HomeMy WebLinkAboutNovember 3, 1976 Planning Commission Minutes Wednesday , November 3, 1976 7 : 30 P .M . The Planning Commission meeting was called to order by Chairman Don Banks . Roll call found the following members present : Emery, Halley, Hillyer , Loveland, Mann, McManama, and Zander. Absent being Commissioner Waldron . Also present were Secretary Janice Corbett , Building Inspector R . J . Ritchey, City Adm . Ron Young , Councilmen Jim Mills and Orville Hamer , and the following Citizen Advisory Committee members : Grace Russell , Chris Binker, Tony Shope, Eric Hamrin „ and Aubrey Taylor. Many citizens were also present . The minutes of October 19 , 1976 were presented for approval . Motion was made by Emery, seconded by Mann to approve the minutes as presented. All in favor, motion carried . Old Business A . Public Hearing (conclusion) - variance to setback requirements 15 feet in lieu of 20 feet on 10th Street and 10 Feet in lieu of 20 feet on 9th Street , Assessor ' s Account #37-2W-2CB, Tax Lot 100 - Hamer Property Chairman Banks opened the public hearing . Chairman Banks asked if a there were any proponents . Mr. Joseph Rehmer , builder, was recognized. The reason he is asking for the variance to setback requirements is because he wishes to build a 4-plex, but he wants to build more than an adequate 4-plex . The lot is large enough to build a box type 4-plex but he wants to build a better looking unit . Chairman Banks asked the Commission if they had any questions . Commissioner Mann asked Mr . Rehmer what the size of the lot is . Mr . Rehmer said it is 73. 3 feet at one end and tapers to 56 . 25 feet at the other end. The length is 140 feet . Chairman Banks asked if there were any opponents to the variance. Mr . Robert C . McAtee , 420 N . 10th Street , was recognized. He said he would like to see a single property there which would enhance the property on 9th and 10th Streets . Mr. McAtee said he was the one who brought the petition in and two have signed off. Chairman Banks said that since two signed off that leaves 12 property-owners still on the petition . Mr . McAtee said that he and the property-owners think the lot is not big enough for a 4-plex and would like to see a single property at 9th and Hazel with shrubbery and landscaping around it to make the property look good all the way around . Mr . Jack Spencer , 380 N . 10th Street, was recognized. Mr . Spencer asked the Planning weeks prior to the petition that Commission if they were aware that 2 w p P the property-owners signed against the setbacks that Mr . Hamer circu- lated a petition for them to sign to waive the alley on that property . Chairman Banks said that the City Council handles alley vacations and the Planning Commission has nothing to do with it. Mr . Spencer said that they signed to let him have the alley property and now he wants to cut down his setbacks . It was stated by some citizens in the audience that Mr. Dewane Hood and Mr . Jim Wilson were not notified and that they are within 300 feet of the property. Chairman Banks said that he and the City Recorder checked the plat map for that area and it does show that everyone in that area was notified. Mr. Hood , stated he did not know the hearing was being held tonight until he arrived for the meeting . He thought that at the last meeting it was decided that this matter was going to be rescheduled and read- vertised and that .he did not receive any notice of the public hearing . Chairman Banks said that the City Attorney decided there would be no reason to resubmit this to the people again since all had been notified with the 300 feet and that is why the hearing was held tonight . Mr. Dewane Hood, 363 N . 10th Street , stated he would like to protest because he is within 300 feet and was not notified . Mrs . Joyce Spain , 400 N . 10th Street , was recognized and stated that her objection is for the safety of the school children . Many children go up' and down 10th Street and she thinks that cars will be parking in the street making it more hazardous for the children . Chairman Banks said that sidewalks will be put completely around the building for the children to walk on . Mr. Rehmer, builder, asked the Commission that he thought this part of the meeting was called for only the variance but the petition mentions the fact of an R-1 zone. Chairman Banks told Mr . Rehmer that the property-owners had made a mistake about the zone. Mr. Spencer said that there was no mistake about the zone on the petition . He told the Commission that they asked the Commission to change it to an R-1 zone. Chairman Banks said this area has been an R-3 zone for many years and the only one who can ask for a zone change is the property- owner himself. With no further questions or comments, . ' Chairman Banks closed the public hearing and asked the Commission if they had any questions . Commissioner Mann asked Mr. Rehmer what size building he was going to put up . Mr. Rehmer replied it would be 35 X 67, two story single family units with no children or pets . Commissioner Zander asked if there would be a hardship for anyone if the setbacks were granted . Mr. Spencer said it would be a hardship for him because he has no place to park his vehicles out of the weather. He' also stated that some- time ago he asked for a building permit 'to put a carport on his house and it was not given to him because it .was outside the setback requirements so why should Mr. Rehmer be granted. Mr. Rehmer presented a plot plan for the Planning -Commission to discuss and review. Short. discussion was held. Chairman Banks proceeded with the Fasano findings. (Fasano findings attached) . Motion was made by Zander, seconded by Loveland to accept the variance. Roll call vote ; Emery, yes ; Halley, yes ; Hillyer, yes ; Loveland, yes ; Mann , yes; McManama, yes ; Zander, yes ; Banks , yes . ' All in favor, motion carried. B . Final approval of Escondido Mobile Home Park (Weather' s) Adm. Young pointed to the plot plan that has been looked at by the City Council and said that conditions have been set that will come back to the Planning Commission once the agreement has been signed. Adm. Young said that the area ' from Bursell Road over to the entrance will be paved with curb and gutter all the way through as provided by the ordinance . From this entrance one-half (2) of the street to the easterly boundary will have aggregate base. The park �ovtiml'Uti 3 i 9 7(� will be developed on a phase development basis. The 1st phase will be done out to and including the recreation and service buildings . The 2nd phase will be gradual development of the rest of the park. Adm. Young said there was a stipulation in the subdivision ordinance requiring bonding of subdivisions . This development was approved without a bond . All fees associated with connection to the sewer line will be paid by the Developer. The water line will be connected to the City of Central Point B" line on Hopkins Road. Lotion was made by McManama, seconded by Emery to approve this mobile home park with the conditions that have been set. Roll call vote : Emery, yes ; Halley , yes ; Hillyer , yes ; Loveland, yes ; Dann, yes ; McManama, yes ; Zander, yes ; Banks , yes . All in favor , motion carried. New Business A . Public Hearing - Home Occupation request by Stacey Adams, 722 Laurel Street, Assessor' s Account #37-2W-2CB, Tax Lot 3, to allow a carpet and furniture cleaning business . Chairman Banks opened the public hearing . Chairman Banks asked if there were any proponents . fir. Adams said there would be no business operating from his home except use of a telephone. There would be no storage of any flammable chemicals in his home . Chairman Banks asked if there were any opponents . No one came forth. Chairman Banks closed the public hearing . Chairman Banks proceeded with the Fasano findings . (Fasano findings attached) . Lotion was made by Mann , seconded by Emery to approve the home occupation with the condition that in case of any storage of flammable materials , fir . Adams would have to come before the Planning Commission . Roll call vote : Emery , yes ; Halley, yes ; Hillyer, yes ; Loveland, yes ; Dann , yes ; McManama, yes ; Zander , yes ; Banks , yes. All in favor, motion carried. Comprehensive Land Use Plan - Urban Growth Boundaries - Adm. Young read a letter from Dorothy Simpson , Jackson County Planning Department . Adm. Young said that the time line that has been set up is for City-County Staff to begin preparation of maps, data and input from affected agencies which started in October. Through November staff.•._proposal_forca ' urban growth boundaries . In December review by committees formed under the Planning Commission and affected agencies urban growth boundaries as shown . Also in December joint meetings for the full Commission , Boards and Citizen Advisory Committees and public hearings . In January any revisions in the documents or maps presented will take place along with the procedure necessary to amend the Comprehensive Land Use Plan . The Planning Commission public hearings are set for February . Final approval set for March- April . The first public hearing was set for Tuesday, December 7 , 1976. In regards to the Hamer property variance , Mr. Jim Wilson was recognized and said he is within 250 feet of the property and Mr. Hood is also within 300 feet . Both mencdid not receive any notification . Chairman Banks asked Mr. Wilson if he is the ' property—owner of record . Mr. Wilson replied he is the owner. Chairman Banks asked him if he was buying under contract. Mr . Wilson stated he was buying from his grandmother. It was stated by Mr. Hood that he would like to have the decision. nullified until this matter has been resolved. Chairman Banks said that he could not see any further action on this matter since the variance was granted by the Commission earlier this evening and told Mr. Hood that he could appeal the decision to the City Council . With no' further business to be brought before the Commission, motion was made by mcManama, seconded by Emery to adjourn. All in favor, motion carried.
