I. MEETING CALLED TO ORDER
at 7:05 p.m.
11. ROLL CALL: Present were: Garth Ellard, Rick Bettenburg, Candace Fish,
Lloyd Governor, Randy Graves, and Chuck Piland. Karolyne Hugo-
Johnson had phoned previously to inform the Commission that she
would not be able to attend. Also present were Dave Kucera, City
(v Administrator, George Rubaloff City Administrative Assistant, Mark
Servatius, Fire Chief/Building Official, Larry R. Blanchard, Public Works
(� Director and Cecelia Gordon, Planning Commission Secretary.
QIII. CORRESPONDENCE -
George Rubaloff handed out two memos to the Commission.
(1) Memo from George Rubaloff, dated May 5, 1992 requesting a
second Planning Commission meeting in May.
(2) Memo from George Rubaloff, Dated May 5, 1992, enclosing the
material on the status of the Fence Variance for Pacific Trend.
IV. APPROVAL OF MINUTES
Minutes of April 7th, 1992 is amended to show that Lloyd Governor in
attendance, and Candace (not Candice Fish).
Commissioner Governor moved to approve the Minutes of the April 7,
1992 Planning Commission Meeting with the above amendments.
Commissioner Fish seconded the Motion. Roll Call Vote: Bettenburg,
yes; Fish, yes; Governor, yes; Graves, yes; Piland, yes; and the Motion
passed unanimously.
V. BUSINESS
A. Public Meeting - Review and recommendation for a Tentative Plan for Green
Park Village Subdivision, Unit No. 3, located directly west of 1-5 in southeast
corner of City Limits (Applicant: Lou Mahar of Pacific Trend Building Company
(37 2W 12C TL 800 and 3100).

George Rubaloff outlined his Staff Report of April 20, 1992, and referred to the
following items: April 28, 1992 Addendum to Staff Report, Location/Zoning
Map, Tax Assessor's Map, Certificate of Posting, Application Materials,
including Tentative Plan Application (full size copy enclosed in Packet Plan, and
Public Works Director Report dated March 26, 1992. Rubaloff described the
application and entered all the above items into the record by reference.
There were no conflicts of interest or ex-parte communication on the part of
any of the Commissioners. Chairman Ellard opened the Public Meeting
Dennis Hoffbuhr, 1062 E. Jackson, Medford, Oregon agent for Pacific Trend
came forward in support of the application for the proposed Subdivision.
Commissioners asked Mr. Hoffbuhr if Pacific Trend were fully informed, and
were aware of all the remaining conditions they had to meet in this Subdivision.
Mr. Hoffbuhr replied that they had been meeting with staff, were fully informed
and agreed to meet all the remaining conditions.
When asked about the "noise barrier" that they planned to do between the
development and the freeway, Mr. Hoffbuhr explained that they would be
placing a fence 6' high on a 3' berm, and that the fence would be the same
design and material as exists around the front of Green Park Subdivision, which
is a wood fence with brick pillars.
Mr. Hoffbuhr said that the existing drainage easement belonged to Medford and
had been there for some time, and that Pacific Trend was aware of that
easement.
Commission asked staff if the sub-division check list had been reviewed by the
applicant. Larry Blanchard explained that this was standard procedure for each
subdivision, and that developers welcomed the process, and it was a graphic
way of tracking the process.
Mark Servatius pointed out an error on Page 17 in the check list, changing the
distance between fire hydrants from 500' to the corrected distance of 300'
apart.
No one else came forward in support of or in opposition to the matter.
Chairman Ellard closed the Public Meeting.

B. Resolution 234, a Resolution Recommending a Tentative Plan for Green Park
Village Subdivision, Unit. No. 3.
Commissioner Bettenburg moved that they recommend the above Resolution,
as corrected. Commissioner Graves seconded the Motion. Roll call Vote:
Bettenburg, yes; Fish, yes; Governor, yes; Graves, yes; and Piland, yes; and
N the Motion carried unanimously.
C. Public Meetinq - Review and Recommendation for a Subdivision Variance
m relating to proposed Griffin Creek Estates project located south of Flagstone
Q Subdivision and generally north of where Corcoran intersects with West Pine
(37 2W 10AB TL 2100, 2500, 2200, 2400) (Applicants: Ted Branch, Nadine
Branch and Bob Bauman).
George Rubaloff, Administrative Assistant outlined his Staff Report of April 28,
1992 with the following attachments in the packet: Various Maps, Certificate
of Posting and Variance Application Materials, whereupon he described the
' Application and entered all the above items into the record by reference.
Rubaloff stated that the decision of the Commission on this matter will come
before the City Council at their May 21, 1992 Hearing.
There were no conflicts of interest or ex parte communication on the part of
any of the Commissioners, Chairman Ellard opened the Public Meeting.
Michael Lanier, 107 E. Main #7, Medford, Oregon, representing the applicants,
came forward in support of the proposed variance.
Mr. Lanier gave a report supporting the findings and conclusion of facts, stating
that this is an awkward piece of property to develop, due to past City approvals
and land use actions for other developments. Also that the developer's plan is
not detrimental to the City.
Mr. Lanier submitted a letter mis-dated May 4, 1991, Mr. Lanier corrected the
date to May 4, 1992 whereupon this letter was then entered into the record by
reference.
The Commission asked if the Fire Department could service a 560' cul-de-sac.
Chief Servatius said that with a 2 man engine company that the length of hose
and difficulty with the extended cul-de-sac, that the 400' long cul-de-sac would
be more efficiently served by the City Fire Department.

No one else came forward in support of or in opposition to the proposed
variance. Chairman Ellard closed the Public Meeting.
Commissioner Piland moved to deny the recommendation for the proposed
variance. Commissioner Fish seconded the Motion. Roll Call Vote: Bettenburg,
no; Fish, yes; Governor, no; Graves, no; and Piland, yes. The motion to deny
the recommendation was defeated.
Chairman Ellard called for a 10 minute recess.
After the 10 minute recess, the Commission convened, and Chairman Ellard re-
opened the Public Meeting.
Herb Farber, 908 E. Jackson, came forward in support of the proposed
variance. Mr. Farber stated that the applicant had tried to go with the through
street and a smaller cul-de-sac but the adjoining property owners (church)
objected to a street coming through their property, so the applicant came up
with the plan that is being reviewed tonight. '
Farber also stated that he felt encouraged by the City last meeting to redesign
this development with a turn-around on a 560' cul-de-sac.
Mr. Lanier stated that there was not one thing in the CPMC that says a
hardship cannot be a financial hardship.
He also said that if the City held the applicant to the 400' long cul-de-sac, that
the lots would be so large that they would not be able to market them to the
average home buyer.
Commissioner Governor moved that the variance be denied. Commission Piland
seconded the Motion. Roll Call Vote: Bettenburg, yes; Fish, yes; Governor,yes;
Graves, NO; Piland, yes; and the motion passed by a majority vote.
The Commission announced that there would be a Public Meeting held on May
12, 1992 to review the Resolution. There will also be a training session for the
Planning Commission members after the Public Meeting that same evening.

D. Public Meeting - Review and Recommendation for a Tentative Partition Plan on
Cedar Street between Rostell and Freeman Road. (Applicant: John Durham) (37
2W 11 BA TL 2402)
George Rubaloff outlined his Staff Report of April 20, 1992, pointing out the
(V Location/Zoning, Aerial Maps, Tax Assessor Maps, Certificate of Posting,
Application Materials (Full Size Copy Tentative Plan enclosed), Rubaloff
U described the application, referred to the Public Works Department Director's
m Report of April 30, 1992 with its attached exhibits, and entered all the above
Q items into the record by reference.
There were no conflicts of interest or ex-parte communication on the part of
any of Commissioners, Chairman Ellard opened the Public Meeting.
John Durham, 4260 Beagle Road, White City, Oregon came forward in support
of the proposed Minor Land Partition application.
Commissioners asked Mr. Durham if he was aware of all the conditions. Mr.
Durham said that he was fully informed and agreeable to those conditions.
The Resolution was corrected to read .58 acres (on page 17).
No one else came forward in support of, or in opposition to the proposed MLP.
E. Resolution No. 235, A Resolution Recommending a Tentative Partition Plan (37
2W 11BA.TL 2402) (Durham)
Commissioner Piland moved to adopt Resolution 235 as corrected.
Commissioner Governor seconded the Motion.
Roll Call Vote: Bettenburg, yes; Fish, yes; Governor, yes; Graves, yes; Hugo-
Johnson, yes and Piland, yes, and the Motion passed unanimously.

F. Public Meeting - Review and Recommendation for a Tentative Partition Plan
Adjacent to 530 Bush Street (37 2W 11 BD TL 600) (Jean Thoren).
There were no conflicts of interest or ex-parte communication, Chairman Ellard
opened the Public Meeting.
George Rubaloff outlined his Staff Report dated April 20, 1992, described the
application and entered the following items into the record by reference:
Location/Zoning, Aerial Map, Tax Assessor Map, Certificate of Posting,
Application Materials (Full size copy of Tentative Plan in Packet), Director's
report from Public Works Department, Dated April 30, 1992.
Dave Edwards, 823 W. 8th Street, Medford, Oregon came forward in support
of the Minor Land Partition Application.
Mr. Edwards concurred with Staff that the closest calculation for the square
footage of the easterly parcel was 10,502 square feet.
Commissioners did not have any questions of Mr. Edwards, or of staff. ,
No one else came forward in support of, or in opposition to the Minor Land
Partition Resolution.
G. Resolution No. 236, A Resolution Recommending a Tentative Partition Plan
(Thoren).
Commissioner Fish moved that the Commission approve recommending
Resolution No. 236, a Resolution Recommending a Tentative Partition Plan.
Commissioner Bettenburg seconded the Motion.
Roll Call Vote: Bettenburg,yes; Fish,yes; Governor, yes; Graves, yes; and
Piland, yes, and the Motion carried unanimously.
VI. MISCELLANEOUS - None
VII. ADJOURNMENT - Commissioner Bettenburg moved that the Planning
Commission adjourn. Commissioner Fish seconded the motion. The motion
carried unanimously on voice vote. Meeting adjourned at 9:35 p.m.
