Planning Commission Meeting Minutes February 17,, 1981 MEETING CALLED TO ORDER Chairman Jean Hillyer called the meeting to order at 7:00 P.M. ROLL-CALL Present were Planning Commission members Louise Novasad, George Freeman, Pat Himmelman, Dewane Hood and Theda Havice. City Staff present were Administrator David Rncera and Planner R. J. Ritchey. Also present were Mayor Don Jones, Councilmember Don Faber, Donna Higginbotham, and Ron Holmgren. Also present R.V.C.O.G. planner Ron Hough and C.A.C. Chairman Grace Russell. APPROVAL OF MINUTES It was noted an page 2 of the Minutes of February 31 1981 the Minutes did not name a second to the motion by Havice to approve the Final Plat of Stonecreek II. The Minutes should reflect that Himmelman seconded the motion. D AIso on page 2 "north from, Beall Lane along Chicory to the first turn" should be replaced with the words "that portion of Chicory Lane which borders Stonecreek Subdivision". A motion was made by Commissioner Himmelman to approve the Minutes as corrected. A second to the motion was made by Commissioner Havice. All Commissioners voted yes and the motion was approved. CORRESPONDENCE AND PUBLIC APPEARANCES Chairman Hillyer read a February 6, 1981 letter from Jackson County Dept. of PIanning and Development. The letter explained the Jackson County intent to change a parcel of land from R-5 to General Industrial. Planner Ritchey explained that the property was located west of the Southern Pacific railroad tracks. It is a parcel owned by Mr. Collins (lit. Pitt Company). He reviewed the Jackson County's proposed findings and conclusions. Ron Hough explained that the County's reasoning for making this amendment was because of a mistake in the original Comprehensive Plan. Chairman Hillyer requested that this matter be forwarded as an agenda item for discussion at the next meeting. Chairman Iiillyer asked if any members of the audience wished to speak before the Planning Commission. No one came forth. page 2 Planning Commission Minutes February 17, 1981 NEW 'BUSINESS Public Hearing for a Conditional Use Permit for a Home Occupation. Chairman Hillyer opened the public hearing and read the description of the application located at 290 Freeman Road. Proponent Byron Cordes II explained that he was asking for a home occupation for a part-time locksmith business. A one foot square sign would be placed in the front yard. He anticipated walk-in traffic of short duration on an occasional basis to have a key made. Planner Ritchey read his February 17, 1981 Staff report which recommended approval. He noted that notices had been posted in 4 public locations in the City including City Hall, Library and the Post Office. The Conditional Use Permit hearing had also been advertised in-the Mail Tribune newspaper on February 9th and on February 16th. It was not necessary, according to our ordinances, to notify adjacent land owners. By reference Planner Ritchey entered the documentation in his file into the record. Chairman Hillyer requested any Commissioners to declare any potential ex parte conflicts. There were no responses. Chairman Hillyer then asked for proponents and opponents in accordance with the established procedure for public hearings. None came forward. She then 1 closed the public hearing for Planning Commission deliberations. Chairman Hillyer read the Fasano Findings that were proposed by the applicant. A motion was made by Commissioners Hillyer to approve the Conditional Use Permit for a Home Occupation for a lock-smith business at 290 Freeman Road subject to the Staff Report and adopting the applicant's Findings. A second to the motion was made by Commissioner Freeman. All Commissioners voted yes and the motion was approved. 1068 Plan Review - Arcade Drive In 163 South Front Street Harvey Rueners explained his proposal for a 12 X 21 foot dry storage unit. He would have 1 light fixture and be built according to Codes. Its location would be near the northeast corner of the existing building. The existing building would remain in its present condition. There is approx. 38 ft. between the no. propertyline & the proposed building. Cars will be exiting using the alley as they have done in the past. About 30 parking places are available. The occupancy inside the restaurant is 62 people. Planner Ritchey read his February 17th, 1981 Staff Report and stated that the proposal would meet City's parking requirements and the construction would meet the Fire Codes. A motion was made by Commissioner Havice to approve the proposed plans subject to the Staff Report. A second to the motion was made by Commissioner Himmelman. All Commissioners voted yes and the motion was approved. page 3 Planning Commission Minutes February 179 1981 MISCELLANEOUS MATTERS Planner Ritchey indicated that he had met with Sue Messmer and Dick Halley to discuss the Planning Commission's proposed suggested changes to the teat of the Zoning Ordinance. Mayor Jones also attended a portion of this meeting. It was the concensus of this group that consideration should be given to adding the following businesses within the teat: Commercial condominiums, mini-warehouses, tire shops including recapping, auto body or paint shops, laundry and drycleaning plants. Chairman Hillyer stated that the Planning Commission cannot address every single possible business in adopting permitted uses in the teat and the Commission had previously agreed not to try to do this. She asked that Staff prepare a formal report addressing these businesses and present it at the March 3rd, 1981 Planning Commission meeting. Commissioner Havice agreed with Chairman Hillyer's statement. A motion was made by Commissioner Havice to adjourn the Planning Commission meeting. A second to the motion was made by Commissioner Freeman. All Commissioners voted yes and the motion was approved. Chairman Hillyer adjourned the meeting at 7:45 P.M. DK:ris
