December 7 , 1976
7 : 30 P .M .
The Planning Commission meeting was called to order by Chairman Don
Banks . Roll call found the following members present : Loveland,
Halley , McManama, Mann , Emery, Waldron , Hillyer . Absent being
Commissioner Zander . Also present were the following members of the
Citizens Advisory Committee: Grace Russell , Chris . Binker, Anthony
Shope, Eric Hamrin, City Adm . Ron Young , Building Inspector R . J .
Ritchey, Secretary Janice Corbett and several interested citizens .
The minutes of November 16 , 1976 were presented for approval .
Motion was made by Loveland, seconded by Mann to approve the minutes
as presented. All in favor, motion carried.
Old Ousiness
A . Public Hearing - Variance to setback requirements 15 feet in
lieu of 20 feet on 10th Street and 10 feet in lieu of 20 feet
on 9th Street, Assessor' s Account #37-2W-2CB , Tax Lot 100 -
Chairman Banks read aloud the Fasano Findings Procedures and
opened the public hearing . Chairman Banks asked if any proponents
would like to speak. Mr . Joseph Rehmer, builder, was recognized
a and came forth. Mr. Rehmer presented two plans to the Commission .
The first plan shows the land as it is now with setbacks shown .
The land area is 9 ,066 square feet. With all the setbacks it
leaves 2 ,750 square feet useable with only 3D% of the area.
The second plan shows the setbacks Mr. Rehmer desires with the
apartments drawn on it. Chairman Banks asked if there were any
opponents who wished to speak. Mr. Jim Wilson , j64 N . 10th Street,
was recognized and came forth. He stated the maority of the
people affected are against the variance and have so stated their
opposition by two petitions brought before the Planning Commission .
Mr. Wilson said that a 4-plex built on that corner lot may be a
hazard for people coming off of Hazel onto 10th. He feels the
proposed building will create parking problems and will be a
hazard for the children attending Jewett School . Mr. Robert
McAtee, 420 N. 10th Street, was recognized and came forth. He
said seven property-owners submitted a petition to the Commission
to reject the variance on account of the property around . He
said the people are asking that the variance remain the same.
Mr. Jack Spencer, 380 N . 10th Street, was recognized and came
forth. Mr . Spencer said it is a traffic hazard for the children
going to and from school . Mrs . Joyce Spain , 400 N . 10th Street,
was recognized and came forth. Mrs . Spain stated her main
concern is the amount of children on that street. Mr. Dewane
Hood asked the Planning Commission if they had ever gram a
10 foot variance in a residential area. Commissioner Mann said
they had on 7th and Ash . Chairman Banks closed the public
portion of the hearing . ( Fasano Findings attached) General
discussion was held. Motion was made by Hillyer, seconded by
Emery to approve the variance of 5 feet along 10th Street and
10 feet along 9th Street . Roll call vote : Loveland, yes ;
Halley, yes; McManama, yes ; Mann , yes ; Emery , yes ; Waldron ,
yes ; Hillyer, yes ; Banks , yes . All in favor, motion '
carried .
B. Public Hearing - Delete Section 17 .28 .080 , Density ,
Municipal Code, R-3-1 .2 and R-3-2 . 4 regulations -
Chairman Banks opened the public hearing . City Adm. Young
said the reason for deleting this section .from the Code was
there are yard setbacks and area requirements in the Code
already under Section 17..28 .050 . Section 17,28 .050 spells
out the size of the building allowed on any parcel of land.
Section 17 .28 .080 spells out densities based on the first
unit of 4,000 square feet and each additional unit varying
based on lot area for each additional unit after the first.
Chairman Banks asked 'if there were any proponents of
opponents present. Since no one was recognized, Chairman
Banks closed the public portion of the hearing . Motion was
made by McManama, seconded by Mann to delete Section 17 . 28 .

yes; Halley,. yes ; McManama, yes ; Mann, yes ; Emery, yes ;
Waldron , yes; Hillyer, yes ; Banks , yes . All in favor,
motion carried.
C . Public Hearing - Add R-1-7 zone to 'Section 17 .20 .050 ,
Municipal Code, for yard requirements , etc. -
Chairman Banks opened the public hearing. City Adm. Young '
told the Commission that ..there is an existing R-1-7 zone
in the City. Adm. Young said that the Code was recodified
sometime ago and this Section was inadvertently deleted from
the Code. This Section would add R-1-7 zone back into the
Code so the. areas- in the City zoned R-1-7 would have some-
thing that spells out the requirements . Chairman Banks
asked if there were any proponents or opponents present .
No one came forth. Chairman Banks closed the public
portion of the hearing . Motion was made by Mann , seconded
by McManama to add R-1-7 zone to Section 17 , 20 .050 to the
Municipal Code with recommendations of the Staff Report.

D. Urban Growth Boundaries Meeting with Jackson County
Planning Department
Mr. Jim Capp , Jackson County Land Use Coordinator .was
not present for the meeting with the Planning Commission
and Citizens Advisory Committee.

New Business
A . Central Point State Bank Request to change one-way alley grid -
City Adm. Young read a letter from Mr. Bob Lance , President of the
Central Point State Bank requesting the alley ' s one way direction
from west to east between 4th and 5th Streets be changed to an
east to west direction . Mr . Orville Hamer was recognized and said
it would be a detriment to the City and the traffic flow of the
alley to change one block. It is his recommendation to leave it
the way it is . General discussion was held . Motion was made by
Emery, seconded by Mann to table this to a study session , contact
all the owners of the alley and get input from them as to what
direction the alley should go . All in favor , motion carried.
Miscellaneous Matters & Public Appearances
A . Reimbursement contract for Mr. & Mrs . Bixby at the corner of
Hopkins and Freeman Roads -
City Adm. Young stated that he has an interest in this matter and,
therefore , cannot take any part . Total cost of the line is $1 , 700 .
It starts from the corner of Freeman and Hopkins Road and runs
approximately 120 feet north on Freeman Road. Short discussion was
held . Chairman Banks asked Adm . Young to get an engineer' s report
to see how many people will benefit . Chairman Banks asked the
Commission what procedure should be taken . Chairman Banks said
a there is no way of knowing what might go into the Gorden property
so this would have to be done on a square footage basis .
B . Ordinance 1068 Review - Quality Insulation -
Building Inspector Ritchey was recognized regarding the Quality
Insulation building and stated that the plans are a duplication of
the existing building except for the office and the new proposed
office will be inside the building . The existing building is
30 X 100 and the new proposed building is 45 X 100 . General
discussion was held. Emery said he would like some input from Mr .
McGrew as to how many employees there would be so as to determine
parking needs . Commissioner Emery made a motion , seconded by Mann
to table this matter until Mr. McGrew can be present .
C . Mr. Bob Smith , 211 Windsor Way , was recognized and came forth.
Mr. Smith stated the City gave him a building permit for 47 South
7th Street. He said that behind his property there are 2 other
lots and he was given permission to build 2 4-plexes on his
original request. He said he would like the Commission ' s feelings
on changing his original request and putting in 10 single-family
low cost dwellings for the aged. Discussion was held. The
minimum square footage is 625. Mr . Smith stated they ,.would be
one bedroom , one bath, kitchen , dining room, front room with small
storage area. Chairman Banks said the Planning Commission feels
there is a need for this type of housing close to town and told
Mr . Smith to get a preliminary plot plan together and present it to
the Commission .
D. Van Way ' s Donut Shop -
Building Inspector Ritchey presented plans to the Commission '
regarding Van Way ' s donut. shop . . Discussion was held. . Motion
was made by Mann , seconded by Emery to table this matter to the
next meeting (December 21st.) and have Mr. Van Way present. All
in favor, motion carried.
Motion was made by Emery , seconded by Hillyer to recommend to the
Council to change the ordinance from 12 to 2 parking spaces per
unit for multi-family dwellings. All in favor, motion carried.
E. Chic Hair Fashions -
Building Inspector Ritchey stated that Mr. Leo Mahoney, owner
of Chic Hair Fashions would like to have a false front of T1-ll
plywood, cover existing door and use door not presently being
used. He stated this is permitted under the Uniform Building
Code Section 17 .05. Motion was made by Mann, seconded by Halley
to approve this as long as it meets fire code and City. regula-
tions. All in favor, motion. carried.
With no further business to be brought before the Planning Commission ,
motion was made by McManama, seconded by Emery to adjourn . Meeting
adjourned at 9 : 30 P .M.
