Planning Commission Meeting

MEETING CALLED TO ORDER
Vice Chairman Chuck Piland called the meeting to order at 7:05 p.m.
ROLL CALL
Present were Vice Chairman Chuck Piland and Commissioners Reed Barlow, Ginger
Bitterling and Orrin Frederick. Absent were Commissioners Garth Ellard and
Jerry Mattey for employment reasons. Also present were Fire Chief/Building
Official Don Paul and secretaries Barbara Cochran and Maureen Tanhoff.
APPROVAL OF MINUTES
A Planning Commission meeting was not held in June due to lack of business.
Commissioner Frederick made a motion to approve the minutes of the May 6, 1986
Planning Commission meeting as presented. Commissioner Bitterling seconded the
motion. Roll call vote: Barlow, yes; Bitterling, yes; Frederick, yes. All of
the Commissioners voted in favor of the motion and the motion carried.
PUBLIC APPEARANCES AND CORRESPONDENCE
There were none at this meeting.
BUSINESS
The Meadows - Final Plat for a Planned Unit Development, 555 Freeman Road -
Pioneer Resources, Inc.
Building Official Paul gave a history of The Meadows and listed and explained
the following exhibits and cited changes in them since the preliminary plat
review: Exhibit A - Application for Approval of a Planned Unit Development;
Exhibit B - Bylaws; Exhibit C - Declaration; Exhibit D - Statement of Planned
Community Information Pursuant to ORS 94.750; Exhibit E - Statement of Declar-
ant's Interest Pursuant to ORS 94. 745; Exhibit F - Reserve Account Replacement
(applicant asked to include remaining life to determine if it was enough to
cover replacement) ; Exhibit G - Landscape and Drainage Guarantee Agreement
(second agreement put together by Far West Federal Bank, reviewed by the City
Attorney, signed by the Mayor and the Executive Vice President of Far West
Federal, to ensure that required improvements will take place with the Elk
Creek drainage improvement to begin after July 15, 1986 to be completed no
later than December 31, 1986) ; Exhibit H - The Meadows Site Plan and Phasing
Plan Sheets 1-22; Exhibit I - The Meadows Recreational Vehicle Storage/Park-
ing; Exhibit J - The Meadows Proposed Outdoor Rec Area; Exhibit K - The Meadows
Proposed Rec Yard Area; Exhibit L - The Meadows Landscape Irrigation and Path
Systems; and Exhibit M - The Meadows, A Planned Unit Development Subdivision

expressed at the time of the preliminary plat review had been satisfied. The
Commission reviewed the exhibits. Jim Bennett and Neil Scheuneman of Pioneer
Resources, Inc. , were present.
Commissioner Bitterling made a motion to accept the final plat for The Meadows,
a Planned Unit Development, at 555 Freeman Road, Central Point, as submitted by
Pioneer Resources, Inc. , and to allow signing of the plat by Vice Chairman
Piland. Commissioner Barlow seconded the motion. Roll call vote: . Barlow,
yes; Bitterling, yes; Frederick, yes. All of the Commissioners voted in favor
of the motion and the motion carried.
A recess was called at 7:30 p.m. for the signing of the final plat. The meet-
ing was called back to order at 7:35 p.m.
Public hearing to review an application for zone change of property located in
the 4500 block of Rogue Valley Highway further described as 37 2W 3B, Tax Lot
1501, submitted by Ray Davidson
Building Official Paul read his staff report dated June 27, 1986 and listed the
following exhibits for the record: Exhibit A - Notice of Public Hearing; Exhi-
bit B - Certificate of Posting of Notice of Public Hearing; Exhibit C - Appli-
cation for Amendment to Zoning Map; Exhibit D - Applicant's findings, map and
legal description; Exhibit E - Assessor's map page; and Exhibit F - aerial map
page. The Planning Commissioners also received copies of a letter dated June
27, 1986 to the City from Federal Intermediate Credit Bank stating that sale of
the property to Mr. Davidson is contingent upon obtaining M-1 zoning. Staff
did not have any negative comments regarding the application.
There were no conflicts of interest expressed by the Commissioners and Vice
Chairman Piland opened the public hearing.
Mr. Ray Davidson, 2798 Eric Avenue, Central Point, came forward. He stated
that he plans to clean the area up and eventually pour a concrete slab to erect
a 50' x 50' shop building for the work he does as a welder and a machinist.
Commissioner Frederick asked that Mr. Davidson check into the flood plane regu-
lations for that area, and also asked if he thought the electrical substation
would be a problem located close by. Mr. Davidson stated that he had no pro-
blem with the substation. Commissioner Frederick asked if the parcel is large
enough for Mr. Davidson's needs. He stated that it is not as large as he would
like, but it is adequate and there is plenty of room for parking. Mr. Davidson
stated that he feels his proposal for the property will be a welcome addition
to the City and he would keep it looking nice.
No one else came forward to speak in favor of or against the application. Vice
Chairman Piland closed the public hearing.

Commissioner Frederick stated that he agrees with the findings of staff and
that his only concern is that Mr. Davidson's activities on the property not
interfere with Crater High School which is nearby.
Commissioner Frederick made a motion to pass Resolution No. 15, A Resolution of
Recommendation to Approve a Zone Change from R-2 to M-1, for property located
in the 4500 block of Rogue Valley Highway, Central Point, as requested by Ray
Davidson. Commisioner Bitterling seconded the motion. Roll call vote:
Barlow, yes; Bitterling, yes; Frederick, yes. All of the Commissioners voted
in favor of the motion and the motion carried.
Public hearing to review an application for a minor land partition from Jackson
County Parks Department for property located between Interstate 5 and Bear
Creek described by Jackson County Assessor's Map Page 37 2W 12B, Tax Lot 500
Building Official Paul read his staff report dated June 27, 1986 and listed the
following exhibits for the records: Exhibit A - Notice of Public Hearing;
Exhibit B - Certificate of Posting of Notice of Public Hearing; Exhibit C -
Application for Minor Land Partition; Exhibit D - Applicant's letter of re-
quest; Exhibit E - legal description; and Exhibit F - Assessor's map page. Mr.
Paul also read a memorandum dated July 1, 1986 from Ron Hough, Senior Planner
with Rogue Valley Council of Governments, recommending approval of the minor
land partition application so that the property can become part of the Bear
Creek Greenway. Mr. Paul explained that the $100 minor land partition applica-
tion fee will be paid out of the $5,000 designated by the City for Greenway
land acquisition with the balance being donated to purchase the land to be
designated as part of the Greenway.
No conflicts of interest were expressed by the Commissioners and Vice Chairman
Piland opened the public hearing. No one was present to speak in favor of or
against the application. Vice Chairman Piland closed the public hearing.
Commissioner Bitterling made a motion to pass Resolution No. 116, A Resolution
of Recommendation of Approval to Grant a Minor Partition of Land, for property
located between Interstate 5 and Bear Creek, Central Point, described by
Jackson County Assessor's Map Page 37 2W 12B, Tax Lot 500, and submitted by
Jackson County Parks Department. Commissioner Barlow seconded the motion.
Roll call vote: Barlow, yes; Bitterling, yes; Piland, yes. All of the Commis-
sioners voted in favor of the motion and the motion carried.

Jeanette Pigott for property lcoated at 1734 Beall Lane further described as
Jackson County Tax Assessor's Map Page 37 2W 10DA, Tax Lot 1200

Application for Minor Land Partition; Exhibit D - applicant's map; Exhibit E -
legal description (to be submitted at a later time) ; .Exhibit F - Assessor's map
page; and Exhibit G - aerial map page. He also distributed a larger map of the
proposed partition. Mr. Paul explained that the legal description is not
ready at this time and suggested that if recommendation of approval of the par-
tition is made by the Planning Commission, it be subject to the requirement
that the legal description be submitted to staff prior the City Council meeting.
There were no conflicts of interest expressed by the Commissioners and Vice
Chairman Piland opened the public hearing.
Don Pigott, 161 Gibbon Road, Central Point, came forward. He stated that they
have been looking for a piece of property like this one to build their home.
They have made an offer to purchase the new lot subject to approval of the
partition and have deposited earnest money. Vice Chairman Piland asked about
the garage that would be located quite close to a property line should the
partition be approved. Commissioner Frederick asked if Mr. Pigott understood
the deferred agreement condition of approval requiring that future property '
owners participate in local improvement districts involving the property. Mr.
Pigott explained that the present owner of the property, Mrs. Jantzer, does not
feel the garage will have to be moved because it has been there so long, and he
would like something in writing from the City stating that it will. He stated
that the building is quite small and he could move it with a forklift. Mr.
Pigott also stated that he understands the deferred agreement stipulation.
No one else came forward to speak in favor of or against the minor land parti-
tion application. Vice Chairman Piland closed the public hearing.
Commissioner Frederick made a motion to pass Resolution No. 117, A Resolution
of Recommendation of Approval to Grant a Minor Partition of Land, for property
located at 1734 Beall Lane, Central Point, also known as Jackson County Tax
Assessor's Map Page 37 2W IODA, Tax Lot 1200, as requested by Don and Jeanette
Pigott with the conditions that the applicants furnish the proper legal des-
criptions prior to presentation of the application to the City Council, and
that the setback limitations for all structures be observed. Commissioner
Bitterling seconded the motion. Roll call vote: Barlow, yes; Bitterling, yes;
Frederick, yes. All of the Commissioners voted in favor of the motion and the
motion carried.
ADJOURNMENT
Commissioner Bitterling made a motion to adjourn the meeting. Commissioner
Frederick seconded the motion. Roll call vote: Barlow, yes; Bitterling, yes;
Frederick, yes. All of the Commissioners voted in favor of the motion and the
motion carried.
Vice Chairman Piland adjourned the meeting at 8:15 p.m.
