MEETING CALLED TO ORDER
Chairman Frederick called the meeting to order at 7:07 p.m.
ROLL CALL
Present were Chairman Orrin Frederick and Commissioners Ginger Bitterling,
Garth Ellard, Jerry Mattey, and Charles Piland. Commissioner Reed Barlow was
excused because of work. Also present were Fire Chief/Building Official Don
Paul and Secretary Maureen Tanhoff.
APPROVAL OF MINUTES
Commissioner Ellard made a motion to approve the minutes of the September 4,
1984 Planning Commission meeting as presented. Commissioner Bitterling
seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes; Mattey,
yes; Piland, yes. All of the Commissioners voted in favor of the motion and
the motion carried.
0 CORRESPONDENCE AND PUBLIC APPEARANCES
No correspondence was presented and there were no public appearances made at
this meeting.
BUSINESS
Public hearing to review and make a decision on an Application for a Condi-
tional Use Permit from Clyde S. and Ann M. S. Bernhardt to allow the sale of
alcoholic beverages in a C-5 zone at a restaurant located at 501 South Front
Street further described as Jackson County Assessor's Map Page 37 2W 11BC, Tax
Lot 4700
Building Official Paul read his staff report dated September 26, 1984 and
listed the exhibits for the record as follows: Exhibit A - Notice of Public
Hearing; Exhibit B - Certificate of Posting of Notice of Public Hearing;
Exhibit C - Application for Conditional Use Permit; Exhibit D - assessor's tax
map; and Exhibit E - aerial map. of subject area.
There were no conflicts of interest expressed by the Commissioners. Chairman
Frederick opened the public hearing.
Clyde Bernhardt, 115 North River Road, Gold Hill, came forward. He stated
that a month ago he and his wife opened the Arirang Korea House restaurant at
501 South Front Street. Several of his customers have asked that beer and
wine be included on the menu so he has applied for this conditional use per-
mit. There will be no bar and the liquor will be served with food within the
building. Mr. Bernhardt stated that he and his wife plan to maintain a fine

,restaurant of which Central Point can be proud. He has already obtained ap-
proval from the O.L.C.C. subject to approval by the City. Chairman Frederick
explained the conditional use permit review procedure.
No one else came forward to speak in favor of or against the request. Chair-
man Frederick closed the public hearing.
Chairman Frederick asked where the nearest restaurant selling alcoholic
beverages on Front Street is located. Don Paul stated that the only place
that might is Chef Fong's but he is not sure.
Commissioner Ellard made a motion to pass Resolution No. 90, A Resolution
Approving a Conditional Use Permit to Allow the Serving of Alcoholic Beverages
Within the Restaurant at 501 South Front Street, Central Point, Oregon, in a
C-5 Zone; property is further described as Jackson County Assessor's Map Page
37 2W 11BC, Tax Lot 4700. Commissioner Piland seconded the motion. Roll call
vote: Bitterling, yes; Ellard, yes; Mattey, yes; Piland, yes. All of the
Commissioners voted in favor of the motion and the motion carried.
Public hearing to review and make a decision on an Application for a Variance
from George Francisco to construct a fence at 4010 Rock Way in a R-1 zone fur-
ther described as Jackson County Assessor's Map Page 37 2W 3AB Tax Lot 1500
Building Official Paul read his staff report dated September 26, 1984 and
listed the following exhibits: Exhibit A - Notice of Public Hearing; Exhibit
B - Certificate of Posting of Notice of Public Hearing; Exhibit C - Applica- .
tion for Variance; Exhibit D - applicant's findings of fact; Exhibit E -
police department memorandum; Exhibit F - assessor's map; Exhibit G - aerial
map; and Exhibit H - staff's map (separate document posted on wall) .
There were no conflicts of interest expressed by the Commissioners. Chairman
Frederick opened the public hearing.
George Francisco, 4010 Rock Way, Central Point, came forward. He stated that
constructing a six-foot fence in the area indicated would allow him more use
of his property. He would like to have a garden, wood storage and a place for
his camper in the area to be fenced. At the present time, he stated that
children are constantly cutting across his property which prevents him from
utilizing this area as he would like. He does not feel a 331-foot fence would
be of adequate height to keep the children off his property. In addition, Mr.
Francisco also stated that his own children are small and a six-foot fence
would provide for their safety in keeping them within his yard. The fence
will also be necessary at some point in the future as he intends to put a pool
in his backyard. He indicated that there is sidewalk on both street sides of
his property.

Commissioner Piland stated that an issue here is the effect a six-foot fence
would have on traffic visibility. Mr. Francisco stated that he did not think
visibility would be hindered any more than it is now. Commissioner Ellard
informed Mr. Francisco of the memorandum from Sgt. Macartney of the police
department stating that traffic visibility would be adversely affected by a
six-foot fence constructed as requested by Mr. Francisco. A copy of the memo-
randum was provided for Mr. Francisco to read. Commissioner Ellard suggested
that the six-foot height of the fence end at a point perpendicular to the
southeast corner of the house and continue toward Rock Way at a height of 3'
feet. Mr. Francisco stated that he would agree to this if it is absolutely
necessary.
Commissioner Bitterling suggested the use of a chain link fence to maintain
visibility. After considerable discussion, the Commissioners decided against
a chain link fence because if approved, at some point in the future the visi-
bility could be obstructed with shrubbery or slats.
No one else came forward to speak in favor of or against the request. Chair-
man Frederick closed the public hearing.
Commissioner Piland made a motion to pass Resolution No. 91 , A Resolution
Approving a Variance to Construct a Fence Exceeding Height Limitations in an
R-1 Zone, said fence not to extend forward (west) beyond a point perpendicular
to the southeast corner of the house on property located at 4010 Rock Way,
Central Point, Oregon, further described as Jackson County Assessor's Map Page
37 2W 3AB, Tax Lot 1500. Commissioner Mattey seconded the motion. Roll call
vote: Bitterling, yes; Ellard, yes; Mattey, yes; Piland, yes. All of the
Commissioners voted in favor of the motion and the motion carried.
ADJOURNMENT
Commissioner Bitterling made a motion to adjourn the meeting. Commissioner
Ellard seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes;
Mattey, yes; Piland, yes. All of the Commissioners voted in favor of the
motion and the motion carried.
Chairman Frederick adjourned the meeting at 7:56 p.m.
