November 1, 1977
7 :30 P.N.
The Planning Commission ,meeting was called .to order by Chairman
Don Banks . Roll call found the following Commissioners present :
Halley, Hillyer, Loveland, McManama, Messmer and Banks. Absent
being Commissioners Emery, Mann, and Waldron . Also present were
Secretary Janice Corbett and Fire Chief Dave Penicook. A few
interested citizens were present.
The minutes of October 18 , 1977 were presented for approval .
Motion was made by Halley, seconded by Messmer to approve the
minutes as presented. All in favor, motion carried.
Correspondence
Chairman Banks read a letter from Mr. & Mrs. Edgar Scheufele,
770 S. 4th St . regarding the operation ,of an illegal Amway
business located at 795 S . 4th St . operated by Mr. & Mrs .
Wallace Sousa. It was noted that the Sousa' s had never applied
for a home occupation and have been operating this business
illegally for several years. Short discussion was held. Motion
was made by McManama, seconded by Loveland recommending that the
City Council take some .kind of action on this matter. Roll call
vote : Halley, yes ; Hillyer, yes ; Loveland, yes ; McManama, yes ;
Messmer, yes ; Banks , yes. All in favor, motion carried.
New Business
A. Variance Public Hearing for Westside Lumber located at
870 S. Front St.
Chairman Banks opened the public hearing . Mr. Noel Moore,
representing Westside Lumber, was recognized. He said the
fence is needed to protect the property from vandalism as
well as a safety measure from children playing in the area.
A. letter from Tom Malot was read stating his approval of
the variance. Chairman Banks asked if any opponents were
present. No one was recognized. Chairman Banks closed the
public hearing . The Fasano Finding Procedures were followed.
(Refer to attached report) . Motion was made by McManama,
seconded by Halley to grant Westside Lumber the variance to
the front property line and 6' fence height requirement.
Roll call vote : Halley, yes ; Hillyer, yes ; Loveland, yes ;
McManama, yes ; Messmer, yes ; Banks, yes. All in favor,
motion carried.
B. Jackson County Planning application for a zone change from RR-5
(Rural-Residential 5) and F-5 (Farm Residential) to RR-1 (Rural
Residential 1 ) - Applicant Donald F. & Ernestine Ahrens , 6850
Dawning Road #4, Central Point.
Motion was made by Messmer, seconded by Loveland to respond
favorably to the zone change from RR-5 and F-5 to RR-1. All
in favor, motion carried.

Miscellaneous Matters & Public Appearances
A short discussion was held on the urban growth boundaries. ,
With no further business to be brought before the Commission,
a motion was made by McManama, seconded by Halley to adjourn.
