HomeMy WebLinkAboutSeptember 3, 1985 City of Central Point Planning Commission Meeting September 3, 1985 - 7:00 p.m. Page 1 MEETING CALLED TO ORDER Vice Chairman Garth Ellard called the meeting to order at 7:00 p.m. ROLL CALL Present were Vice Chairman Garth Ellard and Commissioners Reed Barlow, Ginger Bitterling and Charles Piland. Absent were Chairman Orrin Frederick and Com- missioner Jerry Mattey. Also present were Councilmember Donna Higginbotham, Fire Chief/Building Official Don Paul and Secretary Maureen Tanhoff. APPROVAL OF THE MINUTES Commissioner Piland made a motion to approve the minutes of the August 6, 1985 Planning Commission meeting as presented. Commissioner Barlow seconded the motion. Roll call vote: Barlow, yes; Bitterling, yes; Ellard, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. PUBLIC APPEARANCES AND CORRESPONDENCE 1 There were none at this meeting. BUSINESS Public Hearing to review an application for a minor land partition by Samuel P. and Sharon E Fagone for land located at 1922 Scenic Avenue further described as Jackson County Assessor's Map Page 37 2W 3AB, Tax Lot 4200 Building Official Paul summarized his staff report dated August 26, 1985 and listed the following exhibits: Exhibit A - Application for Minor Land Parti- tion; Exhibit B - Notice of Public Hearing; Exhibit C - Certificate of Posting of Notice of Public Hearing; Exhibit D - Partitioner's map; Exhibit E - Legal descriptions; Exhibit F - Assessor's map page; and Exhibit G - Aerial map page. Mr. Paul stated that the access will be the required 20-foot width. Vice Chairman Ellard opened the public hearing. There were no conflicts of interest expressed by the Commissioners. Samuel P. Fagone, 1922 Scenic Avenue, Central Point, came forward. He stated that the property is currently for sale as one large parcel. He feels it will be more salable partitioned. No one else came forward to speak in favor of or against the application. Vice Chairman Ellard closed the public hearing. It will be a building permit requirement that it have a draining, hard surface. Commissioner Piland made a motion to pass Resolution No. 102, A Resolution of Recommendation of Approval to Grant a Minor Partition of Land, for Samuel P. and Sharon E. Fagone at 1922 Scenic Avenue, Central Point. Commissioner Bitterling seconded the motion. Roll call vote: Barlow, yes; Bitterling, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. Building Official Paul informed the Fagones that the City Council will consider the application at a public hearing September 19, 1985. Public Hearing to consider an application requesting an amendment to the zoning ordinance to allow temporary placement of mobile homes on single lots in resi- dential zones for the purpose of providing full-time care of the infirm, and to consider the adoption of suitable criteria and guidelines related to such a use Building Official Paul gave a history on the issue which began in November of 1982. He summarized his staff report dated August 28, 1985 and listed the fol- lowing exhibits: Exhibit A - Application for Amendment to Zoning Ordinance; Exhibit B - Notice of Public Hearing; Exhibit C - Certificate of Posting of Notice of Public Hearing; Exhibit D - Criteria for Temporary Mobile Homes for Infirm Citizens; Exhibit E - Talent ordinance; and Exhibit F - Jackson County ordinance. Mr. Paul stated that staff considered also including motor homes, but Jackson County staff stated that they regretted allowing them as it is dif- ficult to control their placement. Mr. Paul explained that only mobile homes registered with the Motor Vehicle Division with X-plates are considered mobile homes officially. Staff recommends that if approved, this use be listed as a conditional use in residential zones. Mr. Paul explained the proposed Criteria for Temporary Mobile Homes for Infirm Citizens. He also distributed a memoran- dum on the issue dated September 3, 1985 from Ron Hough, Rogue Valley Council of Governments planner. Vice Chairman Ellard asked about the City fees that would be involved to some- one wanting to place a mobile home in this manner. Mr. Paul explained that the cost would be that of a conditional use permit application ($100.00) and the normal mobile home set-up fee ($30 to $40) in addition to the State plumbing fee (about $20) . Vice Chairman Ellard expressed concern that some of the applicants could be hardship cases and perhaps it should be considered that the fee be lower. Mr. Paul explained that City ordinance states that the fee should be uniform, but changing that could be investigated. Vice Chairman Ellard opened the public hearing. There were no conflicts of interest expressed by the Commissioners. City of Central Point Planning Commission Meeting September 3, 1985 - 7:00 p.m. Page 3 Margaret Wahl, 3328 Snowy Butte Lane, Central Point, came forward. She stated that she has applied for this amendment to the zoning ordinance because she would like to move a mobile home onto her property on Snowy Butte Lane so that her mother can live close enough for Mrs. Wahl to take care of her. Mrs. Wahl stated that her mother has a bad heart and possibly Alzheimer's disease. Vice Chairman Ellard asked Mrs. Wahl if her property was large enough to meet the requirements of the proposed Criteria for Temporary Mobile Homes for Infirm Citizens. Mrs. Wahl stated that her property consists of 1. 13 acres, which is large enough to meet the requirements. Mrs. Wahl stated that they plan to purchase a new 14' x 40' mobile home for her mother. Commissioner Piland asked if it would be. feasible for the mother to live with the Wahls in their home. Mrs. Wahl explained that it is not a viable alterna- tive mainly because the house is not large enough. Commissioner Bitterling asked if Mrs. Wahl would have any problem with the time requirement to move the mobile home when her mother no longer lives there. , Mrs. Wahl stated that she did not anticipate any difficulty should that happen. There was no one else present to speak in favor of or against the application. Vice Chairman Frederick closed the public hearing. Commissioner Piland asked if Item C in Section 2 requires that the water and sewer systems be connected prior to occupancy. Mr. Paul stated that they must be connected before the permit is signed off. He also stated that the mobile home does not have to have its own lines to the street but can tie in to the house service line on the property. Commissioner Piland asked if the minimum width requirement in Item I of Section 2 was determined by the setback require- ments. Mr. Paul stated that he called some mobile home parks to get an idea as to the normal size of a mobile home. The main concern was that the mobile home be modern. Vice Chairman Ellard stated that the mobile homes should be required to have skirting. Building Official Paul agreed that skirting should be required in the Criteria. Discussion followed regarding the renewal process which will allow the City to review each case to be aware of changing conditions. Review would take place at renewal by the planning staff involving the Planning Commission only when staff deems it necessary. It was agreed that the Criteria for Temporary Mobile Homes for Infirm Citizens be referred to in the resolution of recommendation and that skirting be a requirement listed in the Criteria. City of Central Point Planning Commission Meeting September 3, 1985 - 7:00 p.m. Page 4 Commissioner Piland made a motion to approve Resolution No. 103, A Resolution Recommending an Amendment to the Text of the Zoning Ordinance to Authorize the Temporary Placement of Mobile Homes on Single Lots for the Purpose of Providing Full-Time Care of the Infirm as a Conditional Use in Residential Zones, subject to the Criteria for Temporary Mobile Home for Infirm Citizens with the require- ment for skirting added. Commissioner Bitterling seconded the motion. Roll call vote: Barlow, yes; Bitterling, yes; Piland, yes. All of the Commis- sioners voted in favor of the motion and the motion carried. Vice Chairman Ellard stated that the matter would be reviewed by the City Coun- cil on September 19, 1985. MISCELLANEOUS There were no miscellaneous matters at this meeting. ADJOURNMENT Commissioner Bitterling made a motion to adjourn the meeting. Commissioner Piland seconded the motion. Roll call vote: Barlow, yes; Bitterling, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. Vice Chairman Ellard adjourned the meeting at 7:51 p.m.
