The Planning Commission meeting was called to order by Chairman
Don Banks in the Fire Hall since there was a full house. Roll
call found the following Commissioners present : Emery , Halley ,
Hillyer , McManama, Loveland, Waldron and Wood. Absent being
Commissioner Mann. Also present were City Adm . Kucera,
Building Inspector R. J. Ritchey and Secretary Janice Corbett .
The Fire Hall was filled to capacity with interested citizens .
The minutes of March let were presented for approval . Motion
was made by McManama , seconded by Emery to approve the minutes
as presented . All in favor , motion carried.
New Business
The public hearing regarding the K lb mobile home park
conditional use permit was opened y C airman an s . 7ity Adm .
read a memo addressed to Chairman Banks and Commission regarding
the conditional use permit . (Refer to attached memo) .
Chairman Banks read the conditional use permit hearing procedure
form and asked if any proponents wished to come forth. Mr.
Dewey Wilson , Attorney representing Mr . & Mrs . Kilby , was
recognized. Mr . Wilson introduced Mr. & Mrs . Kilby to the
Commission . Mr . Bob Blanton , Civil Engineer, was recognized and
came forth. Mr . Blanton presented several drawings of the '
proposed mobile home park . He explained the type of mobile homes
that they are going to try to attract . They will be approx-
imately 80 ' of single wide, 50' to 70 ' long and would be handling
approximately 14 to 1500 square feet of living space. Mr. Blanton
said he designed Bear Lake Park in Phoenix. That park was designed
so that the placement of mobile homes was at or near grade so that
the floor of the mobile home was approximately 8" above the patio
slab . The driveway slab which is proposed to be 12 ' wide would go
all the way back until there was enough room for 2 covered parking
spaces and storage building which would be approximately 48 to 50
feet . In most of the mobile home spaces there would be additional
room off the street and behind the sidewalk for one more guest
parking space. The carport that will cover the parking spaces and
the patio cover are not part of the lot but a part of the mobile
home. Mr. Blanton stated that phasing is an economic method by
which you can license part of a park while another part is being
constructed. Under state law a mobile park must be completed
before a license can be issued, but under the phasing rule Phase
I can be completed within all the rules of the ordinance. This
allows mobile homes to be brought in and also allows some return
on the investment and rental on the mobile homes while the mobile
home park is still under construction. Mr. Blanton referred to
the drawings pointing to the 4 phases. In Phase I there will be
B6 units and also a recreation hall which will satisfy all the
requirements of the ordinance for Phases I & ' II . The recreation
hall will be approximately 6 , 300 square feet . The open . space
around Phase I will amount to 1 . 34 acres. In Phase I 55 offstreet

offstreet parking spaces have been provided over and above the
required 2 spaces per unit provided for under the ordinance. In
Phase II there will be 51 units . No recreation hall is required in
this phase. The open space area in this phase will amount to 0 .80
acres . There will be 14 offstreet parking spaces . In Phase III
there will be 63 units and a recreation hall of 2, 200 square feet .
The open space area in this phase will amount to 0 .98 acres . There
will be 36 offstreet parking spaces . In Phase IV , (the last phase
to be completed) , there will be a recreation hall with approximately
2 , 170 square feet. The open space area will amount to 0 . 97 acres and
there will be 32 offstreet parking spaces . Mr . Blanton presented
and read their statement of findings . (Refer to original Planning
Commission minutes ) . He then read the findings regarding the Fasano
ruling . (Refer to original Planning Commission minutes) . Chairman
Banks asked if anyone had any questions of Mr . Blanton . Mr . Ted
Christian , 527 Freeman Road, stated that when the fence goes up around
the mobile home park he is going to have 3 fences around his property.
Mr. Blanton said that they 'should get together to see what could be
done but also said that a 6 ' fence is required around a mobile home
park. Mr. Burt Putney , Medford, asked Mr . Blanton when Bear Lake
Park was completed . Mr. Blanton said about 2 years ago . Chairman
Banks asked if any opponents wished to speak. Mr . Burt Putney ,
Attorney representing Ervin Weathers , was recognized . Mr . Putney said
that he is not saying that this area is being used inappropriately
but that the Commission should consider the park contiguous to the
proposed property that has already been approved for a mobile home
park. Mr . Putney said that with the 10 homes in the Weathers ' park
a and the proposed 262 homes in the Kilby park this would be 342 mobile
homes along the freeway . The end result is going to be an area of
mobile homes that is literally going to be a city of mobile homes .
Since no one else came forth in opposition , Chairman Banks closed the
public hearing . Commissioner Emery asked if there was a possibility
of a left turn lane into the mobile home park. Mr . Blanton said that
based on the recommendations that were made to us as conditions by Mr.
Kucera this section of Hopkins Road would be developed to a Central
Point secondary arterial which requires a 40 ' street width. Mr . Blanton
stated that there is really no room for a left turn or acceleration lane
into the park . Mr. McCoy , 942 Hopkins Road , said there is no stop
sign out of Greenbrier Mobile Park and that a stop sign should be put
in the proposed park. Chairman Banks stated that a stop sign will be
required . Mr . Blanton stated that they are asking for the following 3
exceptions to the Mobile Home Park Ordinance :
1 . 30 ' instead of 40 ' street width inside the park.
2 . Total of 6 to 9 washing machines instead of the required 1B washing
machines (minimum) .
3. Install all mobile homes in a well drained pit and provide 2 or 4
reinforced concrete runners depending on the width of the mobile
home instead of providing a concrete or asphalt pad .
Motion was made by Emery , seconded by McManama to deny the variance of
301 and keep the street width at 40 ' which the mobile home park ordinance
speaks of . Roll call vote : Emery , yes ; Halley , abstained ; Hillyer, yes ;
McManama, yes ; Loveland, yes ; Waldron , yes ; Wood , no ; Banks, yes .
Majority in favor , motion carried .
Motion was made by McManama, seconded by Loveland to accept 6 to 9
washing units. Roll call vote: Emery , yes ; Halley, yes ; Hillyer,
yes ; McManama, yes ; Loveland, yes; Waldron, yes ; Wood, yes ; Banks ,
yes . All in favor, motion carried. ,
Motion was made by Emery, seconded by Halley to go by their request
on the construction of the slabs that will have to be worked out
when the final plans come in . Roll call vote : Emery , yes ; Halley ,
yes ; Hillyer, yes ; McManama, yes ; -Loveland, yes ; Waldron , yes ;
Wood , yes ; Banks , yes . All in favor, motion carried.
Motion was made by Emery to .have a left turn lane going into the
mobile home park on Freeman Road .but this would not take effect
until Freeman Road is brought up to specification .. Motion died on
the floor due to lack of second .
Motion was made by Emery, seconded by Halley to have a left hand
-lane installed in an agreement between the County and the City
subject to approval . Roll call vote : Emery, yes ; Halley , yes ;
Hillyer , yes ; McManama, yes; Loveland, yes ; Waldron , yes ; Wood ,
yes ; Banks , yes . All in favor, motion carried.
Chairman Banks read -the Fasano findings and the questions were
answered. (See attached Fasano findings ) .
Motion was made by McManama, seconded by Emery to approve the
mobile home park conditional use permit with the conditions of
the staff and also the conditions brought forth tonight. Roll
call vote : Emery, yes ; Halley; yes ; Hillyer, yes ; McManama, yes ; ,
Loveland, yes ; Waldron , yes ; Wood, yes; Banks ,_ yes . All in
favor , motion carried.
Meeting adjourned to the City Hall Council Chambers at -9 : 10 P .M.
Chairman Banks reopened the meeting at 9 :15 P .M .
Ordinance #1068 Plan Review - Walt Taylor Garage 446 S let
Street
Mr. Taylor was recognized and came forth. He said he mainly wants
storage area and since that area is in a C-2 zone the garage must
be built commercially. The size of the building -is 38 X 30 and
must comply with the State Fire Code. Motion was made by Emery ,
seconded by Waldron to approve this use in a C-2 zone including
the staff report . Roll call vote : Emery, yes ; Halley, yes ;
Hillyer, yes ; McManama, yes; Loveland, yes ; Waldron, yes ; Wood,
yes ; Banks, yes . All in favor, motion carried.
Ordinance #1068 Plan Review - Malot ' s mini market at Hopkins and
Bursell Roads
Mr . Tom Malot, 3119 Hanley Road, was recognized and came forth .
Building Inspector Ritchey read the staff report. Mr. Malot
presented plans of the proposed mini market . Short discussion was
held. Motion was made by Emery, seconded by Loveland to approve ,
the plans and toistipulate that the access route will be paved
uniform with the rest of the paving -and will abide by the staff
report and State and City codes . Roll call vote : Emery, yes;
Halley , yes ; Hillyer, yes ; McManama, yes ; Loveland, yes ; Waldron ,

Short discussion was held regarding the American Legion Hall and in
what zones fraternal organizations would be allowed . Motion was made
by McManama, seconded by Halley to permit fraternal organizations under
a conditional use permit in all zones excluding M-1 and M-2 zones .

Mr. Rodney Hall was recognized . He thought the public hearing regarding
his application for a variance for the construction of a duplex on 4th
Street was going to be held tonight .

SUBJECT : Kilby conditional use permit for mobile home park at
Freeman and Hopkins Road
DATE : March 15, 1977
The proposed property has recently been annexed to the City and zoned
R-3 which allows mobile home parks as a conditional use: The
adjacent property is zoned as shown on attached exhibit .
The proposal has been reviewed on basis of concept as requested
by the applicant and found to be in agreement with existing
ordinances .
The attached application speaks to the findings required by the
conditional use permit ordinances . In addition , at the public
hearing the applicant needs to answer the conditions as set forth
by the Fasano decision .
The applicant has verbally requested that all plans be withdrawn
prior to the hearing and a slightly modified plan No . 1 be
submitted. This report will be based on plan No . 1 as originally
submitted. Previous staff review with the Fire Chief and Police
Chief indicated either plan No. 1 or 2 would be satisfactory,
however, they each prefer plan No . 2 with fire access to western '
building.
Information needs to be provided by the applicant as to the
impact of increased traffic on Freeman Road and Hopkins Road with
consideration given to alternate and/or additional access routes
to the mobile home park.
Information about the type of mobile homes and park restrictions
also needs to be provided.
Three exceptions are requested from the current mobile home park
regulations for this use. One is for narrower streets . In. view
of the recent passage of the ordinance requiring 40 foot streets
in mobile home parks , it would seem that conditions have not yet
changed enough to warrant change from the original decision .
Since the City has no enforcement control over a private park no
parking zone, the only alternative to assure emergency vehicle
access is by requesting streets wide enough to allow both parking
and access .
Item two requesting modification of the washing facilities appears
to contain some merit . The requirements of Section 5 . 32 .260 should
be applied to the number of trailers not expected to contain
complete washer dryer facilities and reviewed each year with
business license renewed. ,
The decision on Item 3 requesting mobile home stand modification
can be made at present on an aesthetic basis subject to later
design approval .

The Planning Commission decisions on all three exception requests
must be made under Ordinance Section 5 . 32 . 490 and forwarded to the
' Council for approval .
If the Planning Commission approves the conditional use concept for
mobile home parks , recommended conditions are as follows :
1 . Prior to any construction permits or park licenses being issued,
the Planning Commission will review all final plans for conformance
under current zoning , mobile home park and design review ordinances ,
including Ordinance No . 1068 , with the right to ,impose additional
conditions at that time.
2 . The maximum number of units for this area will be 265 units which
may be subject to downward adjustment if conflicts arise in the final
design review and density requirements by the Planning Commission .
3. Street improvements to Freeman and Hopkins Road will include
improvement to a City standard 60 ' secondary arterial from property
line to centerline of existing pavement with curbs and sidewalks
continuously from the NW corner of the development on Freeman Road
to the SE corner on Hopkins Road. Any county requirements will also
be met for street improvements . Prior to permits being issued , the
applicant will approach the Council to determine the feasibility ,
possible boundaries and timing of a local street improvement district
in the area.
D 4. No approval for any utilities plans are given at this time.
5 . All streets in the mobile home park will be named . Also , all lots
will be numbered and plainly marked and visible at night .
6. A minimum of 500 gallons per minute fire protection will be provided
throughout the mobile home, parkas?required by the Fire Chief.
