HomeMy WebLinkAboutJune 2, 1981 Planning Commission Minutes June 2, 1981 City Hall Council Chambers MEETING CALLED TO ORDER Chairman Jean Hillyer called the meeting to order at 7:00 P.M. ROLL CALL Planning Commission members present were George Freeman, Pat Himmelman, Dewayne Hood, Louise Novasad and Dana Peters. Present were Mayor Don Jones and Council members Donna Higginbotham and Ron Holmgren. City Staff present were City Administrator Kucera and Fire Cheif Penicook. Also present was Rogue Valley Council of Governments Planner Ron Hough. APPROVAL OF MINUTES May 19 1981 Planning Commission Meeting A motion was made by Commissioner Himmelman to approve the minutes as written. A second to the motion was made by Commissioner Freeman. All Commissioners voted yes and the motion was approved. CORRESPONDENCE There was no correspondence. PUBLIC APPEARANCES Lanny Bogenoff, 927 Freeman Road Mr. Bogenoff explained that he has begun building a fence around his front yard. He is building the fence immediately behind the sidewalk and not on his property line. He was informed that he would have to stop building the fence and he was asking the Planning Commission if they could allow him to continue building the fence behind the sidewalk. He had attempted to make contact with the Building Department several times before beginning construc- tion but had not been able to do so. Mr. Penicook indicated that the Building Department had tried to contact Mr. Bogenoff Tuesday, May 26th, when the Department first became aware of a fence being built without a permit. They finally contacted him on Thursday, May 28th. A lengthy discussion followed regarding the City's fence ordinances. The history of why property lines were behind the sidewalk 1.5' to 20' in town was explained. An explanation was given why the variance procedure applies to building fences on the property line but not building within a public right-of- way. The purpose of City standard streets with an area being reserved for utility easements was reviewed. It was the general concensus of the Planning Commission that there were pre-existing fences in town which were building with- in the public right of way, that until the City ordinances were amended, the Planning Commission would have no authority to grant the construction of a fence behind a sidewalk in the public right-of-way. A motion was made by Commissioner Himmelman to deny the request to build a fence within the public right-of-way and to pass this recommendation forw,:rd to the City Council. A second to the motion was made by Commissioner Hood. All Commissioners voted yes with the exception of Commissioner Freeman who voted no, and the motion was approved. OLD BUSINESS There was no old business. NEW BUSINESS Fence Variances Request by George Francisco, -4010 Rock Way. Mr. Penicook stated that Mr. Francisco had pot paid his variance fee and had requested that the item be removed from the agenda. MISCELLANEOUS MATTERS There was a farther discussion on what the Planning Commission could do about the problems created by the existing fence regulations.
