Planning Commission Meeting Minutes

I. MEETING CALLED TO ORDER
at 7:00 p.m.
II. ROLL CALL: Present were: Garth Ellard, Candace Fish, Lloyd Governor Randy
Graves, and Chuck Piland. Also present were Dave Kucera-City Administrator,
Lo George Rubaloff-City Administrative Assistant, Larry R. Blanchard-Public Works
(\J Director, Mark Servatius, Fire Chief/Building Official, and Cecelia Gordon-
Planning Commission Secretary. Karolyn Johnson had previously asked to be
C) excused. Rick Bettenburg arrived after the Roll Call.

Q III. APPROVAL OF MINUTES
Commissioner Fish moved to approve the Minutes of the November 3, 1992
Planning Commission Meeting. Commissioner seconded the Motion. Roll Call
Vote: Fish, yes; Governor, abstain; Graves, yes; Piland, yes; and the Motion
passed by a majority vote.
IV. CORRESPONDENCE - None
V. BUSINESS
A. Public Meeting - Review and determination on Final Plat for 37 2W 26C, Tax
Lot 1100, Gerald and Esther Corcoran - Applicants.
George Rubaloff, Administrative Assistant, referred to and read into the record
his Staff Report of November 13, 1992. Rubaloff explained the process for
Final Plat approval for Land Divisions including the Legal Review concerning the
Letter of Credit and entered the following items into the record by reference.
Location Map, Memorandum, dated 11/13/92 from Larry Blanchard, Public
Works Director, Application for Final Plat for Land Partition and a copy of the
previous Planning Commission Resolution No. 243, approving the Tentative
Plan.
Rubaloff also handed out 2 letters of Credit. One from the Bank of Salem, in
the amount of 860,741 .35 (which has been reviewed and approved by the City
attorney). The 2nd letter of credit from the Western Bank in the amount of
820,246.65, which was just faxed today, and has not had a chance to be
reviewed by the City attorney. (for a total of 880,988.00)

Rubaloff brought to the Commission's attention, that the Motion on the
proposed Resolution should include wording to the effect that the City Attorney
will review and approve the letters of credit for form and content to ensure that
they guarantee performance under the Development agreement, and that the
required dedications on Cherry Street are completed and recorded.
Rubaloff also explained that the action before the Commission tonight was to
a Final Plat for a Land Partition. That Final Plat approval is ministerial, that it
must be consistent with the Tentative Plan and all requirements listed in the
Memorandum from the Public Works Director have been met.
Also as a matter of record, Rubaloff stated, that in response to Mr. Corcoran's
wish to NOT be called Developer, that the wording in the Development
Agreement has been changed to "Corcoran".
Chairman Ellard asked if the Commission had any questions of Staff.
Doug McMahan, Land Surveyor, 1135 5th Street, Gold Hill, representing the
applicants, came forward in support of the project.
Chairman Ellard inquired about the Landscape Plan. Rubaloff stated that the
requirements for the landscape plan did not pertain to the Land Partition action;
the Landscape Plan is a condition of the Site Plan approval for Willow Glen
Apartment purposes).
The Commission asked Mr. McMahan if there had been any changes since the
Tentative Plan. Mr. McMahan stated that there was a shift in relocating the
bulb (turnaround).
The Commission was assured by Rubaloff that the changes were small, and
that the Final Plat was still in 'substantial conformance'. Mr. McMahan
submitted the original Final Plat to Rubaloff.
Chairman Ellard explained that this evening's meeting was not a public hearing,
but an action on the Final Plat of the Land Partition, but offered 5 minute
increments to those present in the audience.
Dan Kosmatka, 33 Bellair Court, Medford, Oregon, came forward in support of
the proposed Final Plat.

Scott Foster, 5775 Dark Hollow Road, Medford, Oregon from the Housing
Authority, came forward in support of the proposed plan, and added that the
proposed units are not "low cost housing" but affordable rent housing for
working people earning $7.50 to $12.00 per hour, and would have a pleasant
appearance such as a typical market rate complex. In answer to the
Commission, Mr. Foster stated that the Housing Authority has a 15 year
LO commitment as manager, and hopefully would have the first right of refusal,
N when the housing complex goes on the market.
U Skip McGee came forward, and said that he was surprised and confused, and
m felt that the City had not done sufficient noticing. He said that he was not
Q owner of record, but felt that he should have been noticed.
Rubaloff explained that according to State law, the City mails a Notice to
property owners of record within 100' of the subject property, 20 days prior
to Hearing.
Mr. McGee felt this type of development would make it impossible to market
surrounding property, and voiced his opposition to this project.
Mary Coleman, 828 Maple Street, Central Point, came forward in opposition to
the project, exclaiming that the traffic was already dangerous, that the school
would not be able to handle all the children this project would bring in, and that
she was opposed to a complex of this size.
Scott Knapp, 846 Maple Street came forward, asking who would pay for the
widening of the two streets. The Commission assured Mr. Knapp that street
improvements would be paid for by the Developer. Mr. Knapp also stated that
he was opposed to such a project, that there would be no room to park, that
traffic would be impossible, and that low income housing would bring in
problems.
Tom Sharpe, 1105 Cherry Street, Central Point, came forward and asked Mr.
Rubaloff if he thought that nice single family residences would ever be built on
that site. Mr. Rubaloff said the property was zoned for multiple family
residential, and that he did not know if single family residence would ever be
built there. Sharpe stated that he did not think single family residences would
be built there and that after looking into the type of housing proposed in this
development, that he thinks it is a good alternative.

Myron Corcoran, 3570 Hanley Road, Central Point, came forward in support of
the proposed project, and stated that he manages some nice apartments in
Medford that are subsidized by HUD, and that they are clean, pleasant, and do
not attract undesirables.
Chairman Ellard explained that when Staff sends notices to the required
property owners of record, that they obtain the very latest information available
through the Jackson County Tax Assessor's records.
Commissioner Graves asked Rubaloff to explain what the process is from the
point of Application. Rubaloff said that initially, the developer and staff have
a meeting to discuss the preapplication process. Then the developer makes
application, Staff schedules staff Review (which includes several departments,
and then notifies property owners of record, within 100' of the subject
property, publishes reports in the Planning Commission Packets for Planning
Commission Review, Planning Commission Meeting.conducts a Public Hearing,
hears the oral staff report, taking testimony on both sides, and an opportunity
for rebuttal.
Graves asked how the public is notified. Rubaloff said that for Public Hearings,
the notices are mailed to property owners of record within 100' of the subject
property and for Public Meetings set for Site Plans, the notices are posted at
the Fire Station, The Central Point Post Office, City Hall and the Central Point
Library.
Commissioner Bettenburg moved that they approve Resolution 244 with the
addendums that the Letters of Credit would meet the approval of the City
Attorney, and that the necessary dedications for Cherry Street be completed,
thereby granting approval of a Final Plat for a land partition on Tax Lot 1100
(37 2W 26C) Applicants: Gerald and Esther Corcoran).
Commissioner Fish seconded the motion. Roll Call: Bettenburg, yes; Fish, yes;
Governor, yes; Graves,yes; and Piland,. yes, and the motion passed
unanimously.
VI. MISCELLANEOUS -
Dave Kucera announced to the people in the audience, that staff would remain
after the Planning Commission meeting had adjourned in order to address any
concerns.

George Rubaloff stated that a developer had asked that the Planning
Commission conduct a December 15, 1992 meeting in the event staff
completes review of the developer's application. All the Commissioners
present said they would be able to attend at that time.
LO VII. Commissioner Piland moved that the meeting adjourn, Commissioner Graves
N seconded the motion and the motion carried on a voice vote. The Meeting
