MEETING CALLED TO ORDER
Chairman Frederick called the meeting to order at 7:10 p.m.
ROLL CALL
Present were Chairman Orrin Frederick and Commissioners Ginger Bitterling ,
Garth Ellard and Charles Piland. Excused were Commissioners Virgil Elbert
and Louise Novasad. Also present were Mayor Don Jones, City Administrator
David Kucera, Fire Chief Don Paul , Planning Commission Secretary Maureen
Tanhoff, and Councilmember Donna Higginbotham.
Chairman Frederick stated that Commissioner Novasad was unable to attend
due to a back injury. Chairman Frederick introduced and welcomed new
Planning Commissioner Ginger Bitterling.
APPROVAL OF MINUTES
Commissioner Piland made a motion to approve the minutes of the November 16,
1982 meeting as typed., Commissioner Bitterling seconded the motion. Roll
call vote: Bitterling, yes; Ellard, yes; Piland, yes. All Commissioners
voted in favor of the motion, and the motion carried.
CORRESPONDENCE
No correspondence was brought before the Planning Commission at this meeting.
PUBLIC APPEARANCES
No public appearances were made at this Planning Commission meeting.
BUSINESS
A. Public Hearing for the Planning Commission to decide on a Variance to
allow a residential garage to be constructed within the required set-
back at 262 South Second Street, which is in a R-3 zone.
Don Paul reminded the Planning Commissioners that Mr. and Mrs. Marquis Hale
had presented their request to the Planning Commission previously, and that
they are now applying for a Variance to allow construction of a residential
garage to be built five feet within the required setback. The garage has
been designed to face Ash Street, which has a 80 foot right of way. The
house faces South Second Street and does not allow sufficient access for a
driveway approach from South Second Street. The present garage is in non-
conformance with the present zoning ordinance. It is staff's opinion that
the new garage will conform with the requirements set forth in Items 2.
through 5. of Section 17.80.010 D. of the Municipal Code.
The following Exhibits were submitted to the Planning Commission concerning
this request: A. Application for Variance; B. Memorandum of Land-Sale

Contract; C. Assessor's Map; D. Statement for #4 on Variance Applica-
tion; E. Petition of proponents; F. Site Plan and proposed construc-
tion material .
Chairman Frederick asked if there were any conflicts of interest within the
Planning Commission regarding this request and none were expressed. He
then declared the Public- Hearing open. Chairman Frederick asked if the
Notice of Public Hearing had been published and posted. Don Paul stated
that it had been and Mr. Hale presented the Planning Commission with a
clipping of the Notice from the Medford Mail Tribune, which Chairman
Frederick read aloud.
Chairman Frederick advised Mr. Hale that he would have 30 minutes in which
to present evidence to support his request and to speak or have anyone else
speak on his behalf. Mr. Hale stated that he believed he covered it all at
the last meeting he attended, and that he has made every effort to comply
with the requirements of the Planning Commission.
Chairman Frederick complimented Mr. Hale on his diligence in cooperating
with the Planning Commission and stated that he would like the record to
show that the proposed structure would be in line with the existing dwelling.
Chairman Frederick asked if there was anyone present that would like to
speak in opposition to this request. No one came forward and Chairman
Frederick declared the Public Hearing closed and stated that the matter was
now in the hands of the Planning Commission.
Commissioner Ellard stated that he liked the fact that the new garage would
be even with the house. He also stated that he felt the proposed construc-
tion would comply with Item 6. of Section 17.80.010 D. of the Municipal
Code in that Mr. Hale will be making excellent use of the residential zone
while beautifying the neighborhood.
Commissioners Bitterling and Piland each stated they had no objections to
the request and agreed that it complied with all the requirements in Items
1 . through 6. of Section 17.80.010 D. of the Municipal Code.
Chairman Frederick stated that he felt the request was also in compliance
with Item 1 . of Section 17.80.010 D. reiterating that the basic advantage
would be the continued beautification of that corner while providing Mr.
Hale a garage to keep his car in rather than parking it on the street.
Commissioner Ellard made a motion to adopt the findings outlined as Items
1 . through 6. of Section 17.80.010 D. as listed below, and approve the
Variance request.

1 . The Variance will provide advantages to the neighbor-
hood or the City;

2. The Variance will provide beautification to the
neighborhood or the City;
3. The Variance will provide safety to the neighbor-
hood or the City;
4. The Variance will provide protection to the
neighborhood or the City;
5. The Variance will not have any adverse impacts
upon the neighborhood;
6. The Variance will utilize property within the
intent and purpose of the zone district.
A second to the motion was made by Commissioner Bitterling. Roll call vote:
B-itterling, yes; Ellard, yes; Piland, yes. All the Commissioners voted in
favor of the motion, and the motion carried.
MISCELLANEOUS
O No miscellaneous items were brought before the Planning Commission at this
meeting.
ADJOURNMENT
Commissioner Piland made a motion to adjourn the meeting. Commissioner
Ellard seconded the motion. Roll call vote: Bitterling, yes; Ellard, yes;
Piland, yes. All the Commissioners voted in favor of the motion, and the
motion carried.
Chairman Frederick adjourned the meeting at 7:30 p.m.
