ROLL CALL Those present were Garth Ellard, Rick Bettenburg, Jack Crumm, Dick Halley, Karolyne Hugo, Bob Matthews and Chuck Piland. Also present were George Rubaloff, City Administrative Assistant, Mark Servatius, Fire Chief/Building Official, Larry R. Blanchard, Public Works Director and Cecelia Gordon, Secretary. III. APPROVAL OF MINUTES Commissioner Piland moved to approve the January 8, 1991 Planning Commission Meeting Minutes and the motion was seconded by Commissioner Piland. Roll Call Vote: Bettenburg, yes; Crumm, yes; and Halley, Yes; Hugo abstained; Matthews, yes; and Piland, yes. The motion carried unanimously. IV. BUSINESS A. Public Hearing - Resolution #216 - Conditional Use Permit For Pet Grooming Service (The PUDgy's Tub) 237E Pine Within the City's Downtown Business District (C-3 Zone) (37 2W 3DD TL 10800). City Administrative Assistant, George Rubaloff, entered into record by reference the Notice of Public Hearing mailed to adjacent property owners, Mailing List, Certificate of Posting, Application Materials, July 20, 1982 Planning Commission Minutes, Planning Department Staff Report including Conditions of Approval dated January 28, 1991, Zoning Map, Aerial Map, Vicinity Maps, and Tax Assessor's Map, proposed Resolution approving Conditional Use Permit. George Rubaloff reviewed the Conditions of Approval with the Commission and assured the Commission that the applicants and staff had reviewed and discussed those conditions prior to tonight's Planning Commission Meeting. Two of the Commissioners, (Matthews and Bettenburg) had a conflict of interest and excused themselves from their Commission seats and joined the public in the audience. Chairman Ellard opened the Public Hearing. CITY OF CENTRAL POINT Planning Commission Meeting Minutes February 5, 1991 Page Two Representing the business as an employee of "The Puppy's Tub", Janet London General Delivery, Central Point, Oregon came forward to answer questions and discuss the project with the Commission and Staff members. Doris Kunce, 237 E. Pine, Central Point, Oregon, owner of the business came forward as well. Kathy Gorden, 4825 Old Stage Road, Central Point, Oregon,(wife of applicant and property owner) also came forward to respond to any concerns from the Commission or Staff. The Commission's concerns about parking space, number of pets served per average business day ten (10) pets, and business hours of operation (8 a.m. - 5 p.m.) were answered satisfactorily. The Applicants reassured the Commission that no animals are contained outdoors on the site, nor will any animal be kept over night at the site. Fire Chief/Building Official, Mark Servatius asked the applicants about the extent of any remodeling or changes in the interior of the business. Ms. London assured him that no structural changes were involved, that they just covered over cracks in an old non functioning door, in order to prevent noise and odor transferring to the PP&L Office next door through the crack. Carol Fisher, 1148 N. 5th Street, Central Point, came forward in support of the the business. No one else came forward in support of or in opposition to the Conditional Use Permit Application. Chairman Ellard closed the Public Hearing. Commissioner Piland entered the motion that the Commission approve Resolution 216 for Conditional Use Application for Pet Grooming Service (The Puppy's Tub) at 237 E. Pine - 37 2W 3DD Tax Lot 10800. (Applicant Milton Gorden). Commissioner Halley seconded the motion. Roll call vote: Crumm, Yes; Halley, Yes; Hugo, Yes, and Piland, Yes. The Motion carried unanimously. Commissioners Bettenburg and Halley returned to their positions on the Commission. CITY OF CENTRAL POINT Planning Commission Meeting Minutes February 5, 1991 Page Three B. Determination regardina Site Plan Application for a 4000 square foot general commercial building at 788 S Front Street in the C-5 Zone further described as 37 2W 11 BC TL 6200 (Applicants: William and Mary Jo Saxburv) Administrative Assistant, George Rubaloff referred to and entered into the record by reference the Planning Department Memorandum dated January 30, 1991, Vicinity Maps, Certificate of Posting for Public Meeting, Site Plan Application Materials, Tax Assessor Maps, Aerial Maps, Planning Department Site Plan Review Dated January 31, 1991, Public Works Department Site Plan Review dated February 1, 1991, and Reduced copy of Site Plan for the Saxbury Furniture Store addition. Rubaloff referred to the January 31, 1991 Planning Department Report and Public Works Department Report of February 1, 1991 with the Commission and assured them that staff had shared the Conditions with the applicants on Monday, February 4, 1991 . Chairman Ellard asked if there were any conflicts of interest, there were none, Chairman Ellard opened the Public Meeting. Applicant, Bill Saxbury, 2580 Beall Lane, Central Point, Oregon came forward in support of the Application and to respond to the Commission. The Commission was concerned that since this is an application for a shell (building) only, that there may be a demand for more parking. George Rubaloff assured the Commission that staff had used a formula for the highest volume of parking spaces needed for most general commercial uses, and that there is more than ample room for any future expanded parking on applicant's property. Mr. Saxbury commended staff for their assistance and that he wanted to make sure they knew how much he appreciated their facilitating his application in such a professional manner. No one else came forward in support of or in opposition to the Site Plan Application. CITY OF CENTRAL POINT Planning Commission Meeting Minutes February 5, 1991 Page Four Commissioner Halley moved to approve the Site Plan Application based on the Conditions in the January 31, 1991 Planning Department Report, and the Public Works Department Report dated February 1, 1991 . Commissioner Bettenburg seconded the Motion. Roll Call Vote: Bettenburg, Yes; Crumm, Yes; Halley, Yes; Hugo, Yes; Matthews, Yes, and Piland, Yes, and the Motion passed unanimously. V. MISCELLANEOUS 1 . Central Point Population City Administrative Assistant, George Rubaloff reported that Portland State University's latest figures from their February 1, 1991 Report was that the population of the incorporated City of Central Point was 7,535. He also stated that the U.S. Census figures were very close at 7,509, and commented that City of Central Point was in a growth pattern. 2. Disclosure Information George Rubaloff, City Administrative Assistant handed out his Memorandum of February 4, 1991 for the Commission's information and review. (1) Definition of Ex Parte (2) Definition of Conflict of Interest (3) Excerpt from Central Point Municipal Code (1 .24.070F) relating to Disclosure Procedure There were no further miscellaneous items. VI. ADJOURNMENT Crumm moved that the meeting be adjourned, Matthews seconded the motion. Roll Call Vote: Bettenburg, yes; Crumm, yes; Halley, yes; Hugo, yes; Matthews, yes and Piland, yes. The motion carried unanimously. The meeting adjourned at 8:10 p.m.
