HomeMy WebLinkAboutNovember 3, 1981 Planning Commission Meeting City Hall Council Chambers November 3, 1981 MEETING CALLED TO ORDER Chairman Orrin Frederick called the meeting to order at 7:15 P.M. ROLL CALL Present were Chairman Orrin Frederick and Commissioners Owen Christy, George Freeman, Pat Himmelman and Louise Novasad. Also present were Mayor Don Jones, Councilmember Donna Higginbotham, Citizens Advisory Committee Chairman Grace Russell, Citizens Advisory Committee member Ginger Bitterling, Planner Ron Hough, Fire Chief David Penicook and Planning Commission Secretary Luci Miller. R. B. Taylor, previously the Chairman of the Planning Commission, has been appointed to the City Council. APPROVAL OF MINUTES October 20, 1981 Planning Commission Meeting Commissioner Himmelman pointed out that on the first paragraph of Page 3, in the roll call vote, "Himmelman, yes" should be omitted, since she removed herself from participating in this decision due to a' possible conflict of interest. Commissioner Freeman then made a motion to approve the minutes of the October 20., 1981 Planning Commission meeting, as amended; and Commissioner Novasad seconded the motion. Roll call vote: Novasad, yes; Himmelman, yes; Freeman, yes; Christy, yes. All Commissioners voted in favor of the motion, and the motion carried. CORRESPONDENCE No correspondence was brought before the Planning Commission at this meeting. PUBLIC APPEARANCES .. No public appearances were made at this Planning Commission meeting. BUSINESS A. Review of Stonecreek #3 Subdivision Agreement, Whit-Law Properties, Inc. , Applicant Chief Penicook advised that Staff has not yet reached a suitable agree- ment with Whit-Law Properties, Inc. , so this matter would be postponed. Planning Commission Meeting City Hall Council Chambers November 3, 1981 Page Two B. Variance - Public Hearing 447 Grand Avenue, Zone: R-1, Comp Plan_: Low Density Residential J.C. Map Page 37-2W-11BD, Tax Lot 1100, Ben Wells, Applicant Because of an error in the advertisement for the Public Hearing by the Medford Mail Tribune, Chief Penicook consulted with the City Attorney, who advised that the hearing should be postponed. The Mail Tribune notice indicated Grant Avenue instead of Grand Avenue. Because there is a Grant Road in the vicinity of Central Point, it was felt that there was a possibility for confusion. The adver- tisement will run again on 'November 5, 1981 and November 10, 1981 and the Public Hearing will be held at the November 17, 1981 Planning Commission meeting. C. Resolution No A Resolution Authorizing Power Saw Sales b Service as a Conditional Use in a C-5 Zone At present, chain saw sales and service are not allowed in any zone. Staff felt that the way to handle this issue would be to approve a resolution allowing chain saw sales and service in the C-5 zone. ' Commissioner Freeman suggested that a paragraph, similar to paragraph F under Permitted Uses in the C-5. zone, be added as paragraph Z under Conditional Uses in the C-5 zone, and as a paragraph under Conditional Uses in each of the other C zones, so that the uses which are similar but not listed could be approved without having to act on a resolution each time. i Chief Penicook felt that since the City,Attorney had approved this resolution that the most appropriate action would be to modify the resolution and direct Staff to proceed with the change suggested by Commissioner Freeman. Chief Penicook suggested that the Commissioners could change the words "power saw sales and service" to "small engine sales and service" to cover a broader range of activities if that was the Commissioners intent. Therefore, it was agreed that wherever the words "power saw sales and service" were referred to in the resolution, the same would be replaced with the words "small engine sales and service." Commissioner Himmelman then made a motion to approve the Resolution No. 35, A Resolution Authorizing Small Engine Sales and Service as a Conditional Use in a C-5 Zone, as amended, and Commissioner Freeman seconded the motion. Roll call vote: Novasad, yes ; Himmelman, yes; Freeman, yes; Christy, yes . -All Commissioners voted in favor of the motion, and the motion carried. Work Study Session - Review of Class "A" and "B" Nonconforming Uses Chairman Frederick called Planner Ron Hough forward so that he could answer any questions that the Planning 'Commission might have. 1. Subarea A - Pat Himmelman The only question Commissioner Himmelman had with respect to Subarea A was whether the Rock Museum was part of Item A-4, 2002 Parkwood, which was described as a .deteriorated residential structure used for storage and a commercial business. Planner Ron Hough advised that the Rock Museum was not a part of this structure. Commissioner Himmelman had no further questions with respect to Subarea A. 2. Subarea B - There were no nonconforming uses in Subarea B. Chairman Frederick called a five minute$ recess at 7:50 P.M. , so that Ron Hough could get some maps of the areas in question. Chairman Frederick called the meeting back to 'order at 7:55 P.M. At the request of Commissioner Freeman Subarea A was brought back for additional discussion. Planner Ron Hough was' advised that Item A-3, 1246 North Third Street, has been changed from a single family resi- dence to a flower shop. Since this is a conforming use, Item A-3 should be omitted from Subarea A. All Commissioners agreed with this action. 3. Subarea C - Owen Christy There were no questions with respect to Subarea C. Chairman Frederick asked Ron Hough the difference between Class "A" and Class "B" residences. Ron's interpretation was that the difference lies in the potential growth and the condition of the structure. Pro- perty owners will be able to apply for a change from a Class "B" to a Class "A" nonconforming use designation as they upgrade their property. The fee for changing such designation will have to be set by the City Council at a later date. 4. Subarea D - Orrin Frederick Chairman Frederick advised the Planning Commission that Item D-58, the northwest corner of Fourth and Oak Streets, is now a church, not a residence. Churches are not permitted in a C-2 zone, so Planning Commission Meeting City Hall Council Chambers November 3, 1981 Page Four this is still a nonconforming use. However, the Planning Commission felt that the designation should be changed from a Class "B" non- conforming use to a Class "A" nonconforming use so that improvement- can be made. Therefore, Item D-58 "will be changed to read, "Church use and related parking on a C-2 lot." - Class "A" designation. Commissioner Freeman advised the Planning Commission that with respect to Item D-60, the southeast corner of Fourth ,and Pine Streets, the building has been sold and as of the first of the . year, the church will no longer be located in this building. Ron Hough felt that the building would still be designated as Class "B", so no changes needed to be made at this time. Commissioner Freeman also noted that Item D-61, 418-420 East Pine Street, should include the veterinarian clinic which is also not permitted in a C-3 zone. 5) Subarea E - George Freeman It was the Planning Commission's decision that Item E-12, 49 Cedar Street, a single family unit on a 14,000 square foot C-2 lot, should be changed from a Class "B" designation to a C"-ass "A" designation. This decision was made based on the criteria that it has been sold and will be used for commercial purposes . Item E-24, 523 South Second Street, will be omitted completely since it .is now a doctor's office, which is an allowed use in the C-2 district. �. 6) Subarea F - Louise Novasad There were no questions with respect to Subarea F. Commissioner Novasad felt that all of the property owners for these three lots want to sell as commercial, so they should be left as Class "B" designation. Chairman Frederick called a five minutes recess at 9 :00 P.M. Chairman Frederick called the meeting back to order at 9:05 P.M. 7) Subarea G - Orrin Frederick No changes were made in the designations for Subarea G. Planning Commission Meeting City Hall Council Chambers November 3, 1981 Page Five However, it was brought to the Planning Commission's attention that Westside Lumber is using Glades Street for lumber storage. Chief Penicook was asked to check into the vacation ordinances to see what the status is on Glades Street. 8) Subarea H - Owen Christy Commissioner Christy felt that Items H-3 and H-4, Louisiana Pacific lumber storage, should have their descriptions changed to read "Lumber storage (nonconforming to M-1 limitations)", rather than "Lumber storage (not permitted in M-1 district)". All of the C-mmissioners agreed with this change. Also, Commissioner Freeman pointed out that some of the lots designated as vacant lands in the Flagstone Subdivision have since had homes built.on them. Chief Penicook will also make these changes . in Subarea H. 9) Subareas I 6 J - Louise Novasad There were no nonconforming uses in these subareas. MISCELLANEOUS MATTERS Mayor Don Jones thanked Orrin Frederick for taking over as Chairman of the Planning Commission. ADJOURNMENT Commissioner Novasad made a motion to adjourn the meeting, and Commissioner Himmelman seconded the motion. Roll call vote: Novasad, yes; Himmelman, yes ; Freeman, yes; Christy, yes. All Commissioners voted in favor of the motion to adjourn, and the motion carried. Chairman Frederick adjourned the meeting at 9:50 P.M.
