HomeMy WebLinkAboutJuly 2, 1985 City of Central Point Planning Commission Meeting July 2, 1985 - 7:00 p.m. Page 1 MEETING CALLED TO ORDER Chairman Frederick called the meeting to order at 7:04 p.m. ROLL CALL Present were Chairman Orrin Frederick and Planning Commissioners Reed Barlow, Garth Ellard and Charles Piland. Commissioner Bitterling was absent because she was working out of town and Commissioner Mattey was detained at work. Also present were Fire Chief/Building Official Don Paul and Secretary Maureen Tanhoff. APPROVAL OF THE MINUTES Commissioner Ellard made a motion to approve the minutes of the June 4, 1985 Planning Commission meeting as presented. Commissioner Barlow seconded the motion. Roll call vote: Barlow, yes; Ellard, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. ' CORRESPONDENCE AND PUBLIC APPEARANCES There were none at this meeting. BUSINESS Public Hearing to consider an application for annexation of approximately 189 acres generally bounded by Beall Lane Bursell Road, Hopkins Road, and Inter- state X15 further described as within Jackson County Tax Assessor's Map Pages 37 2W 11A, 11D, 12B, and 12C. Building Official Paul read his staff report dated June 27, 1985 and listed the following exhibits for the record: Exhibit A - Petition for Annexation; Exhi- bit B - Plat map; Exhibit C - Notice of Public Hearing; Exhibit D - Certificate of Posting of Notice of Public Hearing; Exhibit E - Ordinance of Intent to Annex; and Exhibit F - Citizens Advisory Committee meeting minutes of June 25, 1985 with motion recommending approval. He also explained the two map exhibits on the board showing the area proposed to be annexed. There were no conflicts of interest expressed by the Commissioners regarding the annexation request. Chairman Frederick opened the public hearing. Zig Zeigler, 805 Beverly Way, Jacksonville, came forward. He stated that he is ' the applicant and represents those in favor of the annexation. Mr. Zeigler gave a background on what led him to apply for the annexation of two parcels of property in the area that he owns on Pittview Avenue. He informed the Commis- sion that he works in a small factory in Central Point and has been in the real City of Central Point Planning Commission Meeting July 2,1985 - 7:00 p.m. Page 2 estate business. Mr. Zeigler stated that he circulated the petition in the neighborhood of the annexation request. Charles Olson, 3358 Bursell Road, Central Point, came forward. He stated that he owns the nursery and other property on Bursell Road and is against the annexation. He would like to know what the total cost will be to the property owners. Chairman Frederick stated that the amounts are unavailable at this time. Mr. Paul stated that staff is attempting to obtain this information from Bear Creek Valley Sanitary Authority. The only information that could be pro- vided now would be based on the last annexation and the City still has not received the bill from BCVSA on that one. Mr. Paul also stated that in regard to the cost of a water line, it is the decision of the property owners whether they want improvements or not and he explained the procedure. Mr. Olson asked if the monthly sewer rate would increase if the annexation takes place. Mr. Paul stated that it should not. Mr. Olson asked what the City rate is at this time. Mr. Paul stated that it is approximately $7. 75 a month for sewer ser- vice. Mr. Olson stated that currently the water rate is twice the rate that the City of Medford charges and asked if that would change. Mr. Paul answered ' that the annexed properties would pay the normal rate like anyone else in town. Jack Beall, 3344 Bursell Road, Central Point, came forward. He questioned the accuracy of the map on the board in that his property is shown as in favor of the annexation when he is not and did not sign the petition. Mr. Paul stated that this was an error. Mr. Beall stated that the City should send out letters to all of the property owners in the area providing more information on the annexation and the costs involved. Mike Sowell, 3363 Marilee, Central Point, came forward. He stated that he thinks a lot of the people who have signed the petition for the annexation do not realize the costs that will be involved. He stated that the people should be better informed by the City. Mr. Sowell also stated that he is against high density development in the area. John Metz, 566 Beall Lane, Central Point, came forward. He stated that he signed the petition because he thought the majority of the property owners were in favor of the annexation. He stated he would like to withdraw his signature until more information is provided. Frank Knox, 3392 Bursell Road, Central Point, came forward. He asked when the petition was circulated and why he was not notified. He also asked what the annexation would provide besides an increase in taxes. Mr. Paul explained what takes place upon annexation in regard to City services provided. Robert Johnson, 654 Beall Lane, Central Point, came forward. He questioned the accuracy of the map and stated that he wanted specific cost figures. Edwin Blackmarr, 1549 Lenora, Medford, came forward. He owns 12 acres in the area of Merriman and Beall. He is in favor of the annexation and does not feel it would over extend anything that has not already been instituted for the area as far as zoning is concerned. He feels the annexation would attract people to the area and cause it to prosper. Iris Charley, 5877 Upton Road, Central Point, came forward. She owns property in the area and has had it for sale for ten years. Mrs. Charley feels that unannexed, the property is "no man's land" and is in favor of the annexation. Mrs. Charley said the area has outgrown its country status and it is time to progress. George Gilman, 452 Beall Lane, Central Point, came forward. He stated that he used to be opposed to annexation but now feels the area has the potential for some nice development if all the properties are annexed at once. Mr. Zeigler stated that he understands why some people are against the annexa- tion and emphasized that it was not his or the City's intention to force others into annexation. Mr. Olson asked if the City could provide a dollar amount for sewer develop- ment per running foot in front of the properties. Chairman Frederick asked Mr. Paul if he could provide some estimated assessments based on the Boes Subdivi- sion LID. Mr. Paul stated that the Boes Subdivision LID assessments were based on $10. 50 per linear foot basic cost for 8" pipe. Ron McAvin, 3458 Bursell Road, Central Point, came forward representing Geneva Hitt. He asked if the water line down Beall Lane would be improved if the annexation takes place and the sewer line replaced. Mr. Paul stated that they would not. Mr. McAvin asked that it go on record that he is against the annex- ation and stated that more information should be provided. Mr. Paul stated that he has spoken to Mrs. Hitt on two occasions. Mr. Olson asked approximately what the engineering costs will be to provide sewer service. Mr. Paul stated that a sewer line already exists that would be used. Chairman Frederick stated that it would be approximately $14.00 per linear foot for a sewer line based on his engineering experience. Mr. McAvin asked if all the properties would have to be surveyed upon annexa- tion. Chairman Frederick stated that they would not, that only the boundary of ' the entire annexation would be surveyed. No one else came forward to speak in favor of or against the annexation and Chairman Frederick closed the public hearing. City of Central Point Planning Commission Meeting July 2,1985 - 7:00 p.m. Page 4 Chairman Frederick called a recess at 8: 14 p.m. The meeting was called back to order at 8:21 p.m. Commissioner Ellard asked Mr. Paul if the percentage of those in favor of the annexation was calculated based on the number of signatures on the petition. Mr. Paul stated that it was and not calculated according to the map. Commis- sioner Ellard informed the people present that any development in the area would be slow. Commissioner Piland asked Mr. Paul which properties are already receiving City water service. Mr. Paul stated approximately two properties on Beall Lane and three on Bursell are the only ones receiving City water. Chairman Frederick provided a background on that water line. A discussion followed on where water service would be provided from. Commissioner Piland asked if the school district boundaries would be affected by the annexation. Mr. Paul stated that they would not. Commissioner Piland asked if there is a problem with failing septic systems in the annexation area. Mr. Paul stated that that information has not been indicated. Commissioner Piland asked if the fire insurance rates would be lower with ser- vice provided by the City. Mr. Paul stated they would remain the same at a Class 4. Commissioner Piland stated that he can see both sides of the issue and that it looks like a lot of the property owners do not actually live in the area. He also stated that he does not believe the area can remain rural for long. Com- missioner Ellard agreed because of the water quality. Mr. Johnson asked if the water is contaminated once annexed, would the City have to provide water ser- vice. Commissioner Ellard stated that it would, and Chairman Frederick stated that another alternative would be for the property owners to install individual water purification systems. Discussion followed. Chairman Frederick stated that on May 9, 1985 all property owners were informed of the annexation request. Commissioner Piland reemphasized that Mr. Paul and the City are not trying force anyone to annex and many opportunities have been provided for those to come forward against it. The City did not ask for the annexation, a majority of the property owners came forward in favor of it. Commissioner Piland made a motion to pass Resolution No. 101, A Resolution of Recommendation to the Central Point City Council for Annexation of Approxi- mately 189 Acres of Contiguous Property Generally Bounded by Bursell Road, Beall Lane, Hopkins Road, and Interestate ,75 to the City of Central Point; to Withdraw such Property from Jackson County Fire District #3, Bear Creek Valley Sanitary Authority and Rogue Valley Transportation District; Further City of Central Point Planning Commission Meeting July 2, 1985 - 7 :00 p.m. Page 5 Recommendation is that the Zoning Designation Indicated on the City of Central Point Comprehensive Land Use Zoning Map be in Effect upon Final Approval of the Proposed Annexation. Commissioner Ellard seconded the motion. Roll call vote: Barlow, yes; Ellard, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. MISCELLANEOUS Mr. Paul stated that Larry Denn, a local contractor, has asked if the City would entertain having an ordinance that allows zero lot lines. This would require that a specific zoning ordinance be created that would address the matter. Discussion followed and the consensus of the Commission was that they are not in favor of addressing this issue at this time. Commissioner Piland asked if anything has been done in regard to an ordinance regulating satellite dishes. Mr. Paul stated that the Council has decided not to address the issue at this time. ADJOURNMENT ' Commissioner Ellard made a motion to adjourn the meeting. Commissioner Barlow seconded the motion. Roll call vote: Barlow, yes; Ellard, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. Chairman Frederick adjourned the meeting at 9:05 p.m.
