HomeMy WebLinkAboutNovember 6, 1979 Planning Commission Meeting City Hall Council Chambers November 6, 1979 Meeting called to order by Chairman McManama at 7:30 P.M. Roll call found the following present: DeArmond, Hillyer, Misik, Nordby, Thelen and McManama. Absent were Members Hamer, McPherson and Sorensen. Others present were City Admin. Dave Kucera, Bldg. Department personnel R. J. Ritchey and Georg Stotler- deRuyter, and Secretary Stamper. Motion by Hillyer, second by Nordby to approve the Minutes of the October 16th Meeting. Carried with all in favor. Correspondence - None Old Business A. Meadows Mobile Home Park Recreation Building Landscape Review was presented by Builder/Developer Stan Harris for property at J.C. map 37 2W 11A Tax Lots 1101 and 200. Landscape diagram showing positions of plants, varieties and heights of the 500 kinds of trees, bushes, shrubs idigenous to our area with 4 and 5 alternatives to be used and the availability of 20-gallon size trees in the front area of each space with dwarf fruit or flowering trees in the rear of each lot. Specifications call for the Recreation Building to have seasonal color in their plantings to be a consideration. Mr. Harris requested the Planning Commission consider the following: 1. a 5-foot brick wall fence instead of a 6-foot fence be allowed around swimming pool area; better viewing to the outside toward the hills; 2. 18-inch planter strip outside the brick wall area at south end of pool; 3. Mature trees on west side of Rec. building will be planted with species that can be pruned or trimmed to conform to the aesthetic lines- of the building; Rhododendrons, holly, Yew, evergreens. Motion by Misik to approve the Landscape Plans as submitted and incorporate chanties requested. Motion seconded by Hillyer. . Carried with all in favor. New Business Suburban Subdivision Preliminary Plat Review for J.C. map 37 2{Y 11A for Tax Lots 1600, 1601, 1602, and 1603 at 882 Hopkins Road; applicant Carol Alleman. Representative Bob Blanton of Blanton Engineering was in audience with Mr. Alle- man. Staff report presented by R. J. Ritchey containing items 1 through 15. Item 2 referring to future roads and road extensions into The Village Subdivision was questioned by Engr. Blanton as he understood the project is now inactive! Item 3 referring to easements to City for all storm sewer, sanitary sewer and water lines through adjacent properties...as the Village is now "static" these lines will have to be continued and/or problems worked out! Mr. Blanton explained his collection and storm sewer drainage project from T. Halot' s 30" line across Hopkins Road which connects and continues on out to north edge of The Village property and the east edge of The Meadows. Item 5 - Install 100' radius at northwest cul-de-sac. Item 7 - To coordinate with John Jenson; will work with The Village for street improvements converning intersection at Hopkins and Bursell Roads; willing to -work with The Village for improvements to street to City-County standards on a pay-back-cost-plan to owners. Item 9 - Bike paths; will invite "no parking" on north side of street (Hopkins) for vehicular traffic to allow bicycle traffic only. Planning Commission Meeting November 60 1979 - page 2 New Business (continued): Suburban Subdivision-- Items 10 thru 14 - Agreed upon outright per Mr. Blanton. (see report in file) Mr. Ritchey introduced George Stotler-deRuyter of his staff who presented a Solar Energy design study and Senate Bill 299. Mr. Stotler-deRuyter stated our area was best location in Pacific Northwest for solar energy design; City of Central Point can be in a position to insure solar design at a local level and designating limitations through the Building Department and Plan- ning Commission efforts; City was in a history-making position for the acceptance of our Comprehensive Plan in the State; Goal 13 of L.C.D.C. Goals and Guidelines states the Planning Commission has the obligation to provide for future access to the sun to its citizens whether single-family dwellings or multiple family planned units. This can be done by placement in a staggered pattern of the housing to be built on the lot space available and feels the City should start with the Suburban Subdivision of 59 lots in the R-3 zoned area! Materials on solar development are available and could be incorporated into P.U.Ds stated'Mr. Stotler-deRuyter. Mr. Blanton addressed the Planning Commission stating he felt that as of this day and date it would be simply a matter of 'cart-before-the-horse' to think about rearranging lots and subdivision plans... that the City should adopt ordinances with rules and regulations for solar placement prior to issuance of building permit level! Discussion. Mr. Ritchey responded and stated he feels the City has adequate vehicle in ' the Ordinance 1068 Review process and could include solar energy directives, and read Ord. 16.12.030 concerning design standards (Mun. Code book page 201). More discussion followed. Mr. Stan Harris voiced certain objections and reservations concerning the proposed Suburban Subdivision; 1. Inadequate storm drain system; 2. High density zoning not high density area; 3. No existing easement at present has been given (Suburban Staff Report item 3); drain system would run under- neath an existing house! Mr. Harris stated Senate Bill 299 is lawful and valid and the Planning Commission should table The Suburban Subdivision until time for all entities has been granted to sit down and solve all problems! From the audience a Mr. John Hansen spoke; identified himself as a Medford attorney but also the City Attorney for the City of. Rogue River and stated the "Commonwealth Properties Against Wasbington County" as criteria...The Planning Commission should use the City ordinances as they presently exist now! City Administrator Kucera recommend the Commission consult City Attorney Carter and list directives to him that they feel are pertinent. More discussion. Items--gone-over from staff report are storm drainage, storm drainage system under Freeway, fair-share pay-back-plan for drainage costs; sewerage/storm drainage study completed but not published, future development of what we know now as farm areas to be considered as possible developments in the future ' and the storm drainage run-off potential that may be involved, and the neces- sity for an additional or second Freeway undercrossing to handle this addi- tional storm runoff. Mr. Blanton stated his client would be willing to fair Planning Commission Meeting November 69 1979 - page 3 New Business (continued): Suburban Subdivision- share its costs now, if determined necessary. More discussion. Motion by Thelen with second by Misik that the Suburban Subdivision storm drainage run- off be scheduled to a study session on November 13th at 7:30 P.M. here in the Council Chambers. Motion carried with all in favor. All parties present tonight are invited to partake of the study session. More discussion on Senate Bill 299...Requirements for solar development plans could be incorporated into the Plan Review process! 10 minutes recess called by Chairman McManama. After reconvening, the next item of business was a 1068 Plan Review for a proposed warehouse and office addition at 820 South Front Street; applicant Gary Whittle of Whittle Construction and Valley Doors, Inc. Presentation by Mr. Whittle of 3150 Crater Lake Ave.,-Medford, informed Commissionmembers that ' .building,, to be built, . 120 X 60 with _. building to contain a 2-story office facility for their own interest. The second warehouse structure will have 60 feet of separate space to be used as a rental. Staff report presented by Bldg. Offical Ritchey; State Fire Marshall's report has been received; must conform to the Uniform Building Code, et. and the Fire Department recommends 2 fire hydrants for this project; 1 placed at each driveway opening. Staff report containing items 1 through 8 were discussed by Members as well as a.c. blacktop requirement for the parking area. Mr. Whittle indicated that the en- 0 tire surface would be blacktopped and a planter area and parking spaces allocated in front of the retail store. Motion by Nordby to approve the 1068 Review Plan for Whittle's proposed warehouse at 820 South Front Street subject to Staff Report and placement of Fire Hydrant requirement to State standards. Motion seconded by Misik. By roll call all voting in favor, and carried. Mr. Mike LaNier of RCS Management was present representing Mr. Wayne Van Wey for property located at 37 2W 2CB on Lot 6 of Block 5 of PatLison Addition at 823 Laurel Street for construction of proposed 4-plex by "Van Wey & Schleining Homes" as applicants. Staff report prepared by Bldg. Official Ritchey items 1 through 12. Mr. LaNier found no fault with the report. Discussion on parking availability, irrigation system for watering and the landscape plan. Question on the 1068 Review if landscape plan is a portion of the review process? Read from the Municipal Code Book Section 17.72 page 266-10 into the record. Dis- cussion. Motion by Misk to approve the 1068 subject to staff report. No second forthcoming, the motion died. Motion by Nordby to deny the 1068 Review because of parking arrangment in front of the proposed structure is not aesthetically pleasing. Second given by Thelen. By roll call vote..."Yes" by Hillyer, Misik, Nordby, Thelen plus McManama to Deny the 1068 Review. "No" by DeArmond. The majority carried to Deny the 1068 Plan Review on the proposed 4-plex to be constructed at 823 Laurel Street based on par arrangements. Miscellaneous Matters Building Official Ritchey reported on the field trip that had occurred on Saturday, November 3rd; letters mailed to School Supt. Office and the bus driver thanking them for the services provided. Planning Commission Meeting November 6, 1979 - page 4 - Miscellaneous matters (continued) Member Hillyer questioned the interpretation of wording in the Code book concerning "variances". Discussion on "extra-ordinary" or unusal circum- stances and the reasonable use of enjoyment of property. Also discussed was "through lots". City Administration Kucera offered the following for consideration: 1. Fence variances does not require "extra-ordinary" terminology. 2. "Extra-ordinary" does not apply to adjacent properties. 3. 2 Public Hearings? Applicant has chance to polish story to modify to what he believes the Council will expect to hear! (Discussion centered on aftermath of John Leventin Appeal recently before the City Council.) 4. Consider the ordinances in the book are fine; and enactment of ordinance is something else! There is a certain education process; will provide uni= formity to both Planning Commission and City Council when the uniform hear- ings procedural ordinance is in effect. ,Both bodies will benefit. 5.. Upon appeal - A designated representative should-make report to Council from the Planning Commission level at- the time of hearing which allows a decision from the Council based on the facts presented; to provide necessary backup needed. Thanks extended to Georg Stotler-deRuyter for his solar presentation. Secretary reported on the illness of Don Banks who was now in Rogue Valley Hospital on the critical list. ' No further business, a motion was made by DeArmond with second by Misik for adjournment. All in favor, carried. Meeting adjourned at 10:50 P.M.
