MEETING CALLED TO ORDER
Chairman Orrin Fredericks called the meeting to order at 7:09 P.M.
ROLL CALL
Present were Chairman Fredericks and Commissioners Christy, Ellard, Himmelman, and
Piland. Excused was Commissioner Novasad. Mayor Don Jones and Councilmember Donna
Higginbotham were also present. Staff members present were Administrator Dave Kucera
and Secretary Peggy Malos.
APPROVAL OF MINUTES - (June 1 , 1982)
Commissioner Christy made a motion to approve the minutes as written. Commissioner
Ellard seconded the motion. Roll call vote: Christy, yes; Ellard, yes; Himmelman,
yes; and Piland, yes. All in favor. The motion carried.
CORRESPONDENCE
No correspondence was brought before the Planning Commission at this meeting.
PUBLIC APPEARANCES
0 No public appearances were made at this Planning Commission meeting.
BUSINESS
A, Site Plan Review - Service Station and Food Store for Hawk Oil Company,
81 Freeman Road, Zone C-4 Tax Lot 900 J. C. Map Paae 37-2W-2D.
Administrator Kucera presented the site plans by Architects Afseth, Jacobs & Schmitz,
Medford, and also the Staff Report by Planning Department staff member Jon Brite,
dated June 10, 1982, recommending the approval of the site plans as submitted. The
Administrator stated that Staff feels there is adequate parking and they feel also
that they can waive any further construction plans. He advised that the question before
the Planning Commission is whether or not a building permit would be required.
Mike Hawkins, the applicant, representing Hawk Oil Company, 1050 So. Riverside, Medford,
addressed the Planning Commission and advised that due to the fact that alcoholic
beverages will be sold "to- go" , there will always be someone working who is 21 years
of age or older.
Commissioner Ellard stated that he felt the proposed mini-mart added to the existing
service station would bean improvement to the area.
Chairman Fredericks stated that the Planning Commission foresees no problems with
0 parking.
Commissioner Ellard made a motion to approve the site plan review of Hawk Oil Company,
81 Freeman Road, Central Point, as presented by Staff. Commissioner Piland seconded
the motion. All in favor. The motion carried.

B. Public Meeting to consider a Resolution of Intent to Amend the Home Occupation
Requirements in the Zoning Ordinance.
Dave Kucera addressed the Planning Commission and stated that notices of the public
meeting were published twice in the Medford Mail Tribune; on June 11 , 1982, and again
on June 13, 1982. He presented a copy of Council Resolution #390, a Resolution of Intent
to Amend the Home Occupation Requirements in the Zoning ,Ordinance, and a copy of the
proposed Home Occupation Permit. He also introduced the Staff Report dated June 7 ,
1982, by Staff member Dave Kucera, and stated that the primary change proposed would
be to remove the requirement to obtain a Conditional Use Permit in order to engage in
a home occupation, and replace it with a permit procedure administered at the Staff
level .
The Administrator stated that Resolution No. 390, as adopted, defines the purpose and
scope of the proposed Home Occupation Permit, adding that no Home Occupation Permit
may be transferred or assigned and that any permit can be revoked if it has been found
that any condition has been violated. The Resolution also provides exclusions for
beauty shops, barber shops , and child care facilities,but the Administrator stated
that Council expressed some reservations about the exclusion of child care facilities,
because they felt child care belonged. in the reaidential areas.
The Administrator stated that under the current procedure the application of a $100
fee was required with the Conditional Use Permit, and the proposal would require a '
one-time only $10 fee, adding that the primary reason this proposal was initiated by.
staff is because of the continued struggle that occurs when people come into the City
Hall and ask for a Business License, as most of the time it is for a small use, and
people are not interested in applying for a Conditional Use Permit and paying $100.
Pat Himmelman stated that she was very concerned with the exclusion of small baby
sitting services in the home, as she feels they are needed and should be allowed.
Chairman Fredericks stated that he, personally, felt that a small sign should be
allowed, stating that it would enable the person looking for a service to have an
easier time locating it.
Commissioner Ellard stated that he would not be in favor of signs in a residential
area.
Commissioner Himmelman stated that she was not in favor of signs in a residential
area.
Pat Himmelman made a motion to authorize the Planning Commission Chairman to sign a
Resolution of Recommendation to the City Council to Amend the Home Occupation Require-
ments in the Zoning Ordinance, with the exclusion of Paragraph F. , which excludes
beauty shops, barber shops, and child care facilities. Owen Christy seconded the
motion. Roll call vote: Christy, yes; Ellard, yes; Himmelman, yes; and Piland, yes . '
All in favor. The motion carried.

MISCELLANEOUS
There was no miscellaneous business brought before the Planning Commission at this
meeting.
ADJOURNMENT
Commissioner Christy made a motion to adjourn the meeting. Commissioner Ellard seconded
the motion. All in favor. The motion carried.
The meeting adjourned at 7:55 P.M.
