HomeMy WebLinkAboutSeptember 21, 1982 Planning Commission Meeting September 21 , 1982 City Council Chambers MEETING CALLED TO ORDER Vice Chairman Garth Ellard called the meeting to order at 7 :04 p.m. ROLL CALL Present were Vice Chairman Garth Ellard and Commissioners Charles Piland , Owen Christy, Virgil Elbert, Jack Crumm and Louise Novasad. Chairman Orrin Frederick was absent. Also present were Mayor Don Jones , City Administrator Dave Kucera, Fire Chief Don Paul , and temporary Planning Commission Secretary Sandy Fisher. APPROVAL OF MINUTES - Meeting of September 7 , 1982 Commissioner Christy made a motion to approve the minutes of the September 7 , 1982 meeting as written. Commissioner Elbert seconded the motion. Roll call vote: Piland, yes ; Christy, yes; Ellard , yes ; Elbert, yes; Crumm, yes; Novasad, yes . All commissioners were in favor and the motion carried . CORRESPONDENCE No correspondence was brought before the Planning Commission at this meeting. o PUBLIC APPEARANCES No public appearances were made at this Planning Commission meeting. BUSINESS A. Public Hearing for the Planning Commission to decide on a Conditional Use Permit application for a Thrift Store in a C-2 zone. Hazel C Larson, 545 Fairmount Street, Medford , Oregon, applicant. Mr. Larson, applicant's husband, came forward and addressed the Planning Com- mission stating that his wife was at home recovering from a stay in the hospital , but that they both wished to express their appreciation to the Com- mission in granting a business license at the August 17th meeting and that, although the decision was subsequently overruled, they felt this was done in the best judgment. The inconvenience and delay had not been pleasant and he wished to assure the City of Central Point and the City Administrator that they intend to operate a business which will adhere to all City regulations and which will be a credit to the community. Staff member Don Paul noted that the Larsons appeared before the Planning Com- mission on August 17 , 1982 for interpretation as to whether their proposed store should be a Permitted Use or a Conditional Use in a C-2 zone. At that meeting the Planning Commission approved a Permitted Use for the Larsons and subsequently they were issued a business license. At the August 26, 1982 O City Council meeting a motion was made and approved to review the Planning Commission decision at the September 9, 1982 Council meeting. On September 9, 1982 a Public Hearing was held to review the Planning Commission decision. At that City Council meeting a motion was made and approved for the Larsons Planning Commission Meeting September 21 , 1982 Page Two to file an application and $100.00 filing fee for a Conditional Use Permit, The Larsons have complied with the City Council ' s decision and Public Notice procedures. Mrs . Novasad noted she had no further questions since she felt the original Permitted Use had been correct and questioned the City Council 's reasons for overriding the Planning Commission's decision. Garth Ellard stated this was because new apparel was included in the original request. While this was still so Mr. Kucera noted that the majority of items in the store would be second hand items which fell under Conditional Use. Commissioner Christy made a motion to adopt the findings contained in sections A, B, and C of the Burden of Proof submitted by Mr. Larson and approve a Conditional Use Permit for a Thrift Store in a C-2 zone located at 61 S. 2nd Street, Central Point. Commissioner Elbert seconded the motion. Roll call vote: Piland, yes; Christy, yes; Ellard, yes; Elbert, yes; Crumm, yes ; Novasad, yes. All commissioners were in favor and the motion carried. Mayor Don Jones spoke in defense of the City Council 's action with regard to the requirement for a Conditional Use permit in this instance, stating that the Council felt the granting of a Permitted Use permit to have been an over- sight on the Planning Commission's part in as much as a second hand store falls under the Conditional Use category. The Mayor stated that while re- vising zoning a year ago the City Council hoped to prevent items being set out on sidewalks or an entire block of second hand stores appearing in the City. Vice Chairman Ellard stated that the Planning Commission had been informed that new as well as used clothing was to be sold with no large furniture items , and nothing placed outside the store, and that such conditions were placed on this at the time the Permitted Use permit was granted. Mayor Jones noted that without granting a Conditional Use permit such condi- tions would have been impossible to uphold. MISCELLANEOUS No miscellaneous items were brought before the Planning Commission at this meeting. ADJOURNMENT Commissioner Christy made a motion to adjourn the meeting. Commissioner Pyland seconded the motion. Roll call vote: Piland, yes ; Christy, yes ; Ellard, yes ; Elbert, yes; Crumm, yes; Novasad, yes. All commissioners were in favor and the motion carried. The meeting adjourned at 7 :17 p.m.
