April 1, 1980 - Planning Commission Meeting
Central Point,Council Chambers
I. Meeting was called to order by Chairman Nordby at 7:30 p.m.
II. Roll Call found Chairman Nordby and Commissioners Hillyer, MacDonald,
Dixon and Himmelman present. Members Thelen and Stallsworth were
absent. Others present were City Administrator-
Dave Kucera, Mayor- Greg Dippel, Building Official-Planning Director-R.J. Ritchey,
Larry Denn, and Planning Commission Secretary-Georg Stotler-de Ruyter.
III. Motion by MacDonald, second by Dixon to approve the Minutes of March 18,
1980 Planning Commission Meeting. All in favor, Motion carried.
IV. Correspondence
Chairman Nordby presented letters from:
1) Department of the Army, Portland District Corps of Engineers regarding
a hydropower study. Commissioners MacDonald and Dixon expressed
interest in obtaining more information. Circular will be returned bearing
their names as contact persons.
2) League of_Oregon Cities regarding Regional Meetings Planning Workshop '
to be held in Medford, April 18 from 1-4:30. This will be a special
planning workshop regarding the use and implementation of the Comprehensive
Plan.

A. Review of Minor Partition Request

Applicant was not present at this time. Matter was moved. to a later
time on the agenda.
VII. Miscellaneous Matters
Building Official Ritchey presented information on "Restrictions on
Additional Dwelling Units on a Single Lot" ORD 1311, 1978. Section
17.28.085 Municipal Code, and suggested that this section was too
restrictive and that an ordinance change be considered that would allow the
Planning Commission some latitude on a case basis, for determining which
buildings could be considered acceptable for the addition of other units.
Study Session set for 7:30, Tuesday, April 8 on Solar Access Implementation.

City Administrator Kucers stated that the initial purpose of the Ordinance
was to prevent the building of two separate units and then selling off one of
them without going through the Minor Partition process. Mr. Kucera further
stated that the meaning of said Ordinance could be clarified by the addition
of one word, that being "no detached dwelling units shall be constructed...".
Mr. Kucera continued by stating that with such an Ordinance you get old
houses converted to multi-family dwellings, which may present a problem.
Building Official Ritchey stated that the existing building would have to be
brought up to existing codes before the addional unit could be constructed.

Building Official Ritchey presented the Staff Report and described the application.
Larry Dean stated that Mr. Miller, owner of property between subject property
and Snowy Butte has agreed to provide Mr. Denn with an 18 foot easement for a
water line with the conditions that he (1) not be assessed for any part of the
cost of installing the water line, and (2) that he could hook up to City water
at any time after the installation.
Mr. Denn stated that he has agreed to provide a line tap, curb stop, and meter
box, so that Mr. Miller would just have to run his line to it.
Discussion on flooding problem. Mr. Ritchey stated that the subject property is
higher than the ground across the creek and adjacent properties.
Larry Denn addressed several of the points on the Staff Report.
Discussion on traffic flow.
Motion by MacDonald to deny application with the right to re-submit within one
year, after major problems are resolved. Said problems being: (1) Bridge
traffic flow; (2) Easement for water line; (3) 100 year flood data needs
to be submitted.' Second by Himmelman. Roll Call vote found Chairman Nordhy,
Members Hillyer, Thelen, Dixon, and Himmelman in favor. Member MacDonald
opposed. Motion carred.
VIII. Adjournmettit
Motion by MacDonald, second by Hillyer for adjournment. All in favor,
Motion carried. Adjournment came at 9:05 p.m.
