HomeMy WebLinkAboutMay 7, 1985 City of Central Point Planning Commission Meeting May 7, 1985 - 7:00 p.m. Page 1 MEETING CALLED TO ORDER Chairman Frederick called the meeting to order at 7:01 p.m. ROLL CALL Present were Chairman Orrin Frederick and Commissioners Ginger Bitterling, Garth Ellard, Jerry Mattey, and Charles Piland. Commissioner Reed Barlow was absent due to work. Also present were Fire Chief/Building Official Don Paul and Secretary Maureen Tanhoff. APPROVAL OF MINUTES Commissioner Ellard made a motion to approve the minutes of the April 2, 1985 Planning Commission meeting as presented. Commissioner Piland seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes; Mattey, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. ' CORRESPONDENCE AND PUBLIC APPEARANCES There were none at this meeting. BUSINESS Public Hearing to consider a conditional use permit application from Joe Dale to allow the remanufacturing of plywood into spring floors for on-premises and telephone retail sales in a building located at 680 South Front Street, Central Point, located in a C-5 zone and further described as Jackson County Assessor's Map Page 37 2W 11BC, Tax Lot 5900. Chairman Frederick opened the public hearing. Building Official Paul stated that the public hearing was opened at the April 2, 1985 Planning Commission meeting due to advertisement in the Medford Mail Tribune even though the Dales were not present. At that time no one was present to speak in favor of or against the application. Mr. Paul read his staff report dated March 27, 1985 and listed the following exhibits for the record: Exhibit A - Application for Conditional Use Permit; Exhibit B - Notice of Public Hearing; Exhibit C - Certificate of Posting of Notice of Public Hearing; Exhibit D - Assessor's map page; and Exhibit E - Aerial map page. There were no conflicts of interest declared by the Commissioners at this meeting. Joe Dale, 680 South Front Street, P. 0. Box 1051, Phoenix, Oregon, came for- ward. He stated that 90% of their business is on-premise retail sales or by telephone. Mr. Dale stated that they use their trucks for some deliveries but also use freight companies and United Parcel Service to ship their product. City of Central Point Planning Commission Meeting May 7, 1985 - 7:00 p.m. Page 2 Mr. Dale stated that the landlord has been hesitant to work on arrangements to construct a permanent office site until the conditional use permit is obtained. He expressed concern about the setback requirements in the event they add on to the building in the construction of an office. Chairman Frederick stated that staff would inform them of the setback requirements. Mr. Dale asked about parking requirements for employees. Discussion followed as to Municipal Code requirements for parking and the possible areas that could be used for parking. Chairman Frederick asked if the Dales would commit to having the permanent office completed within six-months from now. Mr. Dale agreed. Mr. Paul informed Mr. Dale that if an interior office is planned, only a staff review of the plans would be required. If they intend to add on to the existing building for an office, a site plan review before the Planning Commission would be required. Commissioner Piland expressed concern about the big truck that is still being parked out in front impairing traffic vision for those patronizing the veter- inarian's office next door. Mr. Dale stated that they thought it was safer for the truck not to be parked up next to the building. Mr. Dale also stated that the ditch out front causes considerable traffic problems and plans to have it made into a covered culvert. Commissioner Piland asked Mr. Dale if they intend to continue using the front fenced area for storage. Mr. Dale said they share the area with Accent Marble. He stated that once the mobile office is removed, they will probably park the big truck in that area as they hope to construct the office where the truck is parked now. Commissioner Ellard asked Mr. Dale if their operation is run strictly during the day time. Mr. Dale stated that right now they only operate during the day but they may run two shifts in the summer. Commissioner Ellard stated that this may have some effect on the parking requirements. Discussion followed regarding the amount of land available under the ownership of the landlord, Mr. Wiley. Mr. Paul informed Mr. Dale that it is the responsibility of both the business owner and the landlord to work out the arrangements necessary to comply with the requirements of the conditional use permit. No one else came forward to speak in favor of or against the application. Chairman Frederick closed the public hearing. Discussion followed regarding the parking requirements. Commissioner Ellard made a motion to pass Resolution No. 98, A Resolution Approving a Conditional Use Permit to Allow Remanufacturing of Plywood into Spring Floors and for On-Premises and Telephone Retail Sales within a Building City of Central Point Planning Commission Meeting May 7, 1985 - 7:00 p.m. Page 3 in a C-5 Zone, subject to the following conditions: 1. A permanent office be located within or attached to the existing building conforming to all appli- cable codes and ordinances, said construction permits to be obtained so con- struction may be completed within six months; 2. The use of the present mobile office is to discontinue for on-site use after a maximum period of six months; 3. Available on-site parking shall comply with City ordinance. Commissioner Bitterling seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes; Mattey, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. Public Hearing to consider a conditional use permit application from Shirley Ash to allow a secondhand store in a building located at 117 East Pine Street, Central Point Oregon, in a C-3 zone, Jackson County Tax Assessor's Map Page 37 2W 3DD, Tax Lot 9900. Building Official Paul summarized his staff report dated May 3, 1985 and listed the following exhibits for the record: Exhibit A - Notice of Public Hearing; Exhibit B - Certificate of Posting of Notice of Public Hearing; Exhibit C - ' Application for Conditional Use Permit; Exhibit D - Findings of Fact (typed from applicant's handwritten copy) ; and Exhibit E - Assessor's map page. Chairman Frederick opened the public hearing. There were no conflicts of interest expressed by the Commissioners. James Ash, 850 Bennett, Medford, came forward. He stated that he used to just repair and sell used appliances but has recently gotten into the business of trading merchandise. Mr. Ash stated that he placed items for sale on the side- walk at the suggestion of a policeman. Mr. and Mrs. Ash also run a similar business in Talent. Chairman Frederick asked if they have any plans for storage in the immediate area. Mr. Ash stated that they did not. They have an agreement with the landlord for a lease option to buy the building within a year. Mr. Ash stated that they intend to paint the exterior of the building as soon as possible and will discontinue displaying merchandise outside. In response to a question from Commissioner Piland, Building Official Paul pointed out that the alcove for the door is private property. Mr. Ash stated that they intend to cooperate with all City requirements. No one else came forward to speak in favor of or against the application. Chairman Frederick closed the public hearing. Discussion followed regarding placing a condition on the permit to prohibit the displaying of merchandise outside the building. ' Commissioner Piland made a motion to approve Resolution No. 99, A Resolution Approving a Conditional Use Permit to Allow a Secondhand Store within a Build- ing in a C-3 Zone, with the condition that the outside display of merchandise City of Central Point Planning Commission Meeting May 7, 1985 - 7:00 p.m. Page 4 not be allowed. Commissioner Mattey seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes; Mattey, yes; Piland, yes. All of the Commis- sioners voted in favor of the motion and the motion carried. Cherry Park Subdivision Decision Building Official Paul explained that Oregon State Law requires that once an application for a subdivision is filed, a decision must be made within 120 days. The developers of this subdivision have elected not to pursue the pro- ject at this time. Commissioner Piland made a motion to deny the application of the preliminary plat for the Cherry Park Subdivision due to insufficient information provided. Commissioner Ellard seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes; Mattey, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. MISCELLANEOUS Minor Land Partition Application - James Scott Building Official Paul informed the Commissioners that James Scott has with- drawn his minor land partition application. ADJOURNMENT Commissioner Ellard made a motion to adjourn the meeting. Commissioner Bitterling seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes; Mattey, yes; Piland, yes. All of the Commissioners voted in favor of the motion and the motion carried. Chairman Frederick adjourned the meeting at 8:08 p.m.
