PLANNING COMMISSION MINUTES
December 1, 1992 - 7:00 p.m.
LO I. MEETING CALLED TO ORDER
(U Chairman Garth Ellard called the meeting to order at 7:03 p.m.

Q Randy Graves, Karolyn Johnson, and Chuck Piland
III. CORRESPONDENCE
Chairman Ellard opened the meeting to anyone that would like to come forward
regarding anything not on the agenda. No one came forward.
George Rubaloff informed the Commission that the City Council would be
conducting a review hearing of the Corcoran Land Partition and the Site Plan
for Willow Glen Apartments on December 17, 1992. No one else came forward
IV. BUSINESS
A. Public Hearin - Review and Determination for Tentative Plan for
Griffin Creek Estates Subdivision south of Flagstone Subdivision, north
side of West Pine in the proximity of where Corcoran intersects with
West Pine.
Ellard asked the commission if there were any conflicts of interest or
exparte communications regarding this item. There were none.
Chairman Ellard opened the public hearing.
Rubaloff outlined the tentative plan application and asked if the
Commission wanted an oral explanation of the Tentative Plan process.
All commissioners felt they did not need any further explanation.
Rubaloff stated during the hearing that the public will be able to ask
questions and give testimony about the Tentative Plan. Any member of
the public intending to appeal a decision on the Tentative plan will need
to file their concerns in writing no later than the close of the public
hearing. Rubaloff also stated that any testimony or written comments
about the Tentative Plan will need to be related to the proposal and
should be stated clearly. This will help the Planning Commission to
better respond to public concerns.

Rubaloff entered the properties included in the proposed subdivision by Tax
Lot number:

Rubaloff explained the review process and described the application,
pinpointing the location as south of Flagstone Subdivision on the north of West
Pine in the proximity of where Corcoran intersects with West Pine Street and
situated east of the Presbyterian Church.
Rubaloff outlined the background to this application as described in the Staff
Report of 11-20-92, and outlined the standards as found in CPMC Chapter 16
relating to street, water system, storm drainage and sanitary sewer, and
Chapter 17 having to do with lot dimensions.
Rubaloff entered into the record the following exhibits: Notice of public
hearing; maps; application; Public Works Department Staff Report dated 6-16-
92; Resolution No. 241-A recommending approval of the plan; Excerpts of
Planning Commission Minutes dated 6-23-92; Letter to Ted Branch dated July
9, 1992; Resolution No. 242 approving a subdivision variance; Supplemental
Report from Public Works dated 11-23-92; Written comment submitted by Art
Friesen dated July 13, 1992; and written comment submitted by Dewayne
Brown dated November 24, 1992.
Blanchard outlined the street improvement conditions on Exhibit A of the
11-23-92 Staff Report explaining the acceleration and deceleration
requirements. Blanchard explained that there is currently a Deferred
Improvement Agreement (DIA) with the property owner (Wilson) of lots 4900
and 5000 in that area that requires them to be responsible for improvements
to the section on West Pine that fronts these lots (approximately 120 feet).
Developer Ted Branch of 280 Manzanita, Rogue River and Surveyor Herb
Farber of 675 Glenn Way came forward and spoke in opposition of widening
West Pine and in opposition of the developer being responsible for
reconstruction of the box culvert in that area. Farber addressed that the
total volume of work that was being proposed was not appropriate for the
developer. Mr. Branch commented that he had no prior knowledge of the DIA
for Tax Lots 4900 and 5000.
Ellard referred to the Commission for questions. Rubaloff stated to the
Commission that Mr. Branch had,received his Planning Commission Agenda
with information regarding the Deferred Improvement Agreement on November
25, 1992.

In response to written concerns submitted by Art Freisen and Dwayne Brown,
Ln the applicant made a commitment to the Planning Commissioners to:
N 1. Send written notice to the subcontractor's advising them to only use the
front entrance as ingress and egress, and not to use private property
U as access
m 2. Install an earthen barricade to prevent access to the site via private
property
Q 3. Require builders and buyers to install a uniform fence (good neighbor
style) between the site and adjoining property, as it is developed,
running the full length of the subdivision boundary.
4. Have an on-site person, full time, during construction to oversee
project activities.
Don Wilson of 446 W. Pine (owner of tax lots 4900 and 5000) came forward in
opposition of the full street widening of West Pine Street requirement.
The Public Hearing was closed.
Following the Commission's discussion, it was determined that the west
entrance of the project would not need acceleration-deceleration lanes, but the
east entrance is to be fully improved, including acceleration and deceleration
areas, lanes and tapers. Also, the box culvert on the east entrance of the
project will not need to be extended. The Commission requested the developer
to submit drawings to include curbs, sidewalks and a clearer description of
how the west entrance would be completed.
Developer informed the Commission that the triangle at the northeast corner
of Lot 1 is, in fact, a part of Lot 1. Also, tax lots 200, 4900 and 5100 will have
curb, gutter and sidewalks installed by the developer.
In conclusion, Rubaloff stated that the proposed Tentative Plan for Griffin
Creek Estates Subdivision could meet the applicable development requirements
outlined in CPMC Chapters 16 and 17 provided that the applicant meets the
conditions and requirements listed in Exhibit A of the November 23, 1992
Supplemental Public Works Staff Report.
The Commission decided to defer a decision regarding the Tentative Plan until
the December 15, 1992 Planning Commission meeting.

V. MISCELLANEOUS
The commission was informed by Rubaloff that the commission minutes of the
November 17, 1992 meeting were being reviewed and would probably be
available at the December 15, 1992 meeting at which time the Commission will
review a draft resolution and drawings (furnished by the applicant).
VI. ADJOURNMENT
Bettenburg made a motion to adjourn. Piland seconded. All members
indicated approval of the adjournment by saying Aye. The meeting was
adjourned at 10:00 p.m.
