Members present were Chairman Ben McManama, Dave DeArmond, Paul Emery, Jean
Hillyer, Earl Nordby and Rich Thelen as well as Mayor Del- Curry and City
Administrator Dave I{ucera.
Mayor Curry outlined the proposed Uniform Hearings Procedure ordinance.
Discussion ensued on quasi-judicial procedure which is a form of conducting
a meeting not a type of government body.
The Benefits of the proposed ordinance would be uniformity of procedures,
less cost of processing applications, less time in the review process, and
more information being provided to the Planning Commission.
Question was raised about the necessity to hold a public hearing before the
Planning Commission due to the quasi-judicial procedure. It was pointed
out that this procedure does not require proponents nor opponents to be
present- only that an opportunity be provided for them to speak. This can
be accomplished through a public meeting, not a public hearing, which is
advertised in the public meeting section of the newspaper. This public
meeting process will allow the Planning Commission to develop an atmosphere
necessary to make a sound technical planning decision based on the facts
and findings offered for their consideration. '
The resulting workload on the Council was addressed and it was pointed out
that the Council would be establishing a time limit on the presentation to
them, and since most Planning issues end up before the Council anyway,.
under our present systems- either due to appeals or via Council decision
review, the time limit coupled with a factual Planning Commission report
may serve to shorten the time before Council.
Training for the Planning Commission was discussed. Jean Hiilyer said she
could get Dick Eulian, a graduate Planner, to speak before the Planning
Commission regarding procedures and findings.
