August 16, 1977

The Planning Commission meeting was called to order by Chairman
Don Banks . Roll call found the following Commissioners present :
Emery , Hillyer, Mann , Messmer , McManama, Waldron and Banks .
Absent being Commissioners Loveland and Halley . Also present
were Bldg . Inspector R. J. Ritchey , Secretary Janice Corbett,
City Adm. Dave Kucera, Recorder Betty Anders and a few interested
citizens .
The minutes of August 2nd were presented for approval . Motion was
made by Waldron, seconded by McManama to correct the motion on
Page 2 , #A under New Business to read as follows : "Completely
delete the R-3-2.1 and R-3-2 . 4 zone from all records but the
density in an R-3 district shall be 4000 sq. ft . for the first
dwelling unit and 1200 sq. ft. for each added dwelling unit" .
All in favor, motion carried.
Old Business
A . Chairman Banks opened the conditional use public hearing for
a mobile home to be used as a sales office on the construction
Lite as requested by Mr. Ron Young , Multi-State Builders , and
asked if there were any proponents . Mr. Ron Young came forth
and said he is proposing to use the existing mobile home on
the construction site as a sales and construction office during
the construction period of the Green Glen Subdivision . The
home is 10 ' X 54' and has been located at the existing site
since 1963 and during that time there has been no public
opposition to the location . Mr . Young stated the property has
already been annexed and will be zoned R-1-6 for lots 8000
square feet or more in the next 30 days . The construction site
amounts to 11 .2 acres . There is approximately 50 feet of
right-of-way separating the mobile home site from Griffin
Creek . The home will be used as a construction sales office
and this will allow construction workers as well as patrons
looking at property the use of the home and would eliminate
any traffic hazards of people parking on Scenic Avenue during
the construction of the subdivision . Commissioner Emery asked
Ron how long he thought it would take before the subdivision
is completed . Ron said he anticipates completion by the end
of next summer. Chairman Banks asked if there were any
opponents . No one came forth. The public hearing was closed.
The Fasano Findings were read and the questions were filled out.
(Refer to attached report) . Motion was made by Emery , seconded
by Mann to allow this conditional use for the existing mobile
home to be used as a sales and construction office during the
construction period of the subdivision but not to exceed 18
months. Roll call vote : Emery, yes ; Hillyer, yes ; Mann, yes;
McManama, yes ; Messmer, yes ; Waldron , yes ; Banks , yes . All in
favor, motion carried .
B . Ron Young presented another revised preliminary plat (Green
Glen) for the Commission to review. He stated City Adm .
Kucera had suggested several changes in the plans .
Originally the preliminary plat indicated a road running
east and west. In looking over the plans Adm. Kucera
thought the plat should be submitted with a 15 foot
pedestrian way with tie for sewer only and put in
curves on Nancy Avenue . Curbs , gutters and sidewalks
were discussed along the easterly property-line next to
Griffin Creek . Ron indicated that he 'would put in
curbs, gutters and sidewalks on that side of the creek
and would put some low growing shrubbery past the
sidewalk to „prevent anyone from getting down to the
creek. Jackson County has indicated that they want
curbs , gutters, sidewalks and a storm drain system
running into the creek on Scenic Avenue. Ron stated he
has agreed to this . Motion was made by MCManama,
seconded by Mann to tentatively approve the preliminary
plat with the staff recommendations except if staff .
recommendation #7 cannot be done then the plans are to
be approved as presented. Roll call vote : Emery, yes;
Hillyer, yes ; Mann , yes ; MCManama, yes ; Messmer, yes ;
Waldron , yes ; Banks , yes. . All in favor, motion carried.
Motion was made by Hillyer, seconded by McManama to
accept $2795 in lieu of park land. Roll call vote :
Emery, yes ; Hillyer, yes ; Mann , no ,•' MCManama, .yes ;
Messmer, no ; Waldron , no; Banks, yes . With majority in ,
favor, motion carried.
Commissioner Halley arrived at 8 : 30 P .M.
C . Ron Young came forth representing Robbie Collins regarding
the Mt. Pitt warehouse proposal .:_ Ron stated that Mr.
Collins had talked to the Public Utility Commissioner and
Southern Pacific in regards .to getting the Taylor Road
crossing . Ron stated that -this matter will be brought
before the Commission at a later date when there is
something further to report. .
D. The discussion regarding ,park land within subdivisions
was tabled to Wednesday, August 17th.
New Business
A . #1068 Plan .Review .for a Squeeze In Sandwich Shop located
at ine,. Bob Kline, Applicant .
Bldg . Inspector Ritchey said the applicant wishes to
completely renovate the building where the laundromat
use to be for the purpose ,of a sandwich shop. A
discussion was held on the safety of the 2nd floor .
Chairman Banks made the statement .that the 2nd story ,
floor has sunken 18" . Notion was made by Waldron ,
seconded by Mann to approve the #1D68 Plan Review with
the stipulation that the City Engineer and Bldg . Inspector
apprve the 2nd story or make a recommendation to the
Commission on how it can be fixed or if it can be fixed
in order to be safe. Roll call vote : Emery, yes ; Halley , yes ;
Hillyer, yes ; Mann , yes ; McManama, yes ; Messmer , yes ; Waldron ,
a yes ; Banks , yes . All in favor, motion carried.
B . #1068 Plan Review for Jones ' Fair City Market located at
1775 North Tenth Street, Charles Jones, Applicant .
Bldg . Inspector Ritchey stated the #1068 Plan Review was
approved last year but there are a few items he would like
to bring to the Planning Commission ' s attention . R . J. said
there is about 7 ' of property between the back of the sidewalk
and the property line on 3rd and 10th Streets and the developer
would like to extend the asphalt paving to the back of the
sidewalk . R. J . stated that when the plans were approved the
developer agreed to put in curbs, gutters and sidewalks along
10th Street. Motion was made by Emery, seconded by Halley to
approve the blacktopping of the 7 foot strip on 3rd and 10th
Streets to the existing sidewalk and extend paving from the
gutter on 10th Street to join the existing paving with base
rock and asphalt concrete to be installed to city standard
street specifications . Roll call vote : Emery , yes ; Halley,
yes ; Hillyer, no ; Mann , yes ; McManama, yes ; Messmer, yes ;
Waldron, yes ; Banks, yes . Majority in favor, motion carried.
C . #1068 Plan Review for a single family dwelling located at
5th and Ash Streets, Wayne Fair, Applicant
The existing house on the property is 272' X 34' and faces
Ash Street. Mr. Fair said he intends to provide offstreet
parking . Bldg . Inspector Ritchey stated a question has
arisen regarding setbacks for corner houses . A discussion was
held regarding setbacks for corner houses and parking on
alleys . Motion was made by Hillyer , seconded by Messmer to
get an interpretation from the attorney regarding setbacks for
corner houses and parking on alleys compared to parking on
streets before going ahead with this by the September 6th
meeting. Roll call vote : Emery , yes ; Halley , yes ; Hillyer, yes ;
Mann , yes ; McManama, yes ; Messmer , yes ; Waldron , yes ; Banks ,
yes . All in favor, motion carried.
Motion was made by McManama, seconded by Emery to adjourn .
All in favor , motion carried. Meeting adjourned at 9 :15 P.M.

(C ) No adverse effect. None since this is a preexisting use .
(D) Any additional conditions imposed by Planning
Commission .
(1) This mobile home is to removed when the subdivision
is completed or when 18 months is up, whichever
comes first .
