HomeMy WebLinkAboutAugust 7, 1979 Planning Commission Meeting City Hall Council Chambers August 7, 1979 Meeting called to order by Chairman McManama at 7:30 P.M. Roll call found members DeArmond, Emery, Hillyer, Nordby, Sorensen and Thelen present. Absent were Hansen and Waldron. Also present were Bldg. Department representative John Allan and Secretary Stamper. In the audience were Mayor Del Curry and Councilman Ward IV Greg Dippel as well as other interested citizens present. Minutes of the July 17, 1979 meeting were approved in motion by Emery, second by Hillyer and approved by all. Correspondence and Public Appearances Mayor Del Curry, 103 Corcoran Lane, C.P. presented a draft of Uniform Hearings Procedure to Commission members. Outline items 1 through 6 and Benefit items 1 through 4 were read into record. Discussion. Motion by Hillyer to schedule this matter to a joint study session with City Council on August 16th at 7:30 P.M. Second given by Nordby and carried with all members voting "aye". More discussion. Item of Correspondence was in the form of a notice for the Citizens Action Committee of their nest meeting set for August 15th at Scenic Jr. High School for consideration to remove gravel. north of Kirtland Road by State Highway Dept. and a change in zoning request for veterinary clinic at Table Rock and Gibbon Roads. ?member Emery stated the removal of gravel at that site had been going on for 20-30- years and the use should continue. Correspondence was also received in the form of a letter from J.C. Planning and Development Department to consider amendment to City of Medford's Comp. Plan to include area on Table Rock Road intersection whith Vilas Road, east side; as well as voting membership requirement of Planning Advisory Committee. Meet- ings to be held Sept. 6th and Aug. 16th, respectively. (Commission members to discuss this item after the regular business of the agenda is completed.) Public appearance agenda item - John Laventin, 588 North Fifth Street, C.P. addressed Commission stating he was a private contractor and desires a variance of 6' to build a garage on his property; house had been constructed within the 20' setbackA_Maaexa_81}ale-ee23dg#e eA. Questions asked of Bldg. Official Allan who prsented a sketch as Mr. Laventin had not formally applied for a variance nor building permit through the Department. Motion by Nordby to take no action on Mr. Laventin's request at this time. Motion seconded by DeArmond and roll call found all in favor but Sorensen who abstained. Motion carried. Mr. Laventin was counselled to work through the Building Department rules and requirements. No Old Business presented. New Business First order of new business was the scheduled Public Hearing to Amend Zoning Ordinance Section 17;20.030 adding Paragraph G; Early Childhood Education Schools in the R-1 Zone as a Conditional Use referred to the Commission by the City Council via their Resolution #295 dated June 28, 1979. Definition as follows: Early Childhood Education Schools (parochial and public). Refers to Planning Commission Meeting August 7, 1979 - page 2 New Business (continued) programs planned for 3 and 4 year-olds. These schools operate during the school term generally with half-day sessions for 2, 3 or 5 days per week. Planned programs include readiness skills in reading, math and social re- lationships; an educational readiness service and not a baby-sitting or day care center." Presentation made by Councilman Greg Dippel, 1931 Park- wood Avenue, C.P. gave brief history of the need; oversight in not includ- ing this use in our Ordinances. Fasano Findings prepared by City Admin. Kucera was read into record by Councilman Dippel. Questions asked by Members. Public Bearing portion was opened by Chairman McManama and Propon- ents were invited to speak. No one came forth. Next, Chairman McManama invited Opponents to speak. None came forth. The public portion of the hearing was closed. Discussion by Commissionmembers. Suggestion by Emery to add phrase to third sentence. . ."These schools operate during the school term generally but not limited to with half day sessions for 2, 3 or 5 days per week." Dippel in- formed all that requirements of Early Childhood Schools is determined at State level and covered under their code. Planning Commission members agreed the added phrase be placed within the definition. Motion by Nordby to accept the Staff Fasano findings as the Planning Commission Findings to change Ordinance 17.20.0300 adding item G to that portion of the Code and forward to the City Council. Motion was seconded by Emery. Discussion. Roll call ' vote: Emery- yes; Billyer- yes, "with reservations"; Nordby- yes, Sorensen- yes; Thelen- yes; and Chairman McManama- yes. Motion carried to add Early Childhood Schools to the Code and allow such use in the R-1 Zone as a Conditional Use. 1068 Plan Review for request by applicant Dr. Bruce Turner, a dentist at 57 North Second Street to construct professional offices located at 150 Man- zaniia Street in Block 11 of Original Town, J.C. map 37 2W 3DD, Tax Lot 9300 was next order of business. Dr. Turner stated he had lease with the Agri- cultural Stabilization and Conservation Services as tenants in the new bldg. Staff report prepared by Bldg. Official Ritchey was presented by John Allan. Dr. Turner said that the proposed easement indicated on plans_ is no longer valid as he is not considering partitioning the property via the Minor Parti- tion procedure; item #6 of the Report. Plans prepardd, by Architect Wayne Struble explained by applicant and allowance is planned for 22 parking spaces where only 15 are required by code. Plantings to be low-lying on corner of 'No. Second and Manzanita, landscaping within the 20' setback, sidewalks to be provided on Manzanita Street for a length of approx. 100' Motion by DeArmond to approve the 1068 Review and include sidewalks to be 110' more or less and extend beyond driveway opening on west side of property on Manzanita and as per Staff Report presented. Motion seconded by Sorensen. By roll call, all members voting to approve, carried. 1068 Plan Review for 4-plex Townhouse construction at 263, 265, 267 and 269 North Tenth Street by applicant Gary Yost, located on J.C. map 37 2W 2CB, Tax ' Lot 7304. Staff report prepared by Bldg. Official Ritchey presented by John Allan. From the audience a Mr. Norm Renner, 710 Widean St. , Jacksonville, identified himself and stated he was the partner in this request with Mr. Yost and appearing as required. Plans showed 8 parking spaces, second floor will have a 2' overhand from ground floor and building will have a "band" Planning Commission Meeting August 7, 1979 - page 3 New Business (continued) between stories. Exterior will be compatible to previously-built 4-plex by Mr. Yost on adjoining property, financing through the Central Point State Bank stated Mr. Renner. Motion by Emery to approve this 1068 for the 4-plex Town- houses with Staff recommendations of the Staff report. Motion seconded by Thelen. Roll call found all members voting in favor to approve the 1068 as recommended. Motion carried. Miscellaneous Matters Reference is made to item of Correspondence in letter from J.C. Planning and Development Dept. on page 1, 5th paragraph of these Minutes. Discussion on accompanying map with letter and City's adopted Comp Plan map. Emery made motion that due to conflict with the City's Comprehensive Plan Map that the Planning Commission go on record opposing the City of Medford's proposed amend- ment to their Land Use Map Case report #CP-79-9 concerning that area of land on Table Rock Road north and south of the Vilas Road intersection and that a letter be sent to be entered into the hearing Record at the meeting scheduled for September 6, 1979 at 7:30 P.M. in Medford City Hall Council Chambers. Motion was seconded by Nordby and approved by all in the "Aye." voice vote. Secretary is directed to prepare a letter for Planning Commission signatures. Member Hillyer,. bringing up the proposed Uniform Hearing Procedure document* as presented by Mayor Curry earlier this meeting, requested the Planning Commission have their own study session meeting prior to meeting with the City Council on August 16th. Discussion. Motion then made by Hillyer to set August 14th for Planning Commission Study session in Council Chambers at 7:30 P.M. to study the proposed Uniform Hearings Procedure. Motion received second by Nordby and carried with all in favor. Secretary will not be required to attend. No further business, Member Nordby made motion to adjourn. Second by Emery. All in favor and carried. Meeting adjourned at 9:32 P.M. *-included in these minutes, next page. 807,79 UNIFORM HEARINGS PROCEDURE OUTLINE FORM 1. All applications go to an applications clerk. Applications will be complete including proposed exhibits and findings of fact. 2. Applications will be staff-reviewed for completeness, compliance with ordinances and State Law, and the findings of fact will be reviewed to insure they are adequate. Technically unsuitable applications will be rejected by Staff. 3. Staff will prepare a staff report and will schedule a quasi-judicial planning commission review at which time the applicant will made a full and complete presentation of his project. 4. Planning Commission will need to adopt detailed findings of fact and prepare a report that addresses: a The desirability of the application. b The aesthetic qualities. (((c Technical compliance with our planning, goals, procedures and philosophies. d The City's ability to provide public services. e� Any related points. Planning Commission will also recommend to the Council: approval, approval with conditions, or denial with or without prejudice in their ' report. 5. A full evidentuary public hearing will be scheduled by Staff before the Council for all planning decisions which will include: a) Record of notice b Declaration of conflicts c Application description d Reading of the Planning Commission report. e Reading of the Staff Report, if it varies from Planning Commission report. f) Proponents presentation with a time limit. g Opponents presentation with a time limit. h Questions i Closure of hearing, deliberation and a decision, and adoption of findings. 6. An appeal and review process will be available before the Council. THE BENEFITS OF THIS PROCESS ARE AS FOLLOWS: 1. The Planning Commission will have more complete data and presentations before it to make their decision. 2. City only holds one public hearing where now we are almost always holding two complete evidentuary public hearings. 3. The Planning Commission can made a planning decision which is relatively free of political pressures. The Council can then use the Planning Commission recommendation with the understanding that it is based on good planning judgements. 8/07/79 UNIFORM BEARINGS PROCEDURE BENEFITS (continued) 4.
