October 4, 1977
7 : 30 P .M .
The planning Commission meeting was called to order by Chairman
Don Banks . Roll call found the following Commissioners present :
Emery, Halley , Hillyer , Loveland, Mann, McManama (arrived at 7 :45) ,
Messmer and Waldron . Also present were Councilmen Orville Hamer ,
Jim Corliss and Candy Jazdzewski , Acting Police Chief Bill
Robbins , Fire Chief Dave Penicook and a few interested citizens .
The minutes of September 20 , 1977 were presented for approval .
Motion was made by Emery, seconded by Mann to approve the minutes
as presented . All in favor, motion carried.
Old Business
A . Report from Commissioners Emery and Loveland on uses permitted
in a C-4 zone .
A short discussion was held. Commissioner Emery mentioned
initiating a C-5 zone to take care of the overlapping between
C-4 (Commercial Tourist District) and the other commercial
zones . (Refer to attached report outlining some permitted and
conditional uses in a C-4 zone) . Chairman Banks stated that
before the Commission could submit a report of their recommen-
dations , the Council and Planning Commission should get together
and discuss this matter .
New Business
A . Douglas Baer - Proposed motel on East Pine Street
Motion was made by Emery , seconded by Mann to table this
matter since Mr. Baer was not present . All in favor,
motion carried.
B . Mr . Fred Misik, PP & L Representative, was recognized and
spoke on galvanized street lights vs . painted street lights .
He stated that all the new subdivisions will be using galvanized
lights and there is not much difference in the cost . Motion
was made by Emery, seconded by Halley to send an endorsement
to the City Council stating that the Planning Commission goes
along with the recommendation from PP & L to accept galvanized
street lights . Roll call vote : Emery, yes ; Halley, yes ;
Hillyer, yes ; Loveland, yes ; Mann , yes ; McManama, yes ; Messmer ,
yes ; Waldron , yes ; Banks , yes . All in favor , motion carried.
C . Set public hearing date for a conditional use and variance -
A P2 licant - Myer-Holland Post 129 , 311 N . Front American
Legion
Motion was made by McManama , seconded by Waldron to set October
1B, 1977 as the public hearing date for a conditional use permit
and variance. Roll call vote : Emery, yes ; Halley , yes ; Hillyer,
yes ; Loveland, yes ; Mann , yes ; McManama, yes ; Messmer, yes ;
Waldron, yes ; Banks , yes . All in favor, motion carried.
D. #1068 Plan Review — Al Towner, Center. Cafe, 223 E. Pine St.
Motion was made by Emery, seconded by Loveland to approve
the plans as presented for the proposed remodeling and
have the City issue Mr. Towner a building permit . (Refer
to attached Staff Report) . Roll call vote : Emery, yes ;
Halley, yes ; Hillyer, yes; Loveland , yes ; Mann, yes ,
McManama, yes ; Messmer, yes; Waldron , yes ; Banks , yes.
All in favor, motion carried .
Miscellaneous Matters & Public Appearances
A discussion was held regarding the recent passing of a
resolution prohibiting smoking during public, meetings .
Commissioner Halley stated that unless there is a state law
prohibiting smoking in a public place it should be up to the
Planning Commission to decide whether they be allowed to smoke
at their meetings . Commissioner Hillyer stated that the non-
smoking rule came down as an ultimatum . -Commissioner Messmer
stated that this is a "tempest in a teapot" , and that the
City Council did not handle this matter properly . Motion was
made by Halley, seconded by Waldron that the Planning
Commission requests the right to take a vote on the smoking
issue and unless there is a state law prohibiting. smoking in
any public place, it should be the right of the Planning
Commission to determine whether they be permitted to smoke at
their meetings . If there is a joint meeting with the City
Council then the Planning Commission will abide by their ,
rules but be permitted to call for smoke breaks . Roll call
vote : Emery , yes; Halley, yes ; Hillyer , yes ; Loveland, yes ;
Mann, yes ; McManema, abstained ; Messmer , yes ; Waldron , yes ;
Banks , yes . Majority in favor, motion - carried.
Motion was made by Emery, seconded by Loveland to have an
authorized official present such as a policeman , member of
the City Staff, or Councilman during the smoke breaks. so
they can testify that the Planning Commission was not
deliberating on any issue outside the meeting . Roll call
vote : Emery, yes ; Halley, yes.; Hillyer, yes ; Loveland, yes ;
Mann , yes ; McManama, yes ; Messmer, -yes ;_Waldron , yes; Banks ,
yes . Ail in favor, motion carried.
Motion was made by Waldron , seconded by McManama to adjourn..
Meeting adjourned at 9 :00 P .M.
