June 21st
7 : 30 P .M. '
The Planning Commission meeting was called to order by Chairman
Don Banks . Roll .call found the following Commissioners present :
Emery, Halley, Hillyer, Loveland, McManama and Banks . Absent
being Commissioners Mann , Waldron and Wood. Also present were
Secretary Janice Corbett , Building Inspector R. J. Ritchey and
several interested citizens .
The minutes of June 7th were presented for approval . Motion was
made by McManama, seconded by Loveland to approve the minutes
as presented . All in favor , motion carried.
Old Business
A . Motion was made by Emery, seconded by Halley to approve
Rodney Hall ' s landscaping plans at 133-135 S . Oak Street.
Roll call vote : Lmery, yes ; Halley , yes ; Hiiiyer, yes ;
Loveland, yes ; McManama, yes ;'' Banks , yes . All in favor,
motion carried .
B. Mr . Wayne Olson, R & S Enterprises , explained the proposed
warehouse and office a i ion o he Commission . Motion
was made by Emery, secon e y Halley to approve the #1068
Plan Review for R & S Enterprises subject to the Staff '
Report and a statement saying that R & S will pave the
alley if the alley becomes a dust problem or hazardous to
the neighboring residents . Roll call vote : Emery., yes;
Halley , yes ; Hillyer, yes ; Loveland, yes ; McManama , yes ;
Banks , yes . All in favor , motion carried. (Refer to
attached staff report)
C . Mr . Bruce Millbank, Northwest Design , was recognized and
presented the plans for Pizza West Pizza Parlor under #1068
Plan Review located at 9 Front . r. 1 ank sta�cT-

fireplace. At the east property line will be a 6 ' chain
link fence with redwood slats . Motion was made by McManama,
seconded by Loveland to approve the #1068 Plan Review for
Pizza West subject to the staff report and chain link fence
with slats . (Refer to attached staff report) . Roll call
vote : Emery, yes ; Halley , yes ; Hillyer, yes ; Loveland, yes ;
McManama, yes ; Banks , yes. All in favor, motion carried.
D. Chairman Banks opened the public hearingaamending the zoning
text to allow service, fraternal and lodge organizations in
all zones except M-1 & M-2 . Chairman Banks asked if any
proponents were present. No oneewas recognized. Chairman '
Banks asked if any opponents were present. No one was
recognized. The public portion of the hearing was closed.
Motion was made by McManama, seconded by Halley to allow
service, fraternal and lodge organizations in all zones
except M-1 & M-2 . Roll call vote : Emery, yes ; Halley, yes ;
Hillyer, yes ; Loveland, yes; McManama, yes ; Banks , yes . All
in favor, motion carried .
E. Chairman Banks opened the public hearing for the variance on a
conditional use permit located between S. 7th & 9th Streets ,
Applicant Bob Smith. Chairman Banks asked if any proponents were
present. Mr . Bob Smith was recognized and stated that the proposed
project would be financed by the Federal Government and is on a
40 year program. He stated that 12 parking spaces are available
and each unit would be 625 sq . ft . Mr. Bruce Abele, Northwest
Design, was recognized and stated that several similar elderly
planned unit developments in Medford and the surrounding area have
3/4 to 1 parking space per unit and the parking is ample. Chairman
Banks asked if any opponents were present. No one was recognized.
The public portion of the hearing was closed. Chairman Banks read
the Fasano Findings . (Refer to attached findings) . Notion was
made by Halley , seconded by Loveland to approve the application for
a variance and allow one parking space per unit instead of the
required two subject to the Fasano Findings . Roll call vote :
Emery, yes ; Halley , yes ; Hillyer , yes ; Loveland, yes ; McManama,
yes ; Banks , yes . All in favor, motion carried—
F. Chairman Banks opened the public hearing for the variance at
510 Grand Avenue, Applicants Mr & Mrs . James Matthews and Multi-
State Builders Ron Young , A t . Chairman Banks asked if any
proponen s were present . Ron Young was recognized and stated
they are requesting a change in the lot width from 60 ' to 501 .
This change would comply with the other lot widths in the area
which are approximately 51-53' wide. Chairman Banks read a
letter from Edwin and Irene Freeman , 464 Bush Street , in favor
of the variance, Chairman Banks asked if any opponents were
present . No one was recognized. The public portion of the
meeting was closed. Chairman Banks read the Fasano Findings .
(Refer to attached findings) . Motion was made by McManama,
seconded by Halley to approve the variance and minor partitioning
along with the Fasano Findings . Roll call vote : Emery , yes ;
Halley , yes ; Hillyer , yes ; Loveland, yes ; McManama , yes ; Banks ,
yes. All in favor, motion carried .

Banks asked if any proponents were present. No one was recognized.
Chairman Banks asked if any opponents were present . Councilman
Greg Dippel asked if the applicants and surrounding property-
owners had been notified of the public hearing tonight. Secretary
Janice Corbett stated that the applicants had been notified of
tonight ' s hearing but that since this was a tabled public hearing
the surrounding property-owners did not have to be renotified.
The public portion of the hearing was closed. Motion was made
by Hillyer, seconded by Loveland to deny the zone change since
the applicants were not present . Roll call vote : Emery,
abstained ; Halley, yes; Hillyer, yes ; Loveland, yes ; McManama,
abstained ; Banks , yes . Majority in favor, motion carried.
H . Chairman Banks opened the public hearing for a variance to allow
for a 3' setback instead of the erequired 10 ' on the south side
of the property located a7 224 S . Amy as requested by Robert 1
Ashenberner . Chairman Banks asked if any proponents were
present . Mr. Robert Ashenberner was recognized and said he would
like to withdraw his request for the variance. Chairman Banks
asked if there were ,any opponents present. No one was
recognized. The public portion of the hearing .was closed.
Motion was made by McManama, seconded by Hillyer to deny the
variance. Roll call vote : Emery, yes ; Halley, yes ;
Hillyer, yes ; Loveland, yes ; McManama, yes ; Banks , yes . All
in favor, motion carried. Motion was made by McManama,
seconded by Hillyer stipulating the reason for denial of the
variance was based on Mr. Ashenberner ' s request to withdraw
his application for a variance. 'Roll call vote : Emery ,
yes ; Halley , yes ; Hillyer, yes ; Loveland, yes ; McManama, yes ;
Banks , yes : All in favor , motion carried .
New Business
A . A minor partition request by L . L . Kottke, Applicant, located
at 261 N . 4th Street was brought before the .Commission .
Mr. Ko tke said the purpose for the division of the lot is
to build a duplex. Motion was made by Halley , seconded 'by
Loveland to approve the minor partition . Roll call vote :
Emery , yes ; Halley , yes ; Hillyer, yes ; Loveland, yes ;
McManama, yes ; Banks ,. yes . All in favor,, motion carried.
B. Mr. Ron Young , Multi-State Builders , presented to the '
Commission the :plans for annexation of 14. 36 acres located
at 2067 Scenic Avenue, Mary Fernau and Mr . . & Mrs. Robert
Vincent, Applicants , zone change application from County
zoning RR-2 to City zoning R-1-8 , conditional use -
application for a mobile -home on building site and a
preliminary plat for proposed Green 'Glen Subdivision.
Motion was made by Halley, seconded by McManama to set
July 5th as the public hearing date for the zone change
and recommend annexation of 14. 36 acres to the City
Council. Roll call vote : Emery, yes ; Halley, yes ;
Hillyer, yes ; Loveland, yes ; McManama, yes ; Banks, yes.
All in favor, motion carried.

seconded by McManama to allow Robert Ashenberner to go
ahead and put in foundation for his Buter building and
comply with the conditions of the Staff,iReport and
- Fire Marshal ' s Report (Refer to attached Staff Report) .
Roll call vote : Emery, yes ; Halley , yes ; Hillyer, yes ;
Loveland, yes ; McManama , yes ; Banks , yes. All in
favor, motion carried. '
Motion was made by McMa name , seconded by Emery to adjourn the
meeting . With all in favor , the meeting adjourned at 9 :25 P.M .

Application is herein made for variance to the lot width requirement
from 60 feet to 50 feet.
I would propose the following information for your consideration in
support of allowing the requested 10 foot variances
1 . The City of Central Point Comprehensive Land Use Plan indicates
that the Grand Avenue area is planned for multi-family or densely
developed housing areas in the coming 20 years. The lot was
originally proposed by the Final flap of the Grandview Addition
Subdivision 66 years ago .
2 . The existing lots surrounding the proposed lot are 49 feet and
50 feet in width.
3. The granting of the variance may eliminate the foreclosure of the
lot by Jackson County for back taxes in November which preserves
the enjoyment of the property rights of the petitioners .
4. The granting of the application will provide construction site
for a new house that will be priced in the starter home owners
range which is a need not being filled presently . No detrimental
effects to the health, or safety of persons residing or working
in the neighborhood of the property , but the value of the area
will be increased and because of new ownership, the possibility
of the upkeep of the area will be better.

Application is for permit for foundation footings and concrete
slab for Butler SBF II Building 30 ' X 150 ' to be located 20 '

200 , Haskell Street, Cooksey ' s Addition .
Permit for building must comply with State Fire Marshal ' s
Review Board specifications , and be reviewed by Planning

FASANO FINDINGS - Variance - Bob Smith, S. 7th & 9th Streets
(A) Are there exceptional or extraordinary circumstances or
conditions applying to the land, building or use referred
to in the application, which circumstances or conditions
do not apply generally to land , buildings or uses in the
same district? (Describe)
The particular type of housing designed is only for the elderly.
The majority of the people that will live there, at least 50%
will not own an automobile.
(B) Is the granting of the application necessary for the preservation
and enjoyment of substantial property rights of the petitioner?
(State reasons) Yes .
Open space for the elderly is necessary rather than asphalt.
Economic factor also prevails .
(C ) Would the granting under the circumstances be outweighed by the
adverse effects to the health or safety of persons residing or
working in the neighborhood of the property of the applicant, or
be materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood? Yes X No
Why or why not . The area next to the property is zoned
commercial and is an asset to the proposed housing development
for the elderly .
FASANO FINDINGS - Mr . & Mr's . James Matthews & 510 Grand - Variance

(A ) Are there exceptional or extraordinary circumstances or '
conditions applying to the land, building or use referred
to in the application, which circumstances or conditions
do not apply generally to land, buildings or uses in the
same district? (Describe)
Existing lots are 50 ' lots . This change would conform to
the neighboring lots .
(B) Is the granting of the application necessary for the
preservation and enjoyment of substantial property rights
of the petitioner? (State reasons) Yes.
Refer to Ron 's report (attached) : The granting of the
variance could prevent the foreclosure of the property
by Jackson County for back taxes . This would preserve
the rights of the property-owner.
(C) Would the granting under the circumstances be outweighed
by the adverse effects ' to the health or safety of persons
residing or working in the neighborhood of the property
. of the applicant, or be materially detrimental to the
public welfare or injurious to property or improvements
in the neighborhood? Yes X No . ,
Why or why not. This change would upgrade the area and
would create additional usable lots.
