HomeMy WebLinkAboutDecember 6, 1977 Planning Commission Minutes December 6, 1977 7 : 30 P. N. The Planning Commission meeting was called to order by Chairman Don Banks . Roll call found the following Commissioners present : Halley, Hillyer, Loveland;' Mann , McManama, Messmer, Waldron and Banks . Absent being Commissioner Emery. Also present were Councilmen Hamer, Rayburn and Dippel, Mayor Jack Snook, Secretary Janice Corbett, City Adm. Dave Kucera, Bldg . Insp . R. J. Ritchey, Fire Chief Penicook and several interested citizens. The minutes of November 15, 1977 were presented for approval. Motion was made by Halley, seconded by Mann to approve the minutes as presented. All in favor, motion carried. Mayor Jack Snook was recognized and stated to the Planning Commission that the reason for his presence tonight is three- fold : 1 . Jack stated he would like to clear up some of the problems and misunderstandings between the Planning Commission and ` Council and apologize for statements he made about the Commission and Chairman Banks that were printed in the Central Point Press . ' 2. Jack 'stated that the proposed uniform hearing ordinance which will be brought before the Commission tonight is of great interest to him and the Council. The Council has expressed to him that in the past they have not actively participated in the growth of Central Point and feel they should have first hand knowledge of matters regarding the development of Central Point. 3. Jack stated that Central Point is currently involved in a time of change. The city is right in the middle of a feasibility study for the construction of a new city hall complex and swimming pool . Mayor Jack Snook thanked Chairman Banks and the Planning Commission for the opportunity to speak to them tonight and stated that he was sure the Commission and Council could work closely together in the future. New Business A. Minor Partition — 2nd & Cedar TL 1700 Lots 6 7 & 8 Bloc 23 Original Town 3 —2W-11BB Building Inspector Ritchey read the staff report and said he sees no problems with this minor partition. Motion was made by Waldron, seconded by McManama to approve the minor partition. Roll call vote : Halley, yes ; Hillyer, yes ; Loveland, yes ; Mann, yes; McManama, yes; Messmer, yes; Waldron , yes ; Banks, yes . All in favor, motion carried. December 6, 1977 New Business (cont' d) B . Minor Partition and Variance Public Hearin - 543 Hopkins Road; TL 3500, ' 37-2W-11BD, :Applican , Michael `Byxbe Chairman Banks opened the , public hearing. Mr. Doug Hansen representing Michael, Byxbe was recognized: He stated the - apolicant is requesting to separate the lot from the existing house and--is requesting a variance to the lot width requirement. - -A three bedroom single family home is intended to be built on the lot in the future. Mr. Hansen stated that several similar variances -have been granted on Grand Avenue. Chairman Banks asked - if -there were any opponents present. No one was - recognized. , Chairman Banks closed the public portion of the hearing. Building Inspector Ritchey stated that there was a discrepancy -regarding : the distance between the existing house ',and the property line. The figure he received from the applicant indicated the house is approximately 3 feet from the property line. His figure indicates -that - the --house : is approximately 7 feet over the property line assuming that the fence is the true property line. B.uilding.. Inspector -Ritchey recommended that a legal description by a licensed engineer be submitted showing the true property line. Motion .was made by Waldron, seconded by Messmer to accept the staff report and table this until the true property lines are located. Roll -call vote : Halley, yes ;'. Motion. was :made' by Mann , seconded by Hilly,errto continue the public . hearing for the variance at the December 20th meeting or until: the information that has been requested is presented. Public Hearing on C-4 permitted and conditional- uses Chairman Banks opened the public hearing . : Commissioner Mann said the change in the .permitted ,and conditional uses in the C-4 zone would provide more room for Central :Point to expand - in commercial areas . This change will create more. jobs and provide better shopping facilities for the citizens of Central Point. Chairman Banks asked .if there_. were any , opponents present. No one came forth. Chairman Banks closed the public portion of the hearing. . TherFasano -Findings-were read and answered. (Refer to .attached Fasano Findings) . Motion was made by Waldron, I seconded by Halley that all the findings ,of fact .are, positive, the change of :zone is ,justified and recommends_ ;to=:the- Council that the resolution be approved as written . Proposed Uniform Hearings Ordinance City Adm. Kucera outlined the policies in the proposed ordinance. City. Adm. Kucera stated that the or would turn over to the City Council all public hearings which have previously been heard at the Planning Commission level. This process would help in keeping the City Council up to date on the ,development of Central Point. Mayor Snook stated this would also help expedite proceedings for_ the applicant by having only one public hearing at the Council level. The Commissioners raised several questions. Chairman Banks questioned Section 5 having to do with the appeal process. He asked the Councilmen present how the Council could reverse their decision on a matter they had made 5 days earlier. Councilman Dippel explained that the applicant might present new information which could change the Council ' s_ earlier decision . Chairman Banks stated that if the public hearing process is not held at the Commission level the Commissioners would only hear the applicant' s side and would not hear any opposition to the issue. The Commission felt they could not make a fair decision on any issue by only hearing one side of the story. Councilman Dippel stated that the Council, elected by the citizens of Central Point to represent them, cannot effectively represent the , people in their Ward if they are not aware of what is happening in the way of Central Point ' s development. Commissioner Hillyer- said she felt the Council has not attended enough of the Commission ' s public hearings . Chairman Banks stated that the shifting of the public hearing procedure to the Council level is not taking anything away from the Planning Commission but is taking away from the citizens of Central Point. Mayor Snook recommended that no action be taken on the proposed ordinance tonight but to turn this matter ,over to a joint study session. Motion was made by Halley to go along with Mayor Snook ' s recommendation. Motion died for lack of second. E. Annexation presentation by Ron Young representing Dr. & Mrs . Milton Snow locate at 3817 Grant Road TL IUD 37-2W-9 and TL 10500 37-2W_iUHU Ron stated that Mr. & Mrs . Snow were involved with the comprehensive land use plan several years ago . At that time they asked that their property be included within the urban growth boundary. The Snow' s feel that at the present time they have to go ahead with the annexation because of the urban growth boundary. City Adm. Kucera stated that the County will be looking very closely at how the city ' proceeds with this annexation . A public hearing will have to be held at the Planning Commission level. Motion was made by Mc Manama, seconded by Halley to set December 20th December 6, 1977 as the date for the public hearing on the annexation . , Roll call vote: Halley,, yes; Hillye,r,. yes; Loveland, yes ; Mann, yes_•, McManama,- yes;, Messmer, 'yes ; Waldron, 'yes ; Banks ,, yes. Discussion oh 'cul—de-sac radius 'for Flagstone Subdivision Mr. Jack Hoffbuhr, surveyor,- was recognized and stated that when the Flagstone preliminary plat was approved the plans were approved with a 50 ' cul—de-sac radius. Miscellaneo.0 Matters & Public Appearances A . Mr. Ron Young 'wa's recognized and stated .he had two items to present to the Planning Commission.. I 1. Ron presented the final plat mylar copy for the Green Glen Subdivision .. 2 . Ron stated that Robbie Collins has talked to the people at the Southern Pacific Railroad and' the Public Utility Commissioner regarding 's railroad crossing at Taylor and Manzanita. Nothing has been, done. ' Ron. 6tated that gr a public entity has' to submit a ant for a railroad , crossing grant. Mayor Snook stated that 's railroad crossing grant should be submitted to the City Council. B. Proposed Park� Dedication Fees Ordinance Short ?discussion was held on the. proposed `ordinance .es'tab- lishing fees in lieu _of park dedication. Secretary December 6, 1977 FASANO FINDINGS - Amending C-4 Zone, City of Central Point 1. Does the proposed change conform with the comprehensive plan? X Yes Expanding commercial uses in a C-4 zone. 2: Is there a public need for the change? Yes X a. There is a need for more commercial uses of the land. b. Too much land is designated for tourist oriented commercial uses and by . expanding this use to larger commercial uses it will provide much more commercial area for the city to utilize and expand their commercial areas . 3. If there is a public need, would the public need best be met by the proposed amendment (rather than by the use of other property) . Yes X The amendment to °the C-4 zone expands permitted uses in areas so designated. 4. Is there any adverse impact on the neighborhood? X No a. Provide more jobs. b . Lower the tax rate of -schools and city C . Provide better shopping facilities in commercial areas for the residents of Central Point. 5. Have the proponents carried their burden of proof in establishing the above factors? Yes X 6. The Planning Commission, by majority vote with a quorum present, approves the proposed zone change and forwards such recommendation to the City Council .
