HomeMy WebLinkAboutJune 15, 1976 Planning Commission Minutes June 15, 1976 7 : 30 P.M. The Planning Commission meeting was called to order at 7 : 30 P .M. by Chairman Don Banks . Roll call found the following members present : Emery , McDowell , Waldron, Loveland , Hillyer . Absent being Commissioners = Mann , McManama and Zander. Also present were Janice Corbett , Secretary, City Adm. Ron Young and Building Inspector R . J. Ritchey . The minutes of May 18, 1976 were presented for approval . Motion was made by McDowell , seconded by Hillyer to accept the minutes as presented. With all in favor, motion carried . Personal Appearances (A) Mr . Van Wey was not present . (B) Chairman Banks recognized Mr. John Pierson, 733 East Pine Street . Mr . Pierson stated that he has a 3 unit apartment complex between Cedar and Bush on Front Street . The apartments have two double garages underneath and Mr. Pierson wants to close in the front of the garages so at some future date he can put in an office. Mr . Pierson said that plans have been submitted. Discussion followed. Motion was made by McDowell , seconded by Emery to accept the plans as submitted subject to approval of a building permit by the City. Roll call vote : Emery, yes ; McDowell , yes ; Waldron , yes ; Loveland , yes ; Hillyer, abstained; Banks , yes . With all in favor , motion carried . Commissioner Mann arrived at 7 :50 P .M. Chairman Banks opened the public hearing for a zone change from R-1-8 (Single Family Residential) to C-1 (Commercial Limited) , Jackson County Assessor ' s Parcel Tax Account No . 37-2W-3A, Lots 1300 & 1400 , 3rd and 10th Streets , Charles Jones, Applicant. Chairman Banks asked if there were any proponents present. Mr. Charles Jones , 539 North 6th Street, was recognized. He stated that he is planning to build a convenience market on the corner of 3rd and 10th Streets . Discussion followed . Chairman Banks asked if there were any opponents present . No one came forth. Public hearing was closed. Adm. Young read the Staff Report and recommended that the zone change be allowed. Motion was made by Emery, seconded by McDowell to approve the zone change from R-1-8 to C-1 . Roll call vote : Emery , yes ; McDowell, yes ; Waldron , yes ; Loveland , yes ; Hillyer, yes ; Mann , yes ; Banks , yes . With all in favor, motion carried. (Refer to attached Fasano Findings) Chairman Banks opened the public hearing for a variance for side and rear yard setback requirements from 20 ' to 15 ' side yard and 5 ' to 0_' property line and 10 ' to 0 ' on rear property line, Jackson County Assessor' s Parcel Tax Account No . 37-2W-3A , Lot 400, Cherry and North 2nd- Streets , Central Point Church of God, Applicant . Chairman Banks asked if there were any proponents . Mr . Herman Bryant, 211 North 3rd Street, was recognized. He said he wants to remodel the building already there into a church . Chairman Banks asked if there were any opponents present . Mr. Norman Bruce, 5055 Dobrot Way, was recognized. He stated that he owns the property adjacent to the property in question . Mr. Bruce said he is not against the church but is against all the space that would be taken up with parking . Mr. Bruce said. he contacted his renters and they are against it. Mrs. Stansrud, renter of Mr. Bruce ' s apartment, said she is concerned about the level of livability if the church is allowed because of a parking lot right against the bedroom window, gas fumes and noise factor . Commissioner McDowell asked Mr . Bryant if the church has already purchased the property. Mr . Bryant said yes . Commissioner Emery asked Mr. Bryant if the church would be in use any other day except Sunday . Mr. Bryant said the church would be in use on Wednesday nights . He stated that there would be no activity after 9 :00 P .M. Mrs . Gloria Deason , 247 Cherry Street , was concerned about what would happen to the parking area when the congregation grows . With no further comments , the public hearing was closed. Adm . Young read the Staff Report. He said churches are allowed within an R-3 zone. Motion was made. by Emery, seconded by Loveland to deny the request for a variance. Roll call vote : Emery , yes ; McDowell , yes ; Waldron , yes; Loveland , yes ; Hillyer, yes ; Mann , yes ; Banks , yes. With all in favor, motion carried . (Refer to attached Fasano Findings) Chairman Banks opened the public hearing for a conditional use permit for a commercial parking lot, Jackson County Assessor 's Parcel Tax Account No . 37-2W-10AA , Tax Lots 3800 and 3900 , 145 South Front St . , Grange Co-pp, Applicant. Chairman Banks asked if there were any proponents present. Mr. Jim Hudson , Manager of the Grange, was recognized and came forth. He said the property ' is 70 ' (wide) by 100 ' (deep) and fronts on Front Street. Mr . Hudson said the Grange is proposing to buy the property and use the lot for parking delivery trucks . Chairman Banks asked if there were any opponents present. No one came forth. Public hearing was closed. Adm. Young read the Staff Report . Staff recommends approval with asphalt paving . Motion was made by Loveland, seconded by Hillyer to approve the conditional use permit with the Staff recommendations and agreement with Grange Co-Op that they blacktop the parking lot -later on if it becomes a hazard . Roll call vote : Emery, yes ; McDowell, yes ; Waldron , yes ; Loveland , yes ; Hillyer, yes ; Mann , yes ; Banks , yes . With all in favor , motion carried . (Refer to attached Fasano Findings) Plan Review (A ) Gary Yost - Short discussion was held. The parking lot and driveways will have to be blacktopped . Adm. Young read the Staff Report. Motion was made by McDowell , seconded by Hillyer to approve the plans subject to the recommendations and requirements of the Staff before obtaining a building permit plus the condition would agree for Mr . Yost to pave the parking lot six (b) months after completion of the building . Roll call vote : Emery , yes ; McDowell, yes ; Waldron , yes ; Loveland, yes ; Hillyer, yes ; Mann , yes ; Banks, yes . With all in favor,- motion carried. It was noted that this must comply with the Fire Marshal report. T" 15, I9'1� City of Central Point request for employee parking lot , conditional use, Jackson County Assessor ' s Tax Account No. 37-2W-11BB, Tax Lots 4600 and 4700 , Alder and South 3rd Streets . Adm. Young said the City has purchased the property. It was noted that the proposed parking lot is in an R-3 zone and parking lots are not permitted in that zone. A public hearing date was set for July 20th at 7 : 30 P .M. Minor partition ordinance - The City Council directed the Staff to come up with an ordinance for minor partitions . A public hearing date was set for July 20th at 7 : 30 P .M . A study session date was set for July 6th at 7 : 30 P .M. Miscellaneous Matters Robbie Collins , Mt. Pitt Co . , M-2 zone , warehousing permitted use. Adm. Young said that Mr . Pitt wants the City to vacate Manzanita Street between Haskell and Amy for the purpose of splitting lots for individual storage warehouses . They would either sell or lease them. A public hearing date was set for July 20th at 7 : 30 P .M. Motion was made by Waldron, seconded by Mann to adjourn . N Lot survey required due to encroachment. 5 ' variance on 2nd St . side . 10 ' variance on alley 5 ' variance on other sideyard (c) Written agreement with property-owner to the east for drainage from roof overhang . (d) Ord. #1068 - Study session and conditions to be set for later date. (e) Staff recommend approval if neighborhood property- owners signatures are presented. IV . Conditional Use Permit - 145 S. (b Staff recommends fence setback minimum 4 feet with plantings against fence , providing 2 foot strip unim- proved walkway . (c ) Require encroachment for concrete driveway on Front St . through Oregon Highway Division . (d) Aesthetic review.
