HomeMy WebLinkAboutSeptember 20, 1977 Planning Commission Minutes September 20 , 1977 7 : 30 P .M. The Planning Commission meeting was called to order by Chairman Don Banks . Roll call found the following Commissioners present : Emery, Hillyer, Loveland, Mann, McManama (arrived at 8 :00 P.M . ) , and Banks . Absent being Commissioners Messmer, Waldron and Halley . Also present were Bldg . Inspector R. J . Ritchey , City Adm. Dave Kucera, Secretary Janice Corbett, City Attorney Bill Carter, Councilman Candy Jazdzewski and several interested citizens . The minutes of September 6 , 1977 were presented for approval . Motion was made by Loveland, seconded by Mann to approve the minutes as presented. All in favor, motion' carried. Old Business A . Wayne Fair - #1068 Plan Review for a single family residence located at 5th & Ash - Attorney s interpre- tation Attorney Carter stated that when he first reviewed this . matter he was looking at the property as one parcel . Upon further review of the ordinances this matter must be looked at as two separate lots . The ordinance regarding special yards and distances between buildings ' states that the distance between any principal building and detached accessory building shall be a minimum of 10 feet and the distance between principal buildings shall be at least one-half the sum of the height of both buildings provided that in no case shall the distance be less than twelve feet . This would authorize the City to approve more than one principal building on the same lot . Attorney Carter stated he sees no reason why the City could not approve this building as long as it meets with the City requirements regarding offstreet parking, yard, lot, width, and density requirements . Attorney Carter stated he would like 'to make two comments relating to this matter : 1 . He noted that Mr . Fair shows a 7 ' rear yard setback . This does not comply with City standards since the required rear yard setback in an R-3 zone is 10 ' . There is a question relating to a minor partition . The minor partition ordinance is ambiguous relating to the separation of a lot into two separate lots . Attorney Carter said that the City should have some kind of assurance that the houses will remain under one ownership. Mr. Pat Huyke, attorney for Mr. Fair, was recognized and he stated that he will draft an agreement between the City and Mr . Fair stating that no portion of one lot will be separated , from the other lot and that the total parcel will remain under one ownership and will be recorded with the deed. Mr . Huyke will present the draft agreement to Attorney Carter for his review and approval . Mr. Fair presented to the Commission revised building plans and stated that the 7 ' rear yard setback had been corrected to 10 ' to zn,t4q l0, I q 1'7 comply with City standards . Motion was made by Mann , seconded by Emery to approve Mr. Fair' s revised building plans as presented subject to R. J . ' s staff report and also signing of the agreement regarding the separation of the lots . Roll call vote : Emery , yes ; Hillyer , yes ; Loveland , yes ; Mann , yes ; Banks, yes . All in favor, motion carried. B . Gary Yost - Minor partition for 5 4-plexes located on 10th and Laurel Motion was made by Hillyer, seconded by Loveland to deny the minor partition. All in favor, motion carried . C . Public hearing date for zone change - Applicants , Vic & Dan Kosmatka, J. M. & Lillian Weidman & Gerald Corcoran - Cherry St. Motion was made by Mann, seconded by Emery to set the public hearing date for zone change to October 4th . Roll call vote : Emery , yes ; Hillyer , yes ; Loveland, yes ; Mann , yes ; Banks , yes . All in favor, motion carried. New Business A . Kilby Mobile Home Park Site Plan Review - Bob Blanton , Engineer. a Mr. Dewey Wilson , attorney For the Kilby ' s said that the mobile home park ordinance requires that the landscape plans be drawn up by a licensed landscape architect. There is only one licensed landscape architect in Jackson County and he is unavailable at this time. Mr. Wilson asked that the Commission eliminate this requirement. Mr. Bob Blanton, Engineer, presented to the Commission preliminary sketches for the building , site plans describing the drainage, street plans showing the width, curvitures and location of the streets , sewer plans and a layout showing the location of mobile home spaces . A brief summary of the plans followed . Attorney Wilson outlined the procddure they wish to take regarding approval of the mobile home park license : 1 . The Planning Commission will review and make tentative recommendations on the construction in accordance with the plans . 2 . The Planning Commission recommendations will be forwarded to the City Council . The Council will tentatively approve the issuance of the license based on the conditions of the staff ' s approval , issuance of the building permit and construction according to the plans . 3. The Staff will make their recommendations to the Commission. a 4. The Commission will then recommend to the City Council that the license be issued . S . The City Recorder will issue the license . Motion was made by Emery, seconded by Loveland to approve subject to staff approval of detail drawings the following : 1 . The Site Plan 2 . Preliminary mobile home park license 3. A submittal of the landscape plans at a later date 4. Recommendations to the City Council that the landscape plans be accepted without an architect ' s stamp and to adopt the findings as presented by the proponents . Roll call vote : . Emery, yes ; Hillyer, yes ; Loveland, yes ; Mann , yes ; McManama, yes ; Banks , . yes. All in favor, motion carried. Miscellaneous Matters and Public Appearances A . Mr. Norman Bruce representing the American Legion was recognized . He stated that they are purchasing some property by Crater .Iron for a Legion Hall in an LC-LI district . " A discussion was held on the required setbacks and Mr. Bruce said he would be in to file for a variance to the setbacks . B . Mr. Don Bellew was recognized and asked what the status is on the .10th Street project. He stated that many school children have to walk in the street which creates a hazardous condition . Adm . Kucera said that he hoped to have the project completed before the rainy season . C . A discussion was held on urban growth boundaries . Attorney -.Bill Mansfield was recognized and stated he is representing Mr . Harry Elden .who .owns 18 acres adjacent to the Seven Oaks Interchange. Mr: Elden wishes .to_ be included within the urban .growth boundaries . Commissioner Emery stated .that if anything should be .deleted from the urban growth boundary map it should be the two agricultural areas . D. Commissioners Emery and Loveland gave a report on permitted and conditional .uses in a C-4 zone . A discussion was held . The Commission asked that Secretary Corbett make up a report on uses in a C-4 zone to be presented at the next meeting .
