HomeMy WebLinkAboutMay 17, 1977 Planning Commission Minutes May 17 , 1977 a 7 : 30 P .M. The Planning Commission meeting was called to order by Chairman Don Banks . Roll call found the following Commissioners present : Emery, Hillyer , McManama and Loveland. Absent being Commissioners Halley , Mann , Waldron and Wood. Also present were City Adm. Dave Kucera , Secretary Janice Corbett, Councilman Orville Hamer and several interested citizens . The minutes of May 3rd and special meeting minutes of May 10th were presented for approval . Motion was made by McManama, seconded by Loveland to approve the minutes as presented. All in favor,motion carried . Correspondence 1. Chairman Banks read a letter from the Medford Post Office regarding a formalized mail delivery approval procedure for subdivisions and asked the Planning Commission to adopt a policy requiring mailbox grouping at property line. Old Business A . Resolution of intention to amend zoning ordinance{ a Motion was made by McManama, seconded by Emery to set June 21 , 1977 for public hearing and adopt Resolution #239 . Roll call vote : Emery , yes ; Hillyer, yes ; McManama , yes ; Loveland, yes ; Banks , yes . All in favor, motion carried . Resolution #239 - "A PLANNING COMMISSION RESOLUTION OF INTENTION TD AMEND ZONING ORDINANCE TO ALLOW SERVICE , FRATERNAL AND LODGE ORGANIZATIONS AS A CONDITIONAL USE IN ALL ZONES EXCEPT M-1 & M-211 . Resolution #239 Declared Duly Adopted. New Business A . The public hearing for a variance at 751 Hazel Street was opened by Chairman Banks . Chairman Banks asked if any proponents wished to speak. Mr . Louis Corwin representing Jim Nistler came forth . Mr. Corwin said the purpose of the variance is to create two separate tax lots to establish individual ownership . Chairman Banks asked if there were any opponents who wished to speak. Councilman Hamer said that the division of the property would create two illegal tax lots and this would be unfair to the citizens of Central Point . Chairman Banks closed the public portion of the hearing. (Refer to attached Fasano Findings) . Motion was made by Loveland , seconded by Hillyer to deny the variance. Commissioners Emery and McManama stated they could not vote because they reside within 300 ' of the property . Roll call vote : Hillyer, yes ; Loveland, yes ; Banks, yes . All in favor, motion carried. B . The public hearing for the zone change .on .Taylor Road was opened by Chairman Banks . Chairman Banks asked if any proponents wished to speak. Mr . Dennis Hoffbuhr, 219 N . Oakdale, surveyor for W. L. Moore came forth. He said that the sale is pending on the zone change. The proposed annexation is .for a subdivision consisting of 10 . 3 acres with 87 lots . Mr. Hoffbuhr said the property lies south of Taylor Road and northeast 'of West Pine Villa Subdivision . Mr . Jack Hoffbuhr said he met with the School Supt . and found that there is room at Mae Richardson School for 70- 80 children . The rest of the schools in the area are above capacity. Chairman Banks asked if any opponents wished to speak . Mr. Chuck Bateman , 2130 Taylor Road, stated he was opposed to any subdivision 'west ,.of the railroad track until there are at least two more crossings . He said the railroad track is already very dangerous without adding more traffic and children to the area. Mr. Otto Bohnert, 4270 Grant Road, said his main concern is Griffin Creek regarding flood problems . Chairman Banks closed the public portion of the hearing . (Refer to attahced Fasano Findings) . Motion was made by Emery, seconded by Loveland to approve the zone change from County zoning RF-5 to City zoning R-1-8 . Roll call vote : Emery , yes ; Hillyer, yes ; McManama , yes ; Loveland, yes ; Banks , yes. All in favor, motion carried. Motion was made by McManama, seconded by Hillyer to recommend annexation to the City Council of the 10 . 3 acres ' on Taylor Road. Roll call vote : Emery, yes ; Hillyer, yes ; McManama, yes ; -Loveland, yes ; Banks, yes . All in favor, motion carried. C . Mr . Bruce Abelo- representing Bob Smith regarding federally; subsidized low .income housing for the elderly between . S. 7th and 9th Streets said 'that he would like to request only 1 parking space per unit . The housing would be for people 62 and over and most of them would not have cars . The Commission requested that Mr . Smith file for a variance. D. Ordinance #1068 plan review for Rodney Hall at Oak & .S . 4th Street was held . . Motion was made .by Hillyer , seconded by McManama to table the 1068 review until the landscape plans have been presented. Roll call vote : Emery , no ; Hillyer , yes ; McManama, yes ; Loveland, no ; Banks , no. 3-no ; 2-yes . Majority in opposition, motion failed. Motion was made by Emery, seconded by Loveland to approve the building plans subject to the -staff .report and city building codes and add a. clause stating that the duplex and existing house stay under one ownership if sold and at the June 7th meeting review .the landscape plans under Ord. 1068 review . Roll call vote : Emery , yes ; Hillyer , yes ; McManama, yes ; Loveland, yes ; Banks , yes . All in favor, motion carried V Miscellaneous Matters & Public Appearances a 1 . Waive filing fee for Bob Ashenberner variance application . Motion was made by Hillyer, seconded by Loveland to waive filing fee for variance application and set public hearing date for June 21st . Roll call vote : Emery , yes ; Hillyer, yes ; McManama, yes ; Loveland, yes ; Banks , yes . All in favor, motion carried. With no further business to be brought before the Planning Commission, motion was made by McManama, seconded by Emery to adjourn the meeting . All in favor , motion carried . (Describe) Does not conform to 'R-1-7 zoning regulations . (B) Is the granting of the application necessary for the preservation and enjoyment of substantial property rights of the petitioner? (State reasons) No . Petitioner, not owner . (C) Would the granting under the circumstances be outweighed by the adverse effects to the health or safety of persons residing or working in the neighborhood of the property of the applicant, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood? X Yes No Why or why not . The granting of this variance would create two illegal lots within the City. FASAND FINDINGS - Martha Krupp - Taylor Road a (1 ) Does the proposed change conform with the Comprehensive Plan? X Yes No Why? The proposed change is within the Comp . Land Use Plan for medium density . (2 ) Is there a public need for the change? X Yes No. Why? The Commission agreed with the proponents that there is a need for additional housing in that area. (3) If there is a public need , would the public need best be met by the proposed zone change (Rather than by the use of other property) X Yes No Contiguous to another subdivision and trailer court and is compatible with one another . (4) Is there any adverse impact on the neighborhood? X Yes No ( If yes , list unfavorable impact ; if no , list favorable impact . ) An increase in traffic flow on Taylor and Pine Streets . The schools in the area are at or above capacity . (5) Have the proponents carried their burden of proof in establishing the above factors? Yes5 X No (6) The Planning Commission, by majority vote with a quorum present, X approves disapproves the proposed zone change and forwards such recommendation to the City Council .
