HomeMy WebLinkAboutAugust 4, 1981 Planning Commission Meeting City Hall Council Chambers August 4, 1981 MEETING CALLED TO ORDER The meeting was called to order at 7:05 P.M. by Vice-Chairman George Freeman. ROLL CALL Present were Commissioners George Freeman, Pat Himmelman, Louise Novasad, Dana Peters and R.B. Taylor. Also present were Mayor Don Jones, Councilmembers Donna Higginbotham and Ron Holmgren, City Administrator David Kucera and Fire Chief Dave Penicook. APPROVAL OF MINUTES July 21, 1981 Planning Commission Meeting A motion was made by Commissioner Himmelman to approve the Minutes as read. A second to the motion was made by Commissioner Taylor. All Commissioners voted yes and the motion was approved. CORRESPONDENCE There was no correspondence. PUBLIC APPEARANCES Vice-Chairman Freeman asked if anyone in the audience wished to appear before the Planning Commission who was not on the agenda. No one came forward. BUSINESS STONECREEK #2 Final Plat Review Developer, Mike Mahar, explained that he has completed the improve- ments to Stonecreek Subdivision #2 and is requesting Final Plat approval. Administrator Kucera explained that Public Works Superintendent Capps has not yet provided a written notice of approval on the construction on the Subdivision, and there is a concern about the grade of Chicory Lane, and the issue of where the buffer fences should be built has not yet been resolved. The Council will be reviewing a proposed ordinance that will enable a variance to the fence construction standards at their next meeting. A motion was made by Commissioner Himmelman to accept the Final Plat on Stonecreek #2 Subdivision subject to a final inspection being performed and determination that the improvements meet City standards and a Staff review being completed on Chicory Lane to Plann. Commission Minutes of Meeting 8/04/81 - page 2 determine that it meets the requirements of the original Prelimin- ary Plat approval, and a final resolution of the construction of the buffer fence being determined. A second to the motion was made by Commissioner Taylor. All Commissioners voted yes and the motion was approved. Public Hearina, Conditional Use Permit Arcade/Amusement Center Vice-Chairman Freeman opened the public hearing and read the des- cription of the application by Bob!, Becker for an arcade/amusement center located at 1254 North Third Street, Jackson County map page 37 2W 3AA, .Tax Lot 4400. This public hearing was continued from the Planning Commission' s previous meeting. Mr. Becker explained to the Planning Commission a need for recre= ation facilities in the area. He feels that the word "arcade" is not appropriate. A recreation center or an amusement center would be more appropriate. The lot in question right now is only being used for refuse. The adjacent residence would stay a residence. Off-street parking would be provided from the Fair City Market parking lot. There was a brief discussion on parking. Chief Penicook explained that the parking proposal was adequate for the C-zone which allo%s shared parking. Mayor Jones stated for the record that he owns the property in- volved in this application. He has leased it to Mr. Becker and whether or not the application is approved, makes no monetary difference to him. The Fair City Market is also leased from him by Mr. Becker. The property is controlled by Mr. Becker. There are 12 extra parking spaces in the Fair City Market parking area. Mr. Becker stated that if the amusement center becomes a hang-up he will immediately have it closed. There will be an inter-com line from the amusement center to the market. There are always two people at the store and the amusement center will have 100 percent supervision. A discussion followed on whether a parking lease was needed if the same person controlled both properties. Vice-Chairman Freeman felt that a parking lease was necessary because the decision should rest on whether or not the parking covers separate tax lots rather than whether or not the property is under one person ' s control. Vice-Chairman Freeman asked the Planning Commission if any members had a declaration of any conflicts of interests. There were none declared. The following Exhibits were entered into the record: Exhibit #1- the Conditional Use Permit application, Exhibit 42 - Notice-of advertisement, Exhibit #3 - a Vicinity map, Exhibit #4 - the Staff Report recommending approval, and Exhibit 45 - a Detailed map of the proposal. Plann. Commission Minutes of Meeting 8/04/81 - page 3 Mr. Becker explained further that the building would hold 12 to 15 machines. There would be no food or drink nor smoking allowed. The hours wuld not exceed the hours of Fair City Market. The market closes at 9 P.M. in the winter and 10 P.M. in the summer. Opening time for the amusement center would not be prior to 1 P.M. He has talked to the parents closest to the Store and have no objections to the project if it is supervised. A phone will be available for people to make calls into the amusement center. Vice-Chairman Freeman asked if there were any further proponents to speak. There were none. He asked for any opponents. There were none. He closed the Public Hearing for Planning Commission deliveration. A motion was made by Commissioner Himmelman to approve the proposed Conditional Use Permit with the condition that full-time supervision be provided. A second to the motion was made by Commissioner Taylor. All Commissioners voted yes and the motion was approved. 1068 Plan Review, Arcade/Amusement Center Vice-Chairman Freeman read a description of the proposed Plan Review for an arcade/amusement center located at 1254 North Third Street, Jackson County map 37 2W 3AA, Tax Lot 4400. The applicant is Bob Becker. Fire Chief Penicook explained the proposed site plan and his staff report. He reviewed the proposed map with the Planning Commission and note'a that the State Code requires 1 restroom. There was a discussion on the restroom. Chief Penicook noted that the restroom was required by State Code which can neither be exceeded nor reduced. Ingress and egress to the property would be from Tenth Street or Third Street through the Fair City Market parking lot. A motion was made by Commissioner Taylor to approve the 1068 Plan Review as 'presented. A second to the motion was made by Commissioner Himmelman. All Commissioners voted yes and the motion was approved. Public Hearing, Conditional Use Permit Arcade/Amusement Center Vice-Chairman Freeman opened the public hearing and stated that the application was for an arcade/amusement center located at 752 Hopkins Road, Jackson County map page 37 2W 11CA, Tax Lot 900 . He asked if any of the Planning Commissioner members wanted to declare any con- flicts of interest. There were no declarations . This Public Hearing was continued from the Planning Commission' s previous meeting. Chief Penicook presented the following Exhibits : Exhibit 41 - An advertisement of the public hearing which was continued to tonight's Planning Commission meeting, Exhibit 42 - The Conditional Use Permit application, Exhibit #3 - A Staff Report recommending approval, and Exhibit 44 - A Vicinity map of the area. Plann. Commission Minutes of Meeting 8/04/81 - page 4 Harold Ellis, representing the applicants, stated that the pro- posal would prohibit any food, drink or smoking on the premises. The hours would be from 12 Noon to 9 P.M. when they start the operation. There would be 2 restrooms. There will be a 20-space bike rack. He presented Exhibits #5, 6, and 7 which were pictures of the store. There will be no change machines. Change will be provided by attendants who will be there full-time. This space will also be a video room. He has found no opposition in this contacts with parents- in the area. There will be 19 to 21 machines in the building, and a phone will be available. Vice-Chairman Freeman asked`if there 'were any`further--proponents. There were none. He asked for any opponents. There were none. He closed the public hearing for Planning Commission deliberation. A motion was made by Commissioner Himmelman to approve the Condi- tional Use Permit as presented with the condition that full-time supervision be provided. A second to the motion was made by Commissioner Novasad. All Commissioners voted yes and the motion was approved. Public Hearing, Conditional Use Permit, Automotive Front-End Align- ment (Repair) Shop Vice-Chairman Freeman opened the Public Hearing and stated that th' owner/applicant Roy Bates was applying for an Automotive Front- End Alignment Shop in the 1100 Block of Beall Lane located on Jackson County map page 37 2W 11C, Tax Lot 4500. This Public Hear- . ing was continued from the Planning Commission' s previous meeting. He asked if there were any declarations of conflicts on the part of any Planning Commission members . There were none. Chief Penicook presented the following Exhibits: Exhibit #1 - The advertisement for the public hearing which was adjourned from the . previous Planning Commission meeting to tonight ' s meeting, Exhibit #2 - The Conditional Use application; Exhibit #3 - A copy of a Vicinity map; Exhibit #4 - The staff report which recommends approval. Chief Penicook stated that his Staff report did not propose includ- ing curb and gutter along the property because he has determined that it would be difficult to design the necessary elevations. Roy Bates told the Planning Commission that he was building the most expensive steel building available. It would be adequate in size and nice looking. It would be insulated with block construc tion for the back wall. The east wall would be a 1-hour fire-rat wall, and the other walls would also be insulated. Chief Penicook explained that there would be no tire sales planned. In fact, had tire sales been the predominant use, it would have been an outright use in this zone. He asked for any opponents . There were none. He closed the public hearing for Planning Commission deliberation. A motion was made by Commissioner Himmelman to approve the Condi- tional Use as proposed with the conditions that curb and gutter be placed by the applicant along Freeman Road at such time that First Street is paved. A second to the motion was made by Commissioner Novasad. All Commissioners voted yes and the motion was approved. 1068 Plan Review, New Construction Automotive Repair Shop Front- End Alionment Chief Penicook explained the proposed plans submitted by the appli- cant Roy Bates. Sewer connection would be to Bear Creek Valley Sanitary Authority. Water being provided by the Medford Water Commission due to availability at or near the property line. The applicant ' s engineer has proposed running asphalt continuously to the edge of the existing ditches. This would eliminate the 6-foot landscpaing strip but would provide better water runoff for storm drain. Mr. Bates felt that the continuous asphalt paved to the ditch would also look nicer. Vice-Chairman Freeman stated that he thought the applicant should provide sidewalks. Commissioner Novasad stated that there are no sidewalks across the street from the proposal and that most people would drive to do business at the shop rather than walk. There was a discussion on whether or not to include sidewalks in the proposal with consideration being given to the adjacent busi- nesses and whether or not they had sidewalks . A motion was made by Commissioner Himmelman to approve the 1068 Plan Review as presented and waive the 6-foot wide landscaping require- ment in the zoning regulations. A second to the motion was made by Commissioner Taylor. Administrator Kucera asked if the motion properly represented procedure for waiver of a zoning requirement and asked that a 10-minute recess be called in order to research the question. Vice-Chairman Freeman called a recess at 8:30 P.M. He called the meeting back to order at 8 :45 P.M. Chief Penicook explained that' the' Zoning Regulation requires a 6-ft. landscaping strip if parking was in the front yard. In this parti- cular proposal the front lot is defined as that portion bordering Freeman Road. Since the off-street parking is provided on Beall Lane side of the building, there is no requirement for the 6-foot landscaping as defined in Section 17. 46.050 Paragraph B of the Central Point Municipal Code Book. Plann. Commission - Minutes of Meeting 8/04/81 - page 6 Commissioner Himmelman withdrew the portion of her motion relating to landscaping. Commissioner Taylor agreed to withdraw that portion of the motion from his second. View The motion then became a motion to approve the -- _ --__e P as proposed. All Commissioners voted yes and the motion was approved. 1068 Plan Review, Commercial Modification Produce Sales Addition to Building Chief Penicook explained that Orlin Cartwright, owner/applicant, was requesting an addition to a building at 175 North First Street, Jackson County map page 37 2W 3DD, Tax Lot 6300. The 66-foot by 13-foot Addition would have overhead doors. The site plan and map were reviewed. The Planning Commission discussed the proposed ingress and egress: The number of parking spaces which were based on the sales area were determined to be adequate. The alley will be used for access to the loading area. Downspout drainage is also adequate. A motion was made by Commissioner Himmelman to approve the 1068 Pla� Review as presented. A'"`second to the motion was made by Commission Peters. All Commissioners voted yes and the motion was approved. Public Hearing, Conditional Use Permit Second Hand Store Vice-Chairman Freeman opened the public hearing and stated that Cecil Gatlin, applicant, wished to open a second hand store at 49 South Second Street, Jackson County map page 37 2W 10AA, Tax Lot 2900. This Public Hearing was continued from the Planning - Commission' s previous meeting. Vice Chairman asked for a declaration of any conflicts on the part of any of the Commissioners. There were none. Mayor Jones stated that Mr. Gatlin was home ill tonight, and that Virginia Wright would be representing him at tonight ' s meeting. Chief Penicook entered the following exhibits into the record: Exhibit #1 - Notice of the public hearing which was adjourned to tonight' s Planning Commission meeting from the previous Plann. Commission meeting, Exhibit #2 —Conditional Use Application, Exhibit 43 - A vicinity map, Exhibit #4 - The Staff Report which recommends approval. Mrs. Wright noted that the Conditional Use Permit request was withi a building which had a residential occupancy above it. The apt. un. above the proposed second hand store is rented' to another party. Plann. Vice-Chairman Freeman noted that the railing above the store was being used for a clothes line. Vice-Chairman Freeman asked if there were any further proponents. There were none. He asked for any opponents . There were none. He closed the public hearing for Planning Commission deliberation. A motion was made by Commissioner Taylor to approve the Conditional Use Permit with the condition that no objects be allowed outside the building for display or sale purposes unless proper permits have been received. A second to the motion was made by Commis- sioner Himmelman. All Commissioners voted yes and the motion was approved. Public Hearing, Conditional Use Permit, Second Hand Store Vice-Chairman Freeman opened the public hearing and stated that Kay Richey, applicant, was requesting a conditional use permit to operate a second hand store at 427 East Pine Street, Jackson County map page 37 2W 2CC,. Tax Lot 5500. Vice-Chairman Freeman asked for declarations of conflict. There were none. Chief Penicook entered the following items into the record as exhibits: Exhibit. #1- A notice of the advertisement for the public hearing, Exhibit #2 - The Conditional Use Permit publication, Exhibit #3 a vicinity map, Exhibit #4 - the Staff Report which recommended approval. Kay Richey stated that the proposed use was for a boutique which would sell used clothes, jewelry, knicknacks and other similar items. There would be a sign on the east side of the building and another sign in the window. Vice-Chairman Freeman asked if there were any other proponents. There were none. He asked for any opponents. There were none. He closed the public hearing for Planning Commission deliberation. It was noted that there are no offstreet parking requirements in the zone and there is employee parking available at the rear of the building. A motion was made by Commissioner Taylor to approve the Conditional Use permit as presented. A second to the motion was made by Commissioner Himmelman. All Commissioners voted yes and the motion was approved. I Plann. Commission Minutes of Meeting 8/04/81 - page 8 MISCELLANEOUS Fence Ordinance Administrator Kucera reviewed the proposed ordinance which the Council would be reviewing at their August 13th meeting. The ordinance will allow variances to the construction standards of the Fence Code. A motion was made by Commissioner Himmelman to recommend approval of the ordinance to the Council. A second to the motion was made by Commissioner Novasad. All Commissioners voted yes and the motion was approved. Commissioner Freeman's Absence Commissioner Freeman informed the Commission that he would be absent in the next two to three weeks. He was going to have a minor operation. ADJOURNMENT ' Vice-Chairman Freeman adjourned the meeting at 9 :25 P.M.
