HomeMy WebLinkAboutApril 17, 1979 Planning Commission Meeting City Hall Council Chambers April 17, 1979 Meeting- called to order by Chairman McManamn. Those present were Paul Emery, Jean Hillyer, Andy Loveland, Earl Nordby and Rich Thelen. Absent members were Norm Hansen, Sue Messmer and Bud Waldron. Also present were R. J. Ritchey and Secretary Spot Stamper. Minutes- of April 3rd meeting approved by Emery, second by Hillyer and carried with all members present voting in the affirmative. Correspondence: Chairman read letter from Sue Messmer dated April 5, 1979 tendering her resign- ation, effective immediately; the letter had been received and accepted by the Mayor and Council at their April 5th meeting. Old Business Remodelling project at 714 East Pine Street, owner Sid Jacob, and requirement of sidewalk construction and paved parking area from the Planning Commission's April 3rd meeting was first item on agenda. -No one appeared. Member Emery made motion to table this matter and re-submit it back before the Commission at a later date. Second by Nordby. All in favor, carried. New Business Minor partition request of property located at 34 North Front Street, J.C. map 37 2W 3DD, Tax Lot 9400; applicant Doug McKee. Report by Bldg. Official Ritchey ' that minor partition was made to the Jackson County Assessor's office and re- corded. The request has never been through the Planning Commission's minor partition process, and Mr. Ritchey would not issue a building permit until cer- tain things were clarified. Property involes parts of Tax Lots 1, 2 and 3 in Block 14 of Original Town and Lots 4 and 5 of Tax Lot 9400 in Block 14. Dis- cussion. Partitioning done in manner not shown on partitioned plat drawing. Per Ordinance 16.44.020 of the Code, requirement of minor partition request must come before the City. More discussion.`, Member Hillyer will investigate the partitioning done through the Assessor's Office and report back at a future Planning Commission meeting. Motion by Nordby to continue this matter to the May lst Planning Commission meeting in order to have Staff check out the legal lot particulars. Motion seconded by Emery. Roll call vote, all in favor and carried. Motion made by Emery, second by Thelen to delete the motion made above to table the Sid Jacob matter concerning 714 East Pine Street. All in favor and carried. Old Business brought back again - Applicant's representative appeared in the form of Attorney Jim Wilson who stated his client was in California; questioned the requirement by the Planning Commission that a sidewalk be required and all- weather paving on the parking lot, and his client will establish a precedent heretofore not required! Mr. Wilson felt the City ghould provide sidewalks thru the entire City and have everybody pay equally for this type improvement- not just his client. More Discussion. Motion by Nordby, second by Hillyer that the requirement of a sidewalk in this particular case will stand per the Bldg. ' Official 's recommendation. By roll call vote, all in favor with 1 abstention (Emery). The motion carried. Planning Commission Meeting City Hall Council Chambers April 17, 1979 - page 2 MiscellaneousMatters- Discussion regarding wheel chair ramps, sidewalks, new curbing cuts, etc. and what Building code requires. Motion by Finery that Planning Commission adopt a resolution and recommendation to the City Council that ordinance be passed re- quiring sidewalks be part of all new construction in all districts. Motion seconded by Nordby. - Exception- if street is unimproved, the requirement for sidewalk be waived until street improvements are made in all zones except the M=19 M-2 and LC-LI zones. More discussion. By roll call, all in favor but McManama who; voted "No". Motion carried. Bldg. Official Ritchey reported to all that new Zoning maps re available and have been updated to include annexations and subdivision platting. He is currently trying to review the Ordinances to update the City's schedule of fees as well as review for any ordinances that appear to be in conflict. Discussion on 1068 requirements. Recommendation that the Bldg. Official make determination of actual, requirements and not all matters come before the Plan- ning Commission; minor repairs, fences, sidewalks, garages, etc. More discussion. Member Nordby made motion to hold a study session to review the 1068 Ordinance on April 24th. Motion seconded by Emery. All in favor, the motion carried. No further business, motion by Thelen, second by Nordby to adjourn. All in favor. Carried unanimously. Meeting adjourned at 9:12 P.M. -
