December 2, 1980 - Planning Commission l:eeting
Central Point Council Chambers
I. The meeting was called to order by Chairman Hillyer at 7:35 p.m.
II. Roll call found Chairman Jean Hillyer and Commissioners George Freeman,
Louise Novasad, Dewane Hood and Pat Himmelman present. absent were
Commissioners Theda Havice and Joy Dixon. Others present were City
Administrator Dave Kucera, Building Official/Planner R.J. Ritchey, City Council
Members/ Ron Holmgren and Judi Miller, Council l:ember Elect/Donna Higginbotham,
Planning Commission Secretary Georg Stotler-de Ruyter and several interested
citizens.
III. Minutes of the November 18, 1980 Planning Commission Meeting will be
reviewed at the December 16, 198C Planning Commission Meeting.
IV. A. No Public Appearances
B. Correspondence
1) Chairman Hillyer presented a letter from SOSO regarding a student
0 study on LCDC acceptances. Motion by Novasad, second by Ilimmelman
to direct the enclosed questionaire to Building Official/Planner
Ritchey to be completed and returned to originator.
Roll call vote found all in favor, motion carried.
V. Old Business
A. Review of Resolution # , A Resolution of Intent to Amend the Text
of the 'Zoning Ordinance to Allow Certain Additional Uses in the
Commercial and Industrial Zones of the City.
B. Review of Resolution # , A Resolution of Recommendation to Amend
the Text of the Zoning Ordinance To Allow Certain Additional Uses In the
Commercial and Industrial Zones of the City.
Items A & B were moved to a later place on the agenda at the suggestion of Chairman
Hillyer so that those people in the audience having business with the Planning
Commission would not have to sit through the zone change discussion.
VI. New Business
A. Final Development Plan - The Village P.U.D.

Village Joint Venture, Applicant
Robert Blanton, 130 W 9th, Medford, Project Engineer for the Village presented
the Final Development Plan stating that all of the changes requested by the City

have been made and have been approved by City Staff.
Building Official/Planner Ritchey stated that Exhibit "A" is a copy of the
approved Final Construction Drawings and Exhibit "B" is a list of additional
conditions required by Staff.
Mr. Ritchey explained item Ykll of Exhibit "B" stating that on December 4, 1950
the developers of the "Meadows", the "Village" and "Suburban" will meet to
determine the fair shares for the storm drainage system under the 1-5 Freeway.
Mr. Ritchey also explained that a letter of agreement exists from Bud Adler to
the City agreeing to item #13 of Exhibit "B" , re-imbursement to the Meadows of
one/half the cost of the 12 inch sanitary sewer through the Meadows that serves
the subject property.
Bob Blanton stated that a problem exists regarding the question of allocating the
fair share of the Meadows Storm Drain; that this is an area that will take some
negotiation; and that the developers of the "Village" while agreeing to pay a fair
share, do not necessarily agree to pay half.
Building Official/Planner Ritchey comented on the somewhat open-ended development
schedule stating that this is not intended to be a phased project; that it will
take approximately 90 working days to get the underground and the streets in; and
that once started the developers intend to keep going until completion or until
the weather prohibits any further work.
Bob Blanton asked if it might be appropriate to put a time limit on the development
of perhaps 6 or 7 months.
Building Official/Planner Ritchey stated that it would likely be in order for the
Planning Commission to put a time limit on it with the option of an extension,
for just cause, if necessary; and, that the applicants would need to come back to
the Planning Commission for said extension.
Chairman Hillyer agreed that it was a reasonable request with perhaps July as the
deadline with a provision for extension.
Discussion followed.
Bob Blanton clarified the discussion, stating that the time limit will be to
complete the engineering construction and prepare the site for the construction
of the dwellings.
Building Official/Planner Ritchey stated that items a-e on page 1 of the Village
P.U.D. Agreement would be constructed within this time limit. These included:
a) Water, sewer and storm drainage, b) Street excavation, base rock & surfacing,
c) Curbs and gutters, d) Sidewalks, e) Street lights and underground utilities.
Commissioner Freeman asked if a two year warranty period was standard for the
streets and other improvements.

11otion by Himmelman, second by Novasad to recommend approval of the Final
Development Plan for the "Village" Planned Unit Development, subject to the
approval of the City Council and the City Attorney, with a time limit for
completion of the engineering construction to July 1, 1981 with an option for
extension for just cause.
Roll call vote found Chairman Hillyer and Commissioners Freeman, Novasad and
Himmelman in favor, Commissioner Hood abstained. Majority in favor, motion
carried.
B. Review of Resolution 021, A. Resolution of Recommendation of Approval
of the Final Development Plan for the "Village" Planned Unit Development.
Chairman Hillyer read Resolution #21 into the record.
Motion by Novasad, second by Freeman to adopt Resolution #21, subject to the
approval of the City Council and City Attorney, and forward it to the City Council.
Roll call vote found Chairman Hillyer and Commissioners Freeman, Novasad and
Himmelman in favor, Commissioner Hood abstained. N.ajority in favor, motion carried.
V. Old Business

the Commercial and Industrial Zones of the City.
Chairman Hillyer briefly discussed the above Resolutions and asked Building Official/
Planner Ritchey for some direction for tonights review.
Building Official/Planner Ritchey stated that it is a new ball game; that the
Municipal Code needs to be examined periodically and updated; and that now would
be a good time to begin.
Mr. Ritchey commented on the proposal of limited wholesale in the C_3 district
and asked how, if approved, that would be controlled; and suggested that the
Planning Commission might want to further define what limits would be imposed.
Chairman Hillyer stated that before that, the intent and purpose of the zone
needs to be considered and that the stated intent is to promote foot traffic and
pedestrian type commercial operations.
Building Official/Planner Ritchey stated that Ron Hough from RV000 was in the
audience and volunteered his services to answer questions.
Ron Hough, RVCOG, stated that the main intent of the central commercial district
is retail trade, convienience shopping and services with the greatest emphasis on
pedestrian traffic, typically located along main arterials.

Chairman ilillyer asked why 11obile Home Parks are conditional uses in C_2 Zone.
Building Official/Planner Ritchey stated that as residential uses ere not allowed
he thinks it is way out of line to incluee it even as a conditional use; that he
could possibly agree with allowing overnight trailer parking, but not residential
uses.
Ron Hough stated that Mobile Home Parks have traditionally been considered a
commercial use and cities have attempted to keep Nobile Home Parks out of residential
areas, and that this could be a carryover.
Commissioner Himmelman stated that if residential uses are non-conforming uses in
C-2 zones, then none of the homes in the new C_2 areas could be enlarged or altered.
Building Official/Planner Ritchey stated that was correct (Section 17.56.010(B)) .
Commissioner Himmelman stated that the city needs to plan for the people who
will be living in that area for the next 20 years as most of these homes are not
ready to be demolished.
Building Official/Planner Ritchey returned to the tonic of wholesaling in commercial
areas stating that lie thinks that wholesaling outright in a C_2 zone violates the '
intent of the zone as it does not generate pedestrian traffic; and that there are
areas in which retail/wholesale could go in, but not in C-2 zone.
Chairman Hillyer asked Ron Bough what the procedure was to change some of the
commercial district to LC-LI on the Comp Plan Nap; and if it would be a major or
a minor change.
Ron Hough stated that it would be a minor change as it is a commercial area and
closely related to LC_LI.
Commissioner Ilimmelnan asked what other areas wholesaling can be carried on in.
Building Official/Planner Ritchey stated in the M-1 and 111-2 zones.
Discussion followed.
Chairman Hillyer stated that a solution to some of the problems is to change an
area on the east side of Front Street to LC-LI.
Building Official/Planner Ritchey stated that by putting it in as a conditional
use in LC_LI the city still retains control over what type of business will
locate in that district; and suggested that the zone should start at Manzanita,
not Pine, as the first block either side of Pine Street should be reserved for
core area uses.
Discussion followed.
Commissioner Himmelman stated that in behalf of good planning, the Planning
Commission should do the zoning first and then deal with the uses in those zones.

Motion by Himmelman, second by Novasad to table the above resolutions until such
a time as further study of the zoning map is completed.
Poll call vote found all in favor, motion carried.

Meeting called back to order at 9:10 p.m. by Chairman Hillyer.

to Amend the Text of the Zoning Ordinance Deleting Residential Uses in
the C_3 District of the City.
D. Review of Resolution # , A Resolution of Recommendation to Amend
the Text of the Zoning Ordinance Deleting Residential Uses in the C-3
District of the City
Discussion followed.
Motion by Freeman, second by hood to table items C & D until further study is
completed on the zoning map. Roll call vote found all in favor, motion carried.
VII. No 11iscellaneous Matters.

the zoning map. Roll call vote found all in favor, motion carried.
