April 19 , 1977
7 : 30 P .M.
The Planning Commission meeting was called to order by Chairman Don
Banks . Roll call found the following Commissioners present : Emery ,
Mann, Halley , Hillyer , McManama and Loveland. Absent being Commissioners
Waldron and Wood . Also present were City Adm. Kucera, Secretary
Janice- Corbett , City Attorney Bill Carter , Councilman Candy Jazdzewski
and a few interested citizens .
The minutes of April 5th were presented for approval . A correction to
the minutes was made by Commissioner Mann . On page 2 , #C , 2nd line, the
designer for the Van Way 6-plex is Bruce Millbank and not Bruce Nubank .
Motion was made by Mann , seconded by Loveland to approve the minutes
as corrected. All in favor , motion carried .
Old Business
A . The continuation of the Wayne Van Wey public hearing for a
conditional use permit at 70 S . 9th Street for the construction of
a 6-plex was opened by Chairman Banks . Chairman Banks asked if
there were any proponents present . Mr . Bruce Abelo , designer,
Northwest Design Co . , came forth and presented to the Commission
a revised parking plan as requested by the City Staff. A
discussion was held on the parking arrangement . Chairman Banks
asked if there were any opponents present . No one came forth .
Chairman Banks closed the public hearing . City Adm . Kucera read
the staff report from the April 5th meeting . He said that the
Commission at their last meeting passed on for Council consideration
an amendment to the zoning ordinance requiring two spaces of parking
per unit in multi-family dwellings . Since this is a conditional
use the 2 parking spaces could be enforced . Motion was made by
Emery , seconded by Mann to approve the conditional use permit
including the staff conditions of April 5th with the exception of
#5. (Refer to attached conditions) . Roll call vote : Emery , yes ;
Halley, yes ; Hillyer, yes ; McManama, yes ; Loveland, yes ; Mann ,
yes ; Banks , yes. All in favor , motion carried.
B . A lengthy discussion was held on the Flanagan-Farnsworth Subdivision
proposal . The flood plain area was discussed at some length
regarding past and present flooding 'problems in the Daisy and
Griffin Creek area. The developer must comply with the National
Flood Insurance Program. In a letter to Adm . Kucera from Stevens ,

elevation . (Refer to attached letter) . Mr . Motes stated he
would like the Commission to approve the tentative plat. The
Commission strongly advised Mr. Motes against approval since this
development is still in a concept stage, final arrangement of
streets and lots are still unimproved and flood plain problems
have to be solved. Attorney Carter read the City and State
regulations for tentative plat approval and stated that with the
existing flood problems it would be premature to go ahead with
approval . Motion was made by Mann, seconded by Halley to table
the Flanagan-Farnsworth Subdivision until the May 3rd meeting for
further discussion . All in favor , motion carried.
C . The Central Point State Bank landscape plans were presented to
the Commission for review. No one was present representing the
bank. Motion was made by Emery, seconded by Mann to table the
landscape plans until someone appears before the Commission to
present and explain the plans . Roll call vote : Emery , yes ;
Halley, yes; Mann, yes ; Hillyer, yes ; McManama, abstained ;
Loveland, yes ; Banks, yes . Majority in favor, motion carried.
Motion was made by Emery, seconded by Hillyer that .the Commission
not look at any plans unless someone is present to present the
plans and answer questions. Roll call vote : Emery, yes ; Halley ,
yes ; Hillyer, yes ; McManama, yes ; Loveland, yes ; Mann, yes ;
Banks , yes . All in favor, motion carried.
Motion was made by Halley, seconded by Emery to accept money in
lieu of land for the park in the Flanagan—Farnsworth Subdivision .
All in favor, motion carried.
New Business
A . Motion was made by McManama, seconded by Halley to set the
variance public hearing date -at 751 Hazel Street applicant
James Nistler, for May 17th at 7 : 30 P .M. in the City Hall
Council Chambers . All in -favor, motion carried.
Commissioner Emery made a request to have past minutes
regarding the variance available at the next meeting .
B . Motion was made by Emery , seconded by Loveland that the
annexation request -by W. L . Moore Construction regarding ,
property on Taylor Road be heard concurrently with the
zone change hearing at the May 17th meeting at 7 : 30 P.M.
in the City Hall Council Chambers. Roll call vote :
Emery , yes ; Halley, yes ; - Hillyer, yes ; McManama, yes ;
Loveland, yes ; Mann, yes ; Banks , yes. All in favor, motion
carried.
Chairman Banks received a letter from Jackson County Planning
concerning the application of Opal Ross Ralls for a change in
zoning from Rural Residential 5 (RR-5) to Rural • Residential
2 . 5 (RR-2 . 5) . The Planning Commission received a similar
letter in February for the same request . At that time the
Commission approved the request but stated they were opposed
to flag lots .
With no further business to be brought before the Planning
Commission , motion was made by Halley, seconded by McManama
to adjourn . Meeting adjourned at 1(00 ::40\JP.M.

Staff Conditions
April 19 , 1977
1. The alley contiguous to property is to be paved with 2" a.c .
to City specifications .
a. A grade and alignment survey is to be provided by a licensed
engineer at no cost to City . Survey and staking shall be
approved by City Engineer before paving .
2 . Provide standard concrete alley approach on South 9th Street to
City specifications .
3. Sewer service line shall be installed by City Public Works Dept.
from sewer service on South 9th Street to property-line and cost
of installation including replacement of a .c . paving to be charged
to the developer at a time-and-material cost . (A $200 .00 deposit
is required with the application for permit) .
4. Provide sidewalk adjacent to front of building so tenants do not
have to walk in alley from parking area to dwellings .
5. Provide 6 ' screen fence between parking area and contiguous R-zones .
6. Provide drainage of parking area into existing storm drain catch
basin on South 8th Street .
7 . An architectural and landscaping review is to be applied for by
applicant to be completed by the Planning Commission under Ordinance
No . 1068 .
8 . Applicant is to record a deed for a portion of Lot 8100 to provide
a minimum of 15' access to Tax Lot #8200 at such time as any
division of ownership is executed.

As per your request, I have prepared a tentative "approximate
method" flood nap of the Daisy Cr2.ek drainage be t-ween peal
Lane and Pine Street. This deterrination is based on 1" equals
1, 000 ft aerial photos taken for our study last September 24th.
We have not asked for any local review of these lines but feel
that in this .instance the limits are fairly well defined. i•,e '
