April 5, 1977
7 : 30 P .M.
The Planning Commission meeting was called to order by Chairman Don
Banks. Roll call found the following Commissioners present : Emery ,
Halley, Hillyer, Mann , McManama, Loveland & Wood . Absent being
Waldron . Also present were Building Inspector R. J . Ritchey , City
Adm. Dave Kucera, Councilmen Hamer , Dippel , Corliss & Jazdzewski,
Secretary Janice Corbett and several interested citizens .
The minutes of March 15, 1977 were presented for approval . Motion uas
made by Emery , seconded by Halley to approve the minutes as presented .
All in favor , motion carried.
Old Business
A . The public hearing for a zone change at Hazel & 10th Streets was
opened by Chairman Banks . Chairman Banks asked if any proponents
wished to speak. City Adm. Kucera said that upon reviewing the
application , the property in question and the use requested for the
property , an amendment must be made to the Comprehensive Land Use
Plan . The applicant has requested that this hearing be continued
at a later date . Mr . Steve Jones , proponent, requested a one month
postponement. Motion was made by Mann , seconded by Emery to
continue the public hearing at the May 3rd Planning Commission
meeting at 7 : 30 P .M . in the City Hall Council Chambers . Roll call
vote : Emery , yes ; Halley , yes ; Hillyer, yes ; Mann, yes ; McManama,
yes ; Loveland, yes ; Wood, yes ; Banks , yes . All in favor, motion
carried.
B . The public hearing for a variance at Oak & South 4th Streets was
opened by Chairman Banks . A letter was read by McManama from
Rodney Hall , applicant, requesting a 15 ' setback rather,-,than the
required 20 ' . This variance request was based on preserving two
well established walnut trees . The staff report was read by
Building Inspector Ritchey . Chairman Banks recognized opponents
to the variance . Mr. Ken Damon , 348 Oak Street , requested that 2
letters in opposition be read . A letter in opposition to the
variance from Mary Harsh, 154 S . 4th Street, was read stating that
allowance of the variance and construction of a duplex would add
to the 4th Street traffic congestion . A letter in opposition to
the variance from Mack E . & Sara J . Brooks , 155 S . 4th Street , was
read stating they would not like to see anymore high density
buildings in that area and the increase in traffic would add to the
traffic congestion in that area. Mr . Damon said he goes along with
the two letters presented in opposition to the variance. Public
hearing was closed. Motion was made by Loveland, seconded by Mann
to deny the variance since the duplex could be built without the
need for a variance . Roll call vote : Emery , yes ; Halley , yes ;
Hillyer , yes ; Mann , yes ; McManama, yes ; Loveland , yes ; Wood, yes ;
Banks , yes . All in favor, motion carried.
a C . The public hearing for a c onditional use permit at 70 S. 9th Street
was opened. Applicant Way Van Wey was present . Mr. Bruce
Millbank, Northwest Design .Co. , spoke for the applicant. He stated
this project would bring in tax dollars , would be beneficial to the
community and the complex would be well. landscaped. The proposed
project will be a two bedroom townhouse (6-plex) with
landscaping in front of the unit and parking in the alley .
Short discussion was held. Building Inspector Ritchey read '
the staff report. Ritchey stated that parking spaces 7 , 8
and 9 would have to be eliminated since they require vehicles
to back up 45' into the alley . He said that one unit might '
have to be eliminated so that parking could .be rearranged .
Mrs . Patricia Garvin , 744 E. Pine, stated that her sewer has
not drained properly since the 4-plex was built. Motion was
made by Mann, seconded by Halley to continue this hearing at
the April 19th meeting at 7 : 30 P .M.. in the City Hall Council
Chambers at which time the . Planning Commission will review
the applicant ' s revised parking arrangement as requested by
the City staff. Roll call vote : Emery , yes ; Halley , yes ;
Hillyer, yes ; Mann, yes ; McManama, yes ; Loveland, yes ; Wood,
yes ; Banks, yes. All in favor, motion carried.
D. The public hearing to amend the zoning ordinance by allowing
developers temporary project and sales offices was opened.
No proponents .or opponents were present. Public hearing was
closed . Motion was made by Emery, seconded by Mann to direct
the Council to amend the zoning ordinance to allow temporary
offices on 'construction sites .., Roll call vote : Emery , yes ;
Halley , yes ; Hillyer; yes ; Mann , yes ; McManame, yes ;
Loveland , yes.; ;Wood, yes. All in favor, 'motion carried.
Motion was made by McManama, seconded by Emery to direct the
staff to prepare a report for the Council for the Planning
Commission ' s approval at the next meeting and incorporate '
the following Planning Commission recommendations into the
ordinance :
1. The mobile home can be used for daytime and nighttime use
only if a watchman is needed on the construction site.
2. The mobile home is not to be used as 's regular residence.
3. The conditional use shall be reviewed on a 6 month basis
from the date of approval. Ifaat the end 'of that time the
Planning Commission feels the use is not in keeping with
the ordinance, the Commission may hold a public hearing to
review the use and continue, revoke or make additional
conditions on the conditional use permit. .
4. The temporary office will be removed 10 days from the
date an occupancy permit is issued by the City Building
Department.
5. The mobile home must be hooked up to sewer and water as
approved by the City.
6. The mobile home must be neat in appearance and in good
maintenance at 911 times.

' in favor, motion carried.
E. The public hearing amending the zoning ordinance by requiring two
parking spaces per dwelling unit for multiple family dwellings was
opened. No proponents or opponents were present. Building
Pnspector Ritchey said that in the case of low cost housing for
the elderly , two spaces per unit might cause a hardship. Short
discussion was held . Councilman Hamer said he was in favor of
two spaces per unit . Emery made a recommendation to approve two
spaces per unit but there should be a dividing line on how many
units are being discussed . Motion was made by Halley , seconded
by McManama that the Council amend the zoning ordinance requiring
two spaces of parking per unit in multi-family dwellings and 12
parking spaces for federally subsidized low income housing for
the elderly and one bedroom apartments . Roll call vote : Emery ,
yes ; Halley, yes ; Hillyer, yes ; Mann , yes ; McManama , yes ; Loveland ,
yes ; Wood, yes ; Banks, yes . All in favor , motion carried.
F. Mr. Cliff Motes , Developer, introduced Mr. Tom Burton , Engineer,
and a short discussion was held . Mr. Motes said that they are
willing to put in any improvements that will better the area.
The Planning Commission suggested that Mr . Motes prepare an
impact statement regarding schools and Mr . Motes said he would
look into it. Mr. Motes stated they are agreeable to all the
recommendations made in the past . The Planning Commission set a
study session for April 12th at 7 : 30 P .M. in the City Hall Council
Chambers to discuss further the Flanagan-Farnsworth plans and what
had been done in the past.
G . Central Point State Bank presented their plans for a #1068 plan
review. Short discussion was held . Building Inspector Ritchey
read the staff report and Fire Marshal ' s report. Motion was made
by Halley, seconded by Loveland to approve the plans as submitted
subject to : '
1 . A level site obscuring fence being installed along the westerly
property-line beginning 3' high at the back of the alley.
2 . Planning Commission approval of the landscape plans which are
to be submitted within 30 days .
3. Remaining recommendations of the staff report.
Roll call vote : Emery, yes ; Halley , yes ; Hillyer, yes ; Mann , yes ;
McManama, abstained; Loveland, yes ; Wood, yes ; Banks , yes . Majority
in favor, motion carried.
With no further business to be brought before the Commission, motion
was made by McManama, seconded by Mann to adjourn the meeting .
All in favor, motion carried. Meeting adjourned at 10 : 10 P .M.

(A) Are there exceptional or extraordinary circumstances or '
conditions applying to the land, building or use referred
to in the application , which circumstances or conditions do
not apply generally to land, buildings or uses in the same
district? (Describe)
No. No extraordinary circumstances required for construction
of duplex on property . Land is of adequate size for
construction of duplex if builder .changes size .
(B) Is the granting of the application. necessary for the
preservation and enjoyment of substantial property rights
of the petitioner? (State reasons)
No . Petitioner would be able to utilize the land without
variance to highest and best use.
(C) Would the granting under the circumstances be outweighed by
the adverse effects to the health or safety of persons
residing or working in the neighborhood of the property of
the applicant, or .be materially detrimental to the public
welfare or injurious to property or improvements in the
neighborhood? Yes X No
Why or why not. Removal of walnut trees not detrimental to
use of land .
