MEETING CALLED TO ORDER
Chairman Orrin Frederick called the meeting to order at 7:05 P.M. He then
introduced and welcomed our new Plamu ng Camiissioner, Jack Crunm, who has
filled the vacant position #6.
ROLL CALL
Present were Chairman Orrin Frederick and ComLissioners Jack Cxnmm, Garth Ellard,
Virgil Elbert and Louise Novasad. Excused were Comnissioners Owen Christy and
Charles Piland. Also present was Councilmenber Lonna Higginbotham and Staff
members present were the Administrator, Dave Kucera, Fire Chief Don Paul, and
Planning Commission Secretary Peggy Malos.
APPROVAL OF Mlri= - July 20, 1982
Louise Novasad made a motion that the minutes of the July 20, 1982 Planning
C =L ssicn meeting be approved as written. CannIssicner Ellard seconded the
motion. Roll call vote: C =nissioner Crump abstained fran voting; Elbert, yes;
Ellard, yes; Novasad, yes. All ommnissioners voted in favor of the motion and
the motion carried.
CORRESPONDENCE "
No correspondence was brought before the Planning Commission at this meeting.
PUBLIC APPEARANCES
No public appearances were made at this Planning Camdssicn meeting.
BUSINESS
A. Request for Planning Camdssion to make a determination that a retail
store sellina used apparel, ierielrv, books, used baby articles, and
brie-a-brae , is a similar and mrmatible use in a C-2 zone.
Hazel and Harry W. Larson, avolicants
Administrator Kucera presented the Staff Report, dated August 3, 1982, by Staff
member Kucera, as well as the Application for a Business License sutmitted 8-3-82,
and advised that this is a request for the Planning Commission to make an interpre-
taticn as to whether the applicants' proposed store should be a Permitted Use or
a Conditional Use in the C-2 zone.'

He advised that most of the items for sale appear in the Permitted Uses Section
of the C-2 zone; however, the applicants have stated that the majority of their
items for sale will be used, which presents a question of whether their use falls
under a Second Hand store, which is listed as a Conditional Use in the C-2 zone.
Staff recommends that because there is a question of interpretation, that this
question should best be resolved by the Planning Comnission after having the
applicants explain their proposed business.

The applicants, Hazel and Harry W. Larson, 545 Fairrta0.mt, Medford, came forward
to address the Commissioners and answer any questions they mdght have.
Hazel Larson advised that their proposed store would be on the order of a thrift
store, specializing in used baby and children's items, such as clothing, cribs,
strollers, etc., but also selling small appliances, jewelry, books, brie-a-brae ,
etc., and it will be located at 61 Second Street. The name of the proposed store
will be 112nd Choice".
Orrin Frederick inquired about the types of businesses that had been previously
located at this address.
Ccnmissioner Novasad stated that at one time there had been a beauty shop at this
address and also a laundromat.
Commissioner Ellard noted that the Business License indicated appliances would
be sold, and he irxlu red about these.
Mrs. Larson advised that she planned to sell small appliances, such as irons,
toasters, etc., adding that the space was too limited to handle large appliances.
After considerable discussion among the commissioners with respect to what, '
exactly, would be sold in the store, etc., it was determined that the store would
Present no Problems and that it would be a similar and compatible use to the uses
listed in the C-2 zone.
Commissioner Ellard made a motion that the Planning Commission detenmines that a
retail store selling used apparel, baby and children's item, jewelry, books,
small appliances, and brie-a-brae is a similar and oonpatible use in the C-2
district under 17.36.020, Permitted Uses, C. Retail outlets, including items as
follows:

# 6. Gifts, notions and variety
# 8. Small appliance sales
#17. Antique shop
#25. General apparel
#27. Specialty apparel
#28. Jewelry
Commissioner Novasad seconded the motion. Roll call vote: Crumm, yes; Elbert, yes,
Ellard, yes; Novasad, yes. All in favor and the motion carried.
B. Request for Planning Commission to make a determination that a warehouse in
a R-1 zone meets the Hone Occupation Reauiremments Neil Carter, applicant
Staff member Don Paul addressed the commissioners and presented the following

Ion Paul advised that the applicant has made a request to enter into a Hone
Occupation. His property is a large irregular shaped lot of approximately
13,250 square feet, which is larger than most properties in the area. The
nature of the business will be newspaper distribution, and the intention is to
build a 24' x 60' warehouse to the rear of the existing residence.
The Planning Commission is requested to determine if the request would interfere
with the preservation of the character of the subject property, as well as the
residential neighborhood.
The applicant, Mr. Neil Carter, 630 Hermosa, Central Point, came forward to address
the commissioners and answer questions. He advised that he wants to build this ware-
house to store his newspapers and vending machines, and stated that his carriers
arne in to pick up their papers, which takes approximately 15 minutes, each morning
0 around 6:30 a.m. He stated that his hone has a composition roof, is olive green
in color, with T-1-11 siding on the outside. He had first considered using metal
for the proposed warehouse but has since decided to use the same type of material
his home is built of. He plans no expansion of this use at all. The reason the
building will be 16' high is due to the fact that he plans to build an overhead
loft to store the vending machines, and he also plans to use this warehouse as a
garage for storing his boat and camp trailer.
Connissioner Novasad inquired about his neighbors' attitude toward his proposed
plan to build a warehouse.
Mr. Carter advised that he had talked to sane of the neighbors and had run into
no opposition.
Commissioner Ellard inquired whether the other banes in the area have attached
garages, and was informed by Mr. Carter that they do.
Commissioner Cram questioned where the carriers would be loading and was advised
by the applicant that they would load in front of the large door in the driveway.
Mr. Carter stated that he will be able to stay within 'all of the set-back require-
ments.
Councilmenber Donna Higginbotham asked if vehicles coming to the property will be
driving inside the building to load, and Mr. Carter stated that they would not.
After considerable discussion among the commissioners it was decided that they
could see no problems with the building of the warehouse.

Virgil Elbert made a motion that a Hone Occupation Permit for a newspaper
distribution center, located at 630 Hermosa, be granted with the following
conditions:
1. All set-back requirements to be met.
2. Structure is to be of similar color and construction appearance,
including siding, trim, roof, etc., as the other dwelling.
3. No parking is to be available for additional vehicles on outside
of structure.
Louise Novasad seconded the motion. Roll call vote: Crump, yes; Elbert, yes;
Ellard, yes; Novasad, yes. All the commissioners were in favor and the motion
carried.
Chairman Frederick called a recess at 8:05 p.m.
Chairman Frederick called the meeting back to order at 8:15 p.m.
C. Determination by Planning Commission on whether Hone Occupation Permits
should be allowed or 'reauired in zones other than residential
Administrator Kucera presented the Staff Report, dated August 6, 1982, by the '
Administrator, and stated that he has received two requests from people who
wish to have a Hone Occupation in a residence which is located in a commercial
zone. The use, by itself, would have required a Home Occupation Permit instead,
thereby foregoing the need for a Conditional Use Permit. Attorney Carter has
advised that this would not be an appropriate process.
The present Ordinance is silent on whether or not Home Occupations are required
both within a residential zone and other zones. However, the apparent intention
of the Ordinance is that Home Occupations be required only within residential
zones and any occupation being conducted in a residence within a zone .other
than residential would need to meet the requirements of that zone.
Staff felt it mould be appropriate for the Planning Commission to review the
set policy and if they should decide that it's allowed, the Ordinance would then
need to be revised.
Chairman Frederick stated that it was his feeling that Home Occupations should
be restricted to residential zones.
Oamni.ssioner Ellard stated that he concurred with Chaixnian Fredericks on Hone
Occupations being restricted to residential zones.
CaTmissioner Novasad made a motion that the Hone Occupation process should not
be allowed in zones other than residential. Virgil Ellard seconded the motion. '
Roll call vote: Crum, Yes; Elbert, Yes, Ellard, yes; Novasad, yes. All of the
commissioners were in favor of the motion and it carried.

No miscellaneous business was brought before the Planning Comnission at this
meeting.
ADJOURIZIRU
Co missirner Ellard made a motion that the meeting be adjourned. Louise Novasad
seconded the motion. Roll call vote. Crumm, yes, Elbert, yes, Ellard, yes,
Novasad, yes. All in favor. The motion carried.
Chairman Frederick adjourned the meeting at 8:25 P.M.
