants Dale LeCu er and
Patric D2.
No one was recognized. Motion was made by Emery, seconded by
Mann that since _a ..zgne change will have . to .be brought before the
Council, to refer this matter to the Council . Roll call vote :
Emery, yes ; Halley, yes ; . Hiliyer,` no ; Mann, yes'; McManama, yes ;
Messmer, yes ; Waldron, yes ; Banks, yes . " Majority in favor,
motion carried.
C . :Final plat approval for -Stonecreek , Subdivia ion, Unit #1 '
City Adm. Kucera -stated that two weeks ago -he told Tom Burton,
Engineer, to bring in the 'final plat for staff review. The plans
were first received this afternoon, January 3, 1978 at
3 : 30 P.M.' No one has had a chance to review the plans.
Motion was made by McManama, seconded by Messmer to table the
approval' of the final plat to the next meeting 'due to the number
of conditions that still need to be checked. Roll call vote :
Emery, no ; Halley, yes ; Hillyer, yes ; Mann , yes ; McManama, yes ;
Messmer, yes; Waldron;' yes ; 'Banks ; yes. '"' Majority in favor,
Motion carried.
Miscellaneous Matters and Public Appearances
A . Chairman Banks read a, letter . by Bjarne . Jensen regarding
accessibility . to ' his property, . Tax . Lot 3900, adjacent to the
Stonecreek Subdivision. Mr. Jenseri stated that the Stonecreek
Subdivision is possibly encroaching- upon the public `right—of-
way and this is the only entrance to his property. Mr. Motes,
one of =the developers of this 'subdiwision was present and was
alerted of the situation . He -stated that he would cntact Mr.
Tom Burton, Engineer, and discuss this ' with him

0 B . Chairman Banks questioned the types of .businesses listed under
conditional uses in the C-4 zone that will soon be going before
the Council., He. .stated that shopping centers are under, permitted
uses but the types of stores that are usually found in shopping
centers are, under. conditional uses . Chairman Banks -stated that
he thinks those items should be omitted from conditional uses in
the C-4 zone. Commissioner Emery, stated he. can see nothing listed
_under conditional uses that should be there, The Commission felt
that the Council should be made aware of the situation .
Notion was made by Mann, seconded by Waldron to adjourn . All in
favor, motion carried. Meeting adjourned at 8 :25 P.M.

FASANO FINDINGS :
Applicant : Mike and Dennis Sullivan
Proposed Variance : Front yard setback from 20 ' to 10 ' on Bth & Pine St .
Date : January 3, 1978
1 . Are there exceptional or extraordinary circumstances or conditions
applying to the land, building or use referred to in the application,
which circumstances or conditions do not apply generally to land,
buildings or uses in the same district?
The granting of this variance would permit best utilization of the
land. Due to the cost of the land and building , the required parking
spaces would require additional area which would be too costly. Granting
of the variance would allow required parking in available area.
2 . Is the granting of the application necessary for the preservation
and enjoyment of substantial property rights of the petitioner?
Yes, By permitting parking in the setback area, workable space of the
lot will be increased by better utilization of lot area for building
and parking .
3. Would the granting under the circumstances be outweighed by the
adverse effects to the health or safety of persons residing or working
in the neighborhood of the property of the applicant, or be materially
detrimental to the public welfare or injurious to property or improve-
ments in the neighborhood? X No
The granting of the variance would allow the development to properly
handle the greater influx of cars & subsequent parking requirements of
a growing commercial area.
This would, by the specific nature of this request, maintain visually
the 20-25' of the remaining single family residences by allowing
parking . A 10' front .yard, setback and 20 ' front yard setback for
structures to remain intact. „ .
If the original reasoning for the 20t setback was, to provide a. good
size landscape strip to visually soften' tha commercial development,
then one must . also' consider .that this area"wcuid have to be .maintained.
Who is .going to' police 'tHis requirement? '. With a 10 ' strip , one can
still . landscaps t''o ' screen cars and ' soften 'impact while allowing for
a better`chance that .the� landscape would be properly maintained.

SUBJECT: Planning Commission Report of January 3, 1978 meeting
A. Planning Commission elections were held. The slate of
officers for 1978 are:
Chairman - Don Banks
Vice-Chairman -. Dick Halley
Secretary - Jean Hillyer
B . The Commission unanimously approved the variance to allow a
10 foot front yard setback for vehicle parking located at
825 E. Pine Street (pizza parlor) . Applicants are Mike and
Dennis Sullivan.
C. The request for a tattoo parlor to be located at 335 E. Pin
Street was denied. The Commission referred this matter to
the Council.
D. The final plat approval for Stonecreek Subdivision, Unit #1,
was tabled to the next Planning Commission meeting since
sufficient time had not been given to review the plat.
E. A letter was read from Bjarne Jensen regarding the accessibility
to his property adjacent the Stonecreek Subdivision . Mr. Cliff
Motes was present and was made aware of the problem.
F. Discussion was held on the types of businesses listed under
conditional uses in the C-4 zone. The Commission felt that
a majority of these businesses should not be put under
conditional uses and will bring this to the Council' s attention
