HomeMy WebLinkAboutJanuary 6, 1981 Minutes January 6, 1981 - Planning Commission Meeting Central Point Council Chambers I. The meeting was called to ordez by Chairman Hillyer at 7:30 p.m. II. Roll call found Chairman Jean Hillyer and Commissioners Theda Havice, George Freeman, Louise Novasad, Dewane Hood, Pat Himmelman present. Commissioner Joy Dixon absent. Others present were Mayor Don Jones, City Administrator Dave Kucera, City Council Members Ron Holmgren, Judi Miller, Donna Higginbotham and Don Faber, Building Official/Planner R.J. Ritchey, Citizens Advisory Committee Chairman Grace Russell and Planning Commission Secretary Georg Stotler-de Ruyter. III. Corrections and additions to the December 16, 1980 Planning Commission Minutes included the following: 1) Page 1, Section IV, line 9, change "7:30" to read "7:45"; 2) Page 2, paragraph 4, line 1, should read "Mr. Ritchey continued"; 3) Page 4, paragraph 11 should read "have no more business than a church locating"; 4) Page 7, paragraph 11, should read "motion by Freeman, second by Himmelman." Motion by Himmelman, second by Freeman to approve the Minutes of the December 16, 1980 Planning Commission Meeting with corrections. Roll call vote found all in favor, motion carried. IV. A. No Correspondence B. No Public Appearances V. Old Business A. Planning Commission Resolution #22, A Resolution of Recommendation To Approve the Franek Annexation Request. Chairman Hillyer read Resolution #22 into the record, discussion followed. Motion by Himmelman, second by Novasad to approve Resolution #22, A Resolution of Recommendation To Approve the Franek Annexation Request, as written. Roll call vote found Chairman Hillyer and Commissioners Havice, Freeman, Novasad and Himmelman in favor, Commissioner Hood abstained. Majority in favor, motion carried. B. Planning Commission Resolution # , A Resolution of Planning Commission Intent to Amend the Text of the 'Loving Ordinance Deleting and Adding Conditional Uses in the C_2, Commercial General District of the City. C. Planning Commission Resolution #_, A Rsolution of Recommendation to Amend the Text of the Zoning Ordinance Deleting and Adding Conditional Uses in the C_2, Commercial General District of the City. Chairman Hillyer stated that the Planning Commissions intention to delete Mobile Home Parks and add churches and similar religious institutions to the C-2 'Lone Minutes Planning Commission Meeting January 6, 1981 - Page 2 would have to be considered after proper advertising, but the addition of limited wholesaling could be considered tonight as it was advertised on December 8 and December 15, 1980 for the December 16, 1980 Planning Commission Meeting and was tabled at that time until further study was completed. Planning Commission Secretary Stotler-de Ruyter explained that the notice published in the Mail Tribune regarding the above changes had been determined to be not specific enough and would have to be re-written and re-advertised. Chairman Hillyer read Resolution #23, A Resolution of Planning Commission Intention To Amend the Text of the Zoning Ordinance Adding Limited Storage and Limited Wholesaling of Goods as a Conditional Use in the C_2, Commercial General District of the City; into the record and asked for Planning Commission comments on the definition of limited included within the Resolution. Commissioner Himmelman asked how Section 17.64.030(G)(2) , referenced in Resolution #23,read. Chairman Hillyer read the above section stating: "Wholesale establishments, warehouse, freight depot. Two spaces for every three employees on the two adjacent shifts or one space for every 1000 sq.ft. which ever is greater." Motion by Freeman to delete sub-section A. Mobile Home Parks from Section 17.36.030 and add churches and similar religious institutions to said section. Building Official/Planner Ritchey stated that the motion was out of order as it had been determined earlier in this meeting that until proper advertising, this item could not be considered. Commissioner Freeman withdrew motion. Commissioner Havice asked City Administrator Kucera if the Planning Commission needed to pass a resolution of intent to amend the text at tonights meeting in order to consider a change at the next Planning Commission Meeting. City Administrator Kucera stated that Building Official/Planner Ritcheys point is that sub-section D of Section 17.36.030 is what is under consideration at this time, and continued, that later in the meeting would be the proper time to consider further amendments, and that the resolution of intent would be considered at the next meeting. Commissioner Havice adked if sub-section(D)(1)(e) of Section 17.36.030 is not too general. Building Official/Planner Ritchey stated that by including this provision, the Planning Commission still has a way to control the conditional use if it is found in the future that the conditions stated are not adequate. Commissioner Himmelman asked for a description of a 10,000 pound gross vehicle weight (GVW) vehicle. City Administrator Kucera stated that the State Highway Dept describes it as a ) Minutes Planning Commission Meeting January 6, 1981 - Page 3 a single axle vehicle with single wheels in the rear, and continued, stating that the items being considered are suggestions to the Planning Commission as possible definitions of limited and puts some severe restrictions on the type of wholesale business that could operate In that zone. Commissioner Havice asked if refrigerated trucks perhaps would weigh more than the 100000 GVW specified. City Administrator Kucera answered that he did not know, but that it was possible. Commissioner Hood asked how the maximum area of 3300 sq.ft. was arrived at. City Administrator Kucera answered that Mr. Pfaff's building will be 3040 sq.ft. with the proposed addition. Commissioner Himmelman asked if this change to the text will take care of Fronek Seafoods, Building Official/Planner Ritchey stated that it would. Chairman Hillyer read Section 17.36.030 MUM) regarding parking requirements and asked for comments. City Administrator Kucera stated that the intention is to protect the integrity of the retail zon=; that the thought had occurred to Staff that off-street parking in the C-2 Zone could effectively disappear with the advent of a number of wholesale businesses, thus the requirement for parking according to Section 17.64.030(F) and 17.64.030(G)(2). Chairman Hillyer stated that what it is saying is that the proposal must conform to retail parking requirements unless it was a pre-existing use. Discussion. Chairman Hillyer stated that before the Planning Commission votes on this matter they should consider what they are doing to the C-2 Zone. Commissioner Himmelman stated that she felt the Planning Commission had discussed this previously. Commissioner Freeman stated that he felt the subject had been thoroughly discussed. Commissioners Havice and Novasad stated that they agreed with the other Planning Commission Members. Motion by Freeman, second by Havice to approve Resolution #23, A Resolution of Planning Commission Intention to Amend the Text of the Zoning Ordinance Adding Limited Storage and Limited Wholesaling of Goods as a Conditional Use in the C-2, Commercial General District of the City as read. Roll call vote found Chairman Hillyer opposed, Commissioners Havice, Freeman, Novasad, Hood and Himmelman in favor. Majority in favor, motion carried. a � Minutes Planning Commission Meeting January 6, 1981 - Page 4 Chairman Hillyer read Resolution #24, a Resolution of Planning Commission Recommend- ation to Amend the Text of the 'Zoning Ordinance Adding Limited Storage and Limited Wholesaling of Goods as a Conditional Use in the C-2, Commercial General District of the City, into the record. Discussion. Motion by Havice to adopt Resolution #24 as read. Roll call vote found Chairman Hillyer opposed, Commissioner Havice, Freeman, Novasad, Hood and Himmelman in favor. Majority in favor, motion carried. Five minute recess called at 8:30 p.m. by Chairman Hillyer. Meeting called back to order at 8:35 p.m. by Chairman Hillyer. VI. New Business A. Planning Commission Review of current City Zoning and the 'Zoning Designations on the Central Point Comprehensive Land Use Plan Map. Commissioner Havice asked since the City has already adopted the Comp Plan Map, what is the Planning Commission bound to. Building OfficiallPlanner Ritchey stated that the Planning Commission can ,hake minor changes at this time. Council member Judi Miller stated that the Council would like to see the A & B classifications, as discussed at previous meetings, implemented; especially for the residences located in the C-2 Zone. Commissioner Himmelman stated that she would not feel good about establishing commercial zonea without that provision. Building Official/Planner Ritchey stated that Ron Hough had loaned him a book that addresses that subject extensively, and continued, stating: Class A. A person may make application to improve or perhaps build an - addition; Burden of proof is on the applicant; the Planning Commission can allow improvements as they see fit; and a person may apply for a variance. Class B. Structures are frozen as is. In this manner structures that are unsound could be phased out as the owners would not be allowed to repair, re-construct or add to the buildings. Council Member Higginbotham asked if a person with a building of the "B" class had and recourse to challenge the classification. Commissioner Himmelman stated that a lot of people would have no idea of the meaning of the A & B classifications. Minutes Planning Commission Meeting January 6, 1981 - Page 5 Commissioner Freeman stated that he felt the people affected should be notified before changing the zones. Chairman Hillyer asked Building Official/Planner Ritchey if he would research the A & B Class system and report his findings at the January 20, 1981 Planning Commission Meeting, and asked the Planning Commission which area of the City Zoning they would like to discuss tonight. Commissioner Freeman stated that he would like to see the C-3 Zone continued to Front Street. Building Official/Planner Ritchey stated that if this area is changed to C-3, no off-street parking would be required. This could result in no off-street parking in the downtown area in the future. Commissioner Freeman asked if the Planning Commission did not discuss extending the LC-LI `Lone through that area along the intersection of Pine Street and Front Street. Commissioner Himmelman stated that it had been discussed, however at that time it was brought out that this is the entrance to our town and should be maintained as a commercial area. Commissioner Havice asked Commissioner Himmelman if her suggestion was to extend the C-4 Zone from 7th Street to the Freeway, and stated that she feels there arc uses included in the C-4 Zone that she would not like to see locate in that area. Commissioner Havice read the permitted uses in the C-4 Zone. Chairman Hillyer read the conditional uses in . the C-4 Zone. Building Official/Planner Ritchey read the purpose of the C-3 Zone, to cater to the walking public; and the purpose of the C.4 Zone, to serve vehicular traffic. Commissioner Havice stated that she does not feel the C-4 area near the Freeway interchange will develop with uses oriented to vehicular traffic, but walking traffic. Grace Russell, Chairman of the Citizens Advisory Committee stated that the intent of zoning that area C-4 originally was to attract motels, restaurants and that type of uses; and that it was thought the existing apartments would convert to motels as the City grows. Building Official/Planner Ritchey stated that there are a number of older houses on the south side of Pine Street; that "main street" cannot remain residential; and that within a few years Pine Street will be four lanes across the freeway. Commissioner Havice commented on the deterioration of the motel area located along Riverside in Medford; and stated that she felt the City should provide for the citizens and pedestrian traffic. Chairman Hillyer stated that the motels along Riverside were built when that was Minutes Planning Commission Meeting January 6, 1981 - Page 6 the highway and that once the freeway was built the motels and restaurants moved. Council Member Don Faber stated that he owned some property out by the interchange and that there has been no development there. City Administrator hucera stated that there has been continual activity centered around that interchange; motels, hotels and chain restaurants have been inquiring and that so far, lack of an ability to purchase property has been the major deterrent. Commissioner Himmelman stated that 7th Street seems the logical place to make the boundary between C-3 and C-4. Building Official/Planner Ritchey suggested the Planning Commission keep in mind that the C-4 Zone does have parking requirements. Grace Russell, C.A.C. Chairman stated that she had a problem with Mobile Home Parks in the C_4 'Lone. Chairman Hillyer stated that she thought uses on the west side of the freeway could be commercial/tourist and on the east side be totally tourist oriented. Mayor Jones stated that he thought the uses of a zone should be discussed and then ' the boundaries. Chairman Hillyer suggested an additional zone for overnight RV camping. Mayor Jones suggested that he would like to limit that type of use to the northeast area of the interchange so the travelers can get to the fairgrounds safely and easily. Commissioner Himmelman stated that she would agree with overnight camping but not Mobile Home Parks in the C-4 'Lone as Mobile Home Parks are residential uses not commercial. Discussion. Commissioner Freeman suggested the Planning Commission continue discussing the zoning along Front Street south of Pine Street at the January 20, 1981 Planning Commission Meeting. Motion by Freeman, second by Himmelman to continue the December 16, 1980 motion to delete Mobile Home Parks from Section 17.36.030 and add churches and similar religious institutions to said section. Mayor Jones stated that churches in C-2 Zone pay no taxes and revenue must be considered when planning for the City; that the area being discussed is prime downtown property; and that he thought a new zone should be created for churches. Commissioner Himmelman retracted her second. Motion died for lack of a second. Minutes Planning Commission Meeting January 6, 1981 - Page 7 Motion by Hillyer, second by Havice to delete Mobile Home Parks from C-2 and C-4 "Zones and instruct Staff to draft a Resolution of Intent and a Resolution of Recommendation to that effect. - Roll call vote found Chairman Hillyer and Commissioners Havice, Hood and Himmelman in favor; Commissioner Novasad opposed, Commissioner Freeman opposed due to deletion from C-4 Zone. Majority in favor, motion carried. Motion by Havice, second by Novasad to begin future Planning Commission Meetings at 7:00 p.m. and to end no later than 10:00 p.m. with a provision to extend meeting for one hour by a two-thirds vote of the members present; and to meet on the first and third Tuesdays of each month. Roll call vote found all in favor, motion carried. Chairman Hillyer stated that Section 2.16.050 of the Central Point Municipal Code instructs the Planning Commission to appoint a Chairperson and Vice-chairperson at their first meeting of a new year, and called for nominations. Motion by Hood to keep the same chairman and vice-chairman for another year. No second, motion died. Theda Havice nominated for chairman by Freeman, no second. Motion by Hood, second by Freeman that the officers be left as is for 1981. Roll call vote found all in favor, motion carried. VII. Miscellaneous Matters A. Commissioner Freeman stated that he thought a study needs to be made regarding locating churches in temporary quarters and that an attempt be made to establish an area where this is allowed. Mayor Jones stated that he could see no problem with the church meeting at 414 E Pine Street as long as the Fire Dept had no problems with it; and stated that he is going to endeavor to re-activate the Economic Development Committee part of who's work would be to investigate areas for churches, lodges, etc. to locate or relocate, freeing downtown commercial property. Council Member Higginbotham stated that she thought the large older houses would be ideal places for churches and lodges to locate as they are already allowed in the R-3 Zones. Mayor Jones stated that he had heard the church plans on purchasing the property and building a church building. Commissioner Freeman answered that the church does want to buy the property, but intends to keep it temporarily and then sell it for capital gains. Council Member Higginbotham asked if the schools do not allow churches to meet in them. Chairman Hillyer answered that a number of them do allow this. Minutes Planning Commission Meeting January 6, 1981 - Page' 8 Building Official/Planner Ritchey stated that if the City is going to allow churches as a conditional use in the C_2 Zone, there must be a time limit put on it as the person abtaining a conditional use permit can apply for a building permit resulting in the conditional use becoming permanent. Chairman Hillyer asked Building Official/Planner Ritchey if he would prepare a report on the above topic. Building Official/Planner Ritchey stated that he would. VIII. Motion by Hillyer, second by Havice to adjourn. Roll call vote found all favor, motion carried. Adjournment came at 10:45p.m.
