October 19 , 1976
7 : 30 P .M .
The Planning Commission meeting was called to order by Chairman Don
Banks. Roll call found. the following members present_: Emery, Loveland,
Mann , McManama, Waldron and Zander . Absent, being Commissioner Hillyer .
Also present were Secretary Janice Corbett and Building Inspector R .J.
Ritchey. A few citizens were also present.
The minutes of October 5-, 19.7.6 were presented for approval . Motion
was made by Zander, seconded by Emery. to approve the minutes as
presented. All in favor, motion carried.
Old Business"
A . Gary Yost - Change in Plans - Ordinance #1068 Review - Assessor' s
Account #37-2W-2CB," Tax Lot 7200 , N . 10th Street
Chairman Banks asked if Mr. Yost was present. Since he was not,
this matter was tabled until- later. (See Page 3)
New Business
A . Public Hearing - Home Occupation to allow a carpet cleaning
business , Herbert G . Richman, 946 Crest Drive, Assessor' s Account
#37-2W-3AD, Tax Lot 4600
Chairman Banks opened the public hearing . Chairman Banks asked
if there was anyone present in opposition to the proposed home
occupation . No one came forth.
At this time Commissioner Hillyer arrived at 7 : 33 P .M .
Mr. Richman; proponent, was recognized by Chairman Banks . He said
he was proposing a carpet cleaning business . No work would be done
in his home. The only equipment used in his. home for this business
would be a telephone.
The Planning Commission asked Mr: Richman the following questions :
1. Would there be any storage of materials?
Mr. Richman said he would store non-flammable chemical cleaning
fluids in his garage.
2.. Are you aware of any covenants in that subdivision restricting
such activity?
Mr. Richman said he was not aware of any.
3. Will there be any equipment parked on the street?
Mr. Richman said that there would be no equipment parked on
the street.
With no further questions or comments,- Chairman Banks closed the
public hearing. Motion was made by Waldron, seconded by Zander
to approve the home occupation. Roll call vote : Emery, yes ; ,
Hillyer, yes ; Loveland, yes ; Mann, yes ; McManama, yes; Waldron,
yes ; Zander, yes ; Banks , yes. With all in favor, ,motion carried.
B. Public Hearing ; ,Variance- to setback requirements 15 feet in
lieu of 20 feet- on 10th Street and. 10 .feet in ,lieu of 20 feet
on 9th Street,Assessor' s Account #37-2W-2CB, Tax .Lot 100 .
Chairman Banks opened the- public hearing. Chairman Banks asked
if there was anyone present •in opposition .to. t_his variance.
No one was recognized. Chairman :Banks had ,received a petition
with 14 signatures of affected property-owners saying they
were opposed to the variance. Mr. Jim Wilson, 364 N .. ,10th
St. , was recognized and said he did not receive a letter
concerning the setback .regyirements . Mr. Wayne Hood,..,363 N.
10th St, and -Ruth Sinclair, 445-.N. .9th St.., stated they had
not received any letter either. Chairman Banks asked that
the Secretary to_ the Planning Commission find out ,why-.,,these
people had not received a ,letter, Motion was .made by
Hillyer, seconded by McManama to table this, send out the
notices again and readvertise. Chairman Banks closed. -the
public hearing . Roll call vote : Emery, yes ; Hillyer, ' yes ;
Loveland, yes; .Mann, .,yes ; ,NcManama, yes; ,Waldron,. yes ;
Zander, yes;- Banks, yes. With all in favor, motion carried.
C. Public Hearing - Ashenberner Moulding Co . , 224-262' Amy
Street - Variance to_ setback for rear yard from 10 ' to

Chairman Banks opened the public hearing. Mr. Vern Allen,
262 S . Amy , .was recognized„. If the .alley- .is closed, which
Mr. Allen brought forth a petition, the alley would consist
of his property, Louisiana. .Pacific., .and Ashenberner ' s
Property. Chairman, Banks informed Mr.-.-Alien that the vacation
of the alley will have. to .go -before the. Council as the
Planning Commission cannot approve vacation of alleys ,
Chairman Banks asked if there was anyone present who wasiin
opposition to this variance. .. No one came-forth. ..Chairman
Banks closed the public hearing. Building Inspector Ritchey
said that until such .time as -the vacation of the alley has
been settled, there is not much action that can be taken .
Motion was made by Emery, seconded by Loveland to 'table this
matter. Roll call vote : Emery, yes ; Hillyer, yes ;
Loveland,. yes; Mann , yes ;. McManama, yes ; Waldron , yes ;
Zander, yes;' Bank`si yes : - With all in (favor, 'motion carried.
Gary Yost -„ Change in.,-Plans - Ordinance #106B Review - Ass_essor' s
Account #37-2W-2CB, Tax Lot 7200, 'N . 10th Street
Mr. Gary Yost was, recognized by Chairman Banks. Mr. Yost said
he was asking the Commission for permission to- rough plumb the '
basement for a possible 5th unit in the future. Discussion was
held. Motion was made by Zander, seconded by McManama that Mr.
Yost commit himself to a 5th unit or disregard it at this time.

Roll call vote : Emery , no ; Hillyer, no ; Loveland, no ; Mann, abstain ;
McManama, yes ; Waldron , no ; Zander, yes ; Banks , yes . With 4-no, 3-
yes and 1 abstention, the motion was denied.
Motion was made by Hillyer, seconded by Emery that Mr. Yost be allowed
to rough plumb the basement. . Discussion followed . Building Inspector
R. J. Ritchey asked for clarification on what was meant by rough'
plumbing . R . J. said that. rough plumbing could' be all the water and
sewer and everything except the fixtures or .just .the soil pipe under
the concrete. Commissioner Hillyer said just' what is absolutely
necessary and not coming into the walls .. Just what is there. Mr.
Yost said that all h"e wants to do -is to rough plumb the soil pipe that
goes under the concrete. That is all he is interested in. The water
can be put in when he goes for his building permit. Roll call vote :
Emery, yes; Hillyer, yes; Loveland, yes ; Mann , abstain ; McManama, no;
Waldron , yes ; Zander, nb ;- Banks, no. With '4-yes , 3-no and 1 abstention,
motion was carried.
Miscellaneous Matters and Public Appearances
Mr. Don Wiley, President of Kitchen Masters Inc . was recognized by
Chairman Banks . Mr. Wiley was asking for 1066 review for a building
permit. Motion was made by Waldron, seconded by Emery to approve Mr.
Wiley ' s plans upon the approval of the Building Inspector and approval
of the Fire Chief. Roll call vote : Emery, yes ; Hillyer, yes..; Loveland,
yes ; Mann, yes ; McManama, 'yes ; Waldron, yes ; Zander, _yes ; Banks, yes .
With all in favor, motion carried.

Discussion was held regarding the 12 ' easement. Motion was made by
Waldron , seconded by Emery that the Commission amend this to the fact
that they just hold on to his letter of intent. Roll call vote :
Emery, yes ; Hillyer, yes ; Loveland, yes ; Mann, yes ; McManama, yes ;
Waldron, yes ; Zander, yes ; Banks, yes. With all in favor, motion
carried.
Emery made a recommendation that the City Staff contact Mr. Smith about
the 2 ' easement that he would have to give in order to have a 12' right-
of-way and an answer from Mr. Smith in writing that he would or would
not give the 2 ' easement for right-of-way. With all in favor, recommen-
dation carried.
With no further business to be brought before the Commission, motion
was made by McManama, seconded by Zander to adjourn . Meeting, adjourned
at 9 :07 P.M.
