January 20, 1981 - Planning Commission Meeting
Central Point Council Chambers
I. The meeting was called to order by Chairman Hillyer at 7:30 p.m.
II. Roll call found Chairman Hillyer and Commissioners Freeman, Novasad, Hood
and Himmelman present. Commissioners Dixon and Havice absent. Others
present were Mayor lion Jones, City Administrator Dave Kucera, Building
Official/Planner R.J. Ritchey, Council Members Donna Higginbotham and Judi Miller,
Planning Commission Jecretary Georg Stotler-de Ruyter and several interested citizens.
III. Addition to the January 6, 1981 Planning Commission Meeting Minutes, page 4,
paragraph 2, line 1, Commissioner Freeman seconded motion to adopt Resolution
#24 as read; correction to above Minutes, page 4, Section VI, paragraph 7,
line 2, "and" should read "any"; page 7, paragraph 1, line 6, "from" should read "of".
Motion by Himmelman, second by Freeman to approve the Minutes of the January 6, 1981
Planning Commission Meeting with corrections and addition. Roll call vote found all
in favor, motion carried.

A. Public Hearing - Conditional Use Permit, Wholesale in C-2 Zone.

Chairman Hillyer read a description of the Public Hearing Procedure and opened the
Public Hearing.
Building Official/Planner R.J. Ritchey read a description of the application into
the record and the notice provided of the hearing.
Commissioner Himmelman, Freeman, Novasad and Hood stated they had ex parte contact.
Chairman Hillyer explained that in ®ses of ex parts contact, the member or members
involved must excuse themselves, however, as the withdrawal of all the above members.
would result in a lack of a quorum, the members can be called back to participate.
Building Official/Planner Ritchey presented the Staff Report, stating that the
application meets the requirements of the Municipal Code; that the construction
drawings submitted meet U.B.C. regulations; recommended the Conditional Use Permit
be approved; read the draft Resolution #25 and itemized the exhibits.

Doug Pfaff, 4630 Hamrick Road, Central Point, appeared and stated that the applicant
would be late as he was not aware of the change of time of the Planning Commission
Meeting.
Chairman Hillyer stated that if the applicant is not present the Planning Commission
ustomarily does not consider the application.
Doug Pfaff suggested that he call the applicant, who could be present in minutes.
Chairman Hillyer called a 5 minute recess at 7:15 p.m.
Meeting called back to order by Chairman Hillyer at 7:20 p.m.
Don Pfaff, Applicant, 4123 Sunland, Central Point, stated that he plans to build a
32 by 30 foot building addition for storage of wholesale fishing tackle and light
sporting goods at 26 E Pine Street in the C-2 'Lone; and, that he felt the details
had been covered at previous meetings.
No one came forward in opposition.
Chairman Hillyer asked Mr. Pfaff if he planned on using the front parking spot along
Pine Street and, if so, if he had access through his own property and expressed
concern that trucks would park there.
Mr. Pfaff answered that he now uses that area for unloading, but the construction
of the addition will include a loading door at the rear.
Chairman Hillyer closed the Public Hearing for Planning Commission deliberations and
discussion.
Motion by Himmelman, second by Freeman to adopt the applicants findings of fact.
Roll call found all in favor, motion carried.
Motion by Freeman, second by Novasad to approve this Conditional Use Permit
application,subject to the Staff Report. Roll call vote found all in favor, motion
carried.
Motion by Freeman, second by Novasad to approve Resolution #25, A Resolution of
Planning Commission Approval of a Conditional Use Permit to Allow Limited Wholesaling
of Fishing Tackle and Light Sporting Goods at 26 East Pine Street in the C-29
Commercial General District of the City, as read. Roll call vote found all in favor,
motion carried.
B. 1068 Plan Review - Building Addition

Building Official/Planner Ritchey presented the.Staff Report stating that this

application is to construct a 30 by 32 foot storage addition for the wholesaling
of fishing tackle and small sporting goods; that limited wholesaling is allowed as
a Conditional Use in the C-2 Zone; that this proposal was within the limitations for
the Conditional Use; and, that the construction drawings and plot plan meet all
U.B.C. and City Codes.
Don Pfaff, Applicant, 4123 Sunland, Ceatral Point commented on item 05 of the Staff
Report regarding piping all surface drainage including roof drains to Pine Street
stating, that cutting the sidewalk and piping the drainage is a lot of extra expense
to go to as his building and others around it have been dumping their roof drains
onto the paving for years.
Building Official/Planner Ritchey stated that the Municipal Code says it is illegal
to drain rain water across a sidewalk.
Mr. Pfaff asked what section of the code read so, and when it was adopted.
Building Official/Planner Ritchey stated that it was about 1964.
Discussion.
O Chairman Hillyer read Section 8.04.070 Drainage of surface waters; and stated that
Mr. Pfaff's addition is compounding the problem of drainage.
Building Official/Planner Ritchey explained the plot plan and construction drawings
showing gutter locations.
Commissioner Freeman stated that he thought the gutter size was too small to handle
the water from a building of this size, if both sides of the building were piped
together; and that he thought Mr. Pfaff might have to make two cuts across the
sidewalk.
Commissioner Himmelman commented on item #5 of the Staff Report stating that she
agreed with Building Official/Planner Ritchey' s statement that the only way the
City can upgrade buildings is by attaching conditions to a construction phase of
the property.
Motion by Himmelman, second by Hood to approve this 1068 Plan Review of a Commercial
Building Addition at 26 East Pine St, subject to the Staff Report. Roll call vote
found all in favor, motion carried.
VI. New Business
A. 1068 Plan Review - Classroom Addition

to develop in two phases: Phase I includes two classrooms, two offices and restroom
facilities; Phase II will be a gymnasium and classroom addition. Mr. Grimes
concluded by presenting the construction drawings and a plat with the phases shown.
Building Official/Planner Ritchey presented the Staff Report stating that the
proposed structure will attach to the existing building by continuing the roof to
form a covered walkway; that the construction plans have recieved approval from
the Fire & Life Safety Plan Review Board; that the project complied with all
Municipal Code requirements; and recommended approval.
Commissioner Freeman asked how many new students would the two new classrooms handle.
Gail Hammond, Board Member/Assembly of God Church, stated that the facility Is for
30 students, but that some of the 30 places will be taken by students moving from
the existing old house, so the result will not be a 30 student increase.
Commissioner Himmelman asked if Phase I will be a complete project in itself.
Ron Grimes answered that it will be.
Motion by Freeman, second by Novasad to approve this 1068 Plan Review of a classroom
addition for the Assembly of God Church at 310 N 10th St, subject to the Staff Report.'

B. Public Hearing - Conditional Use Permit, Wholesale in C-2 'Lone

Lowell Fronek, Applicant
Chairman Hillyer stated that the procedure for the conduct of a Public Hearing,
read previously in this meeting, would be observed in this case also;and opened
the Public Hearing.
Building Official/Planner Ritchey read a description of the application, stating
that it is for a Conditional Use Permit to allow limited wholesaling in conjunction
with a retail seafood market, and read the notice provided of this Public Hearing
into the record.
There were no declared conflicts of interest or ex parte contact.
Building Official/Planner Ritchey presented the Staff Report stating that limited
wholesaling is allowed as a conditional use in the C-2 Zone, that the proposal was
within the limitations for the conditional use; met all applicable sections of the
Municipal Code; and recommended approval.
Mr. Ritchey then presented the findings of fact submitted by the applicant stating
that said findings adequately addressed all applicable sections of Chapters 17.36
and 17.76 of the Municipal Code to Staff's satisfaction.

Commissioner Himmelman asked if the odors from the crab pot were to be controlled.
Building Official/Planner Ritchey stated that as he understood it the filters to
be used stop not only steam, but odors.
Building Official/Planner entered the exhibits into the record.
Lowell Fronek, applicant, 3478 New Ray Road, Central Point stated that the uses
around the proposed seafood market are all wholesalers and he would be adding to
the wholesale uses in the area; that the freezers and coolers are in place and
operational; that he has a City Retail Business License and an Agricultural Dept
Permit; and that the crab pot installation has been approved by the Health Dept,
Fire Marshal and Dept of Agriculture.
No one came forward in opposition,
Mr. Fronek questioned the 10,000 GVW and if there was a limit to the storage
capacity allowed.
Building Official/Planner Ritchey explained the 10,000 GVW related only to loading
0 trucks from Mr. Fronek's facility, not unloading of deliveries, and that no limit
as to amount of storage had been set.
Chairman Hillyer asked what was to be done with the wastes.
Mr. Fronek answered that liquid wastes will go into the sanitary sewer and the
solids will be frozen until picked up by a sanitary service.
Commissioner Freeman asked what kind of vehicles Mr. Fronek uses for his business.
Mr. Fronek answered that he used a 9500 GVW, 314 ton ice van and a 6800 GVW, 1/2
ton ice van.
Chairman Hillyer closed the Public Hearing for Planning Commission deliberations.
Motion by Himmelman, second by Hood to adopt and approve the findings of fact as
presented. Roll call vote found all in favor, motion carried.
Motion by Himmelman, second by Novasad to approve this Conditional Use Permit
application subject to the Staff Report and findings of fact. Roll call vote
found all in favor, motion carried.
Chairman Hillyer read Resolution #26, A Resolution of Planning Commission Approval
of a Conditional Use Permit Application to Allow Limited Wholesaling and Storage
of Seafood at 112 North Front Street in the C_2, Commercial General District of
the City, into the record.
Motion by Hillyer, second by Freeman to approve Resolution #26 as read. Roll call
vote found all in favor, motion carried.

C. Public Hearing - Conditional Use Permit, Church in C-3 Zone

Virgil Osborn, Applicant
Building Official/Planner Ritchey stated that Mr. Osborn had called and asked
that his application be kept in abeyance until the City can officially act on his
application as churches are not included in the conditional uses in a C-3 Zone at
this time.
VII. Miscellaneous Matters
A. Chairman Hillyer stated that Commissioner Joy Dixon had informed her
that she no longer had the time to participate and asked that Chairman
Hillyer so inform the Council and appoint someone in her place.
Recess called by Chairman Hillyer at 8: 50 p.m. for 10 minutes.
B. Chairman Hillyer called the meeting back to order at 9:00 p.m.; stated that a
study of the City Zoning and Comp Plan Map Designations would ensue; and, asked '
for input from those present.
Building Official/Planner Ritchey displayed a City Map stating that the Planning
Commission had previously decided to extend the C-2 and C-3 Zones to 7th Street and
extend the C-2 Zone on the north side of Pine Street one-half block further north.
Mr. Ritchey continued, stating that the Planning Commission had also considered
changing a one-half block strip along the east side of Front Street, north of Pine
Street from C-2 to LC-LI, however, the Municipal Code states that set-backs from
residential areas to LC-LI uses are to be 40 feet, so the lots in question would
be unbuildable.
Chairman Hillyer suggested changing the 40 foot set-back as the existing uses are
already of the LC-LI type and the set-backs are not 40 feet; and suggested that if
the set-back were reduced to 10 feet, the alley could be the set-back.
Building Official/Planner stated that Section 17.53.050 states that there shall be
a buffer set-back of 40 feet contiguous with Single Family Residential areas; therefore
this may not apply in this case; and, that the set-back is measured from the property
line not the center of an alley or street, except in determining separation for fire
protection purposes.
Question from the audience regarding notifying the people who own the property about
these proposed zone changes.
Citizen Advisory Committee Chairman Russell stated that a major concern is with
home owners, but we are also concerned with providing places for businesses to
locate in the City and have developed the Comp Plan and Map as a guide for this
to happen.

Discussion
Chairman Hillyer read the permitted uses in the LC-LI Zone and suggested adding
a new zone.
Building Official/Planner Ritchey quoted from the Handbook of Zoning stating
"the smaller the number of districts, the better."
Chairman Hillyer stated that the purpose of zoning and zones should be discussed
at the next study session.
VIII. Motion by Hood, second by Himmelman to adjourn. Roll call vote found all
in favor, motion carried. Adjournment came at 10:07 p.m.
