Planning Commission Meeting Minutes

I. MEETING CALLED TO ORDER
at 7:00 p.m.
II. ROLL CALL: Present were: Chuck Piland, Herb Farber, Candace Fish, Lloyd
Governor, Randy Graves and Karolyne Johnson. Diane Galley had called to
inform the Commission that she would not be able to attend. Also present were
Dave Kucera-City Administrator, George Rubaloff-City Administrative Assistant,
Mark Servatius-Fire Chief/Building Official, Larry R. Blanchard-Public Works
Director, and Cecelia Gordon-Planning Commission Secretary.
Ill. APPROVAL OF MINUTES
Commissioner Fish moved to approve the Minutes of the April 6, 1993 Planning
Commission Meeting. Commissioner Graves seconded the Motion. Roll Call
Vote: Farber, yes; Fish, yes; Governor, yes; Graves, yes; Johnson, yes; and
the Motion passed by a unanimous vote.
IV. CORRESPONDENCE - None
V. BUSINESS
A. Public Meeting - Review and Recommendation for Annexation Request
for 14.82 acres located on the south side of Taylor Road, east of Grant
Road (Applicants: Bohnert. Benston & Mahar.)
Chairman Piland opened the Public Meeting.
George Rubaloff, Administrative Assistant, reviewed his Staff Report of May
10 1993 including the description, guidelines, follow up process and criteria,
and entered The Staff Report and the following items into the record by
reference: Maps, Annexation Application, and Public Works Department Report.
Mr. Rubaloff informed the Commission that Hoffbuhr and Associates were the
applicants' agent in this land action.

Larry Blanchard, then responded to the Commission's question of if the City's
water supply was adequate to service the additional 50 to 60 lots, by
answering that the water the City of Central Point received from the Medford
Water Commission would in fact be able to supply these additional lots.
Doug McMahan, Hoffbuhr and Associates, 1062 E. Jackson, Medford, Oregon
came forward in support of the Annexation Request as Agent for the
Applicants.
The Commission asked if the Developers planned to keep the existing homes,
and Mr. McMahan replied that they would keep the Benston and Bohnert
homes.
Clarification was provided to the Commission that the proposed annexed
territory lies with both the R-1-8 and the R-1-10 zones.
Commissioner Graves asked if this would tie into Donna Way.
Mr. McMahan answered yes, and there would be an access from the south. ,
No one else came forward in support of or in opposition to the application for
annexation.
There were no further questions or discussions.
Chairman Piland closed the Public Meeting.
Commissioner Fish moved to recommend that the Council approve the
annexation of the 14.82 acres located on the south side of Taylor Road, east
of Grant Road. Commissioner Johnson seconded the Motion. Roll Call Vote:
Farber, yes; Fish, yes, Governor, yes; Graves, yes; and Johnson, yes. The
Motion passed unanimously.
B. Public Hearing - Review and determination of Tentative Plan Application
for Tyler Park Subdivision located on the south side of Hopkins Road
directly east of Kingsland Manor Subdivision (Aoolicant Noel Moore dba
W.L. Moore Construction Co.)

Chairman Piland opened the Public Hearing.
George Rubaloff, Administrative Assistant reviewed the April 28, 1993 Notice
of Public Hearing, sent to Owners of Record, within a 100 foot radius, and
highlighted the procedure for testimony and written comments.
Mr. Rubaloff stated that City Staff had done a complete technical review, and
that they were satisfied that the plan meets the requirements, provided the
Developercan meet all the conditions in Exhibit "A" of the Public Works Report.
Larry Blanchard, Public Works Director, stated that on page 42 in the Packet,
Exhibit A - #5, requires that the developer install new curb and gutter and
driveway approaches, and #9, requires a Temporary Turn-around (that meets
City Approval) and #10 requires a 1' access control strip be shown on the Final
Plat.
There were no conflicts of interest. Commissioner Herb Farber reported that
there was a possibility that he had ex-parte communication, because of working
on another development in the immediate area.
Chairman Piland explained for the record, the description of ex-parte
communication as it applies to the Planning Commission members.
Mr. Rubaloff also outlined his Memo of May 10, 1992 containing the following
the land use history, and entered these items and the following exhibits into the
record by reference: Maps; Application, and Public Works Department Staff
Report dated April 26, 1993.
The Commission pointed out an error on Page 26 of the Packet, George
Rubaloff's May 10, 1993 Memorandum in the second paragraph should be
Tyler Park Subdivision, not Griffin Creek Estates. This was corrected for the
record.
Noel Moore, 3600 Westover, Central Point, Oregon came forward in support
of the proposed Application for Tentative Plan.
Mr. Moore assured the Planning Commission that staff had been working with
him and he was aware of the Public Works requirement.

Mr. Moore also stated that he was working with Mr. Whittle (developing
contiguous property) for the temporary turn around.
In regards to a concern from the Commission regarding homes encroaching the
storm drain easement, Mr. Moore said that he would design the homes in such
a way that they would not be on the easement.
Doug McMahan, Agent for Noel Moore (Tyler Park) came forward in support of
the subdivision, and stated that most of the utilities are already in place.
Mr. Rubaloff asked if the Commission would like to see the plan that Hoffbuhr
prepared in response to the Information Needed Items on Page 44. Mr.
Rubaloff handed out copies of the latest Tentative Plan to the Commission.
No one else came forward in support of or in opposition to the proposed
application for Tentative Plan.
Chairman Piland closed the Public Hearing.
Larry Blanchard, in answer to the Commission, explained that this Plan is ,
generally consistent with the City of Central Point, Master Street Plan. The
Master Street Plan is conceptual, and developed for the purpose of planning the
course of storm drainage. For the record, the Tyler Park Subdivision drawing
does not match exactly.
Larry also explained that Hopkins, Juanita and Columbine would tie in with
other streets, thus avoiding dead end streets.
Commissioner Fish moved that Resolution 255 for Application of Tentative Plan for
Tyler Park Subdivision located on the south side of Hopkins Road directly east of
Kingsland Manor Subdivision be approved based on the Applicant meeting all
conditions outlined in the Staff Reports. Commissioner Johnson seconded the Motion.
Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; Graves, yes; and Johnson,
yes. The Motion passed unanimously.
C. Public Hearing - Review and determination of Tentative Plan Application
for Griffin Creek Estates located on the north side of West Pine Street in
the vicinity of where Corcoran Lane intersects with West Pine Street.
(Applicants: Ted and Nadine Branch, and Bob Bauman). '

Chairman Piland opened the Public Hearing.
George Rubaloff, Administrative Assistant outlined in detail the Notice of Public
Hearing, highlighting the process for testimony and public comments. He also
LD noted that this was sent to owners of record within a 100 foot radius.

r�— Mr. Rubaloff reviewed his Memorandum of May 10, 1993 which included the
U land use history, (pointing out that staff had suggested in the past that full-
[n transition lanes meet ODOT Standards). Mr. Rubaloff also stated that traffic
Q safety is stressed because of stacking which would occur at W. Pine and
connection points. Mr. Rubaloff handed out copies of the Chapter 16 definition
and rules relating to through lots (and showed a map on the overhead showing
how the road will impact 4 lots). Mr. Rubaloff entered this information and the
following exhibits into the record by reference: Maps and Application for
Tentative Plan, Public Works Department Staff Report, dated April 27, 1993,
Resolution No. 242, approving a subdivision variance and Written Comment
from Arlen and Tina Hatlestad of 444 W. Pine Street (received 5/10/93), Letter
from Sharon and Gary Tift of 507 Palo Verde (Received 5/17/93), Letter from
David and Lynette Wittkopf 513 Palo Verde received 5/17/93, Letter from
Donald and Leona Blankenship, 530 Palo Verde, dated 5/17/93, Letter from
Aronda Webster 525 Palo Verde received 5/18/93, a letter from Sheri Miles and
Jamie Hurd of 501 Palo Verde, received May 18, 1993, a letter from Ted
Branch dated 5/18/93 and handed out tonight, and a copy of an Earnest Money
Agreement for the Bucher Property.
Larry Blanchard handed out (blue) copies of corrections to the April 27, 1993
Public Works Staff Report, (pages 64, 67 and 68 of the packet) showing
Nadine LOOP instead of Nadine Way, and that the through lots did not meet the
standard.
Herb Farber expressed a conflict of interest and removed himself from his
commission participation in the above matter.
There were no further conflicts of interest or ex-parte communication.

Ted Branch, 280 Manzanita, Rogue River, and Bob Bauman 1055 N. 5th St.
Jacksonville, Oregon came forward in support of the Application for the
Tentative Plan.
Mr. Branch reviewed his letter of May 18, 1993, (which copies were provided
to the commission and the public attending).
Herb Farber, 908 E. Jackson, Medford, Oregon, (Representing Developers)
came forward in support of the proposed Tentative Plan. Mr. Farber stated that
he designed this plan and did not interpret the City Ordinance to preclude
through lots. It was not the developer's intention to create hardships for
anyone. He stated that the developers would be willing to put a landscape
barrier screening the road to mitigate the impact of the street running along the
backside of the existing Palo Verde yards.
The Commission expressed that even if they moved the streets they would still
be through lots. There was some discussion about how to solve this problem, 1
and Herb Farber offered the idea of a common area, a Tax Lot owned by the
homeowners association. George Rubaloff asked about the possibility of
creating a substandard Tax Lot.
Mr. Farber stated that the financial responsibility of making significant
improvements to Pine Street, was not fair to such a small subdivision of only
17 small lots. He also expressed that this was a very difficult area to develop,
and that the latest design is the best of any submitted to the City of this
property.
Mr. Farber stated that he was finished on the presentation of his support of the
project, but would like to reserve to right to come back before the Commission
for rebuttal.
Chairman Piland declared a 5 minute recess.

Steve Keohart, 531 Palo Verde came forward in opposition to the Tentative
Plan. He stated that when a sign says "no through street" people soon learn
to use that street for a way to loop around back to W. Pine. He felt the
proposed Nadine Loop was not a desirable street because it would too close to
his property, which would not only impact the value of his lot, but would have
a negative effect on his family's health.

N Arlen Hadlestad, 444 W. Pine came forward in opposition to the Tentative Plan.
[\ He stated that the "no through street" signing would be a hazard for emergency
( ) vehicles. And that the small children in that area (Kindergarten through 5th
m Grade) that attend Mae Richardson do not ride the bus, but walk to school. He
Q felt this new plan would make the walk to school even more hazardous for the
children. He also stated that he did not want to see Tax Lot 5100 landlocked.
Aronda Webster, 525 Palo Verde came forward in opposition to the Tentative
Plan. She stated that in her opinion the developers' priority was to make a
profit and that they had not considered the loss of privacy of the homes already
there.
Sharon Tift, 507 Palo Verde came forward in opposition to the Tentative Plan.
She stated that this was not well planned, and that she felt this would be a
violation of their privacy, and that she did not approve. She also brought up the
issue of vandalism by having an additional street in back of the property.
Herb Farber returned to express his rebuttal. He stated that he felt this was a
workable plan. And that the developer can overcome the problem of where the
school children walk, by putting sidewalks on Pine Street. And to address the
issue of vandalism, Mr. Farber felt there was a greater chance of vandalism
without the added houses that would be in the new subdivision.
Sharon Miles - 501 Palo Verde - Came forward and expressed that she did not
want the added traffic adjacent to her property. House were fine, but street
behind them, no.
Ted Branch came forward to express his thanks for everyone's opinion, and
stated that this was not easy to develop and had already cost them a lot of
money.
No one else came forward in support of, or in opposition to the Tentative Plan.
Chairman Piland closed the Public Hearing.

George Rubaloff clarified, that Tax Lot 5100 would not be landlocked, as it
currently has an access off Pine Street.
Mr. Rubaloff explained to the Commission that the issues to deliberate were the
criteria for approval, the testimony and evidence as it relates to criteria.
Commissioner Graves stated that since the through lots do not meet the rules,
then the Commission could not approve the Tentative Plan.
Commissioner Governor moved that the Commission direct staff to prepare a
Resolution outlining reasons for denying the application, based on the fact that
the through lots do not meet the criteria for approving Tentative Subdivision
Plans.
Commissioner Graves seconded the Motion. Roll Call Vote: (Farber-
excused)Fish, yes; Governor, yes; Graves, yes; and Johnson, yes. The motion
carried by majority vote.
VI. MISCELLANEOUS - Commissioner Graves wanted to know if the Resolution '
was approved for Malot's Jackson Creek #5. Mr. Rubaloff stated that it was.
VII ADJOURNMENT:
Commissioner Governor moved that the meeting adjourn. Commissioner
Graves seconded the Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor,
yes; Graves, yes; and Johnson, yes. The Meeting adjourned at 10: 15 pm.
