Roll call found Chairman Jean Ilillyer and Commissioners Theda Havice, George Freeman, Louise Novasad and Pat Himmelman present. :+bsent was hember Joy Dixon. Others present were City Administrator Dave Kucern, Building Official/Planner R.J. Ritchey, Planning Commission Secretary Georg Stotler-de Ruyter, City Council Member Ron Holmgren and several interested citizens. III. Secretary Stotler-de Ruyter stated that on page 3, paragraph 7, line 6, a comma should be inserted after "exterior walls" and 'before "and a parapet" , as all of the structures are required to have 1 hour fire resistant walls no matter what the sq. footage is, and if the structure is over 1000 sq. ft. a parapet is also required, Motion by P,avice, second by Freeman to approve the Minutes of the September 2, 1980 Planning Commission heeting with the above addition. New Business A. 1068 Plan Review - Sidewalk Improvement 336 Mazanita St J.C. Eap Page 37-2W-3DD, Lots 3 & 4, Block 3, Original Town City "Lone/C-2, Comp Plan Zone/Commercial Harold Salter, (General Contractor), Applicant Motion by Himmelman, second by Freeman to place this item on the October 7, 1980 Planning Commission fleeting Agenda as the applicant was not represented. Roll call vote found all in favor, motion carried. VIZ. Miscellaneous Matters A. Instructional Seminars - Land Use Planning Marvin Cloege, Philip Jackson, George Tiger, Oregon State University Extension Service. Seminars have been set for October 14 and October 28, 1980 at 7:30 p.m. in the Council Chambers. Both seminars will start at 7:30 p.m. ) 1 I':inutea Planning Commission Meeting September 16, 1950 - page 2 The Council is invited to attend. The cities of Gold Hill, Shady Cove, Phoenix, Talent, Jacksonville and Eagle Point will be invited to attend the seminar on October 14, 1980. The October 28, 1980 seminar will be for Central Point only. It was suggested that the agenda include an explanation and definition of extraordinary and unusual circumstances. Commissioner Dixon arrived at 8:00 p.m. B. Continuation of Review of Cherry Park Subdivision from the September 2, 1980 Planning Commission Meeting. North 10th and Cherry St J.C. Map Page 37-2W-2BC Daniel & Victor Kosmatka, Gerald Corcoran, Applicants Chairman Hillyer stated that because the variance requested by the applicants at the September 2, 1980 Planning Commission Neeting was not advertised, the action that was taken by the Planning Commission at the above meeting could not be ' considered an official action. Chairman Hillyer continued, asking the applicants if they would like the Planning Commission decision to stand or if they would like the Planning Commission to set a date for a Public Bearing, advertise the hearing and go through due process. Victor Kosmatka, 3094 hells Fargo Road, Central Point, Applicant, stated that he felt the decision would be the same, therefore to let the decision stand. Myron Corcoran, 3570 Hanley Road, Central Point, representing Gerald Corcoran, Applicant stated that he would like to do it legally. Chairman Hillyer stated that, by law, the Planning Commission cannot make design decisions for applicants, as it is the applicant' s responsibility to produce workable plans. Chairman Hillyer continued, stating that if the applicants are going to start over they should get it all together, bring it to the City in writing and submit it. Myron Corcoran stated that he felt the Staff did not want approval granted for what they had presented and that they are in a situation where thay don't know what to do. Mr. Corcoran further stated that they had some comparisons with some situations existing in Medford to present and that they would change their design If the Planning Commission would tell them which way to go. Chairman Hillyer stated that the Planning Commission connot advise them on such matters and asked Building Official/Planner R.J. Ritchey if he had any problems with the contour maps presented by the applicant. Mr. Ritchey stated that the Subdivision Ordinance requires that the contour maps be current. Ptinute s Planning Commission Meeting September 16, 1980 - page 3 Myron Corcoran stated that the only change is that the holes have been filled in, and to simply disregard the contour lines depicting depressions. Victor Kosmatka stated that they simply want to get ideas from the Planning Commission as an advisory group. Chairman Hillyer stated that the Planning Commission does not function as an advisory group but as a review body and that the applicant needed to hire a professional. Commissioner Havice asked the applicants if they had retained professional help. Victor Kosmatka stated that they had hired Verlyn Thomas, Professional Land Surveyor from Medford, and that Mr. Thomas was responsible for many subdivision designs throughout the area. Building Official/Planner Ritchey read from Section 16.24.040 stating "exisitng conditions shall be shown on the preliminary plat... 1) Two foot contour intervals for ground slopes less than five percent; 2) Five foot contour intervals for ground slopes exceeding five percent; ..." Pr. Ritchey continued, stating that he could see a problem building on the fill, that core samples, compaction tests and other tests would probably. have to be ' taken to see what the conditions are and that the possibility exists that it may have to be removed and re-compacted to proper compaction levels as the Oddfellows Lodge was required to do. Commissioner Havice stated that one of the problems is that a Preliminary Plat should be more complete and that this presentation is like a sketch of a subdivision. Commissioner Havice continued, stating that it is not that the Planning Commission is against the ideas presented, its that there is simply not enough to go on. Myron Corcoran stated that what they needed were more specific instructions from the Staff. Building Official/Planner Ritchey stated in answer to Mr. Corcoran's request, that included in the agenda packet for this meeting was a chronological list of several times lists of specific corrections were given to the applicants and suggested that the applicant prepare a new plat and submit written reasons for any variances requested. Victor Kosmatka stated that what he would like to do is to share comparable projects with Staff, that Medford has allowed, and go from there. The only difference is that the comparable project is a single family development and that their development would be more densely populated. Building Official/Planner Ritchey refered the Planning Commission to the Staff Report on the project stating that the Corcoran property has a potential of 255 dwelling units, that the roads need to be designed to handle this fond," and that the City had to assume that it will be developed to its maximum. Minutes Planning Commission electing, September 16, 1980 - page 4 Victor Rosmatka asked how much time they had to prepare a new proposal and still have time to advertise for a Public Hearing. Building Official/Planner Ritchey stated that the information required by the Subdivision Ordinance would have to be submitted by September 23, 1980 in order to give Staff time to review the proposal and advertise for the Public Hearing. Victor Kosmatka and Nyron Corcoran both stated that they would have it ready by that date. C. Building Official Ritchey stated that he had spent 3 days of last week at a Land Use Planning seminar in Eugene and that after talking with repre- sentatives from other cities that we are not the only city with problems. Most otherpeople are no more up on LCDC Goals and Guidelines than we are. Mr. Ritchey concluded by stating that compared to many of the other small cities we are advanced in procedure. VIII. Motion by Havice, second by Ilimmelman to adjourn. Roll call vote found all in favor, motion carried. adjournment came at 8:30 p.m.
